FOR THE CITY OF EDINBURG, TEXAS

1. INTRODUCTION

The City of Edinburg, Texas (“City”) is soliciting Statements of Qualifications and Proposals from qualified consulting firms to prepare a comprehensive Development Impact Fee Nexus Study in accordance with applicable Texas law, including Chapter 395 of the Texas Local Government Code. The purpose of this study is to evaluate, update, and support the City’s development impact fees to ensure they are technically defensible, legally compliant, and aligned with the City’s current and future infrastructure needs.

The selected consultant will provide professional services to analyze growth trends, infrastructure demands, capital improvement needs, and the proportional share of costs attributable to new development.

2. BACKGROUND

The City of Edinburg is one of the fastest-growing communities in the Rio Grande Valley and continues to experience residential, commercial, and institutional development. To ensure that new growth contributes its fair share toward necessary public infrastructure, the City intends to update or establish development impact fees supported by a legally compliant Nexus Study.

The study will serve as the technical foundation for potential adoption, update, or revision of impact fees for water, wastewater, roadway, drainage, and/or other eligible capital facilities as permitted by law.

3. PROJECT OBJECTIVES

The primary objectives of this project are to:

• Ensure full compliance with the requirements of the Texas Local Government Code (TLGC)

Chapter 395 and all applicable legal precedents.

• Establish a legally defensible nexus and proportionality between proposed development and impact fees.

• Evaluate and incorporate the City’s current Unified Development Code, Zoning Maps, Future

Land Use Plan, and Capital Improvement Plan/Impact Fee Infrastructure Plan (CIP/IIP).

• Determine the maximum allowable impact fees for the applicable facility categories.

DEVELOPMENT IMPACT FEE

TYPE AUTHORIZED UNDER NOTES

Water Impact Fees Texas Local Government Code

(TLGC) 395

Typically calculated per equivalent residential unit (ERU). Tightly regulated under Chapter 395, but clearly allowable using defined methodology.

Wastewater Impact Fees TLGC 395 Typically calculated per equivalent residential unit (ERU). Tightly regulated under Chapter 395, but clearly allowable using defined methodology.

ADD ALTERNATE PROPORTIONAL EFFECT OF DEVELOPMENT MITIGATION FEES

TYPE AUTHORIZED UNDER NOTES

Stormwater, Drainage &

Flood Control

TLGC 395 Typically calculated per square foot of impervious surface area (ISA). Tightly regulated under Chapter 395, but clearly allowable using defined methodology.

Parkland Dedication &

Development Fees

Conditional Development

Approval – typically included in a subdivision ordinance or planned development ordinance

Must have clear and standardized methodology in place – can be done as required land dedication, facility construction, or fee in lieu of dedication/construction.

Public Safety Facility Fee Conditional Development

Approval – typically included in a subdivision ordinance or planned development ordinance

Must have clear and standardized methodology in place – can be done as required land dedication, facility construction, or fee in lieu of dedication/construction.

Fees are not as common and subject to additional political and legal scrutiny.

Fire facility fees are generally more defensible than Police facility fees.

Roadway TLGC 395 Typically calculated per trip generation. Tightly regulated under Chapter 395, but clearly allowable using defined methodology.

Library Facility Fees Least common of listed fees. Ween done, typically through a specifically negotiated development agreement.

Not aware of any library facility mitigation fee that has been upheld by the Courts.

A City may negotiate with a developer to provide land or library facilities as part of an overall specific development agreement, but we advise not setting a mitigation fee for library development.

Or a Fee-In-Lieu option which allowed for contribution to a “Public Art Fund” which allowed for the city to provide for murals, public art displays, or cultural arts activities within the city.

• Distinguish existing deficiencies from growth-related capital needs

• Support the City’s Capital Improvements Advisory Committee (CIAC)

• Provide implementation tools, fee models, and ordinance-ready documentation

4. SCOPE OF SERVICES

The selected consultant shall provide, at minimum, the following services:

Task 1 – Project Initiation and Coordination

• Kickoff meeting with City staff and legal counsel

• Confirm facility categories, service areas, and assumptions

• Develop project schedule aligned with CIAC and Council timelines

Task 2 – Identify and Resolve Policy Issues

• Objective: Identify and resolve policy issues raised by the study.

• Description: Review agency documents related to existing capital planning policies and funding programs, including existing development impact fees. Bring policy issues to City staff’s attention, as appropriate, during the project and seek guidance prior to proceeding. Potential policy issues include:

o Adequacy of the City’s General Plan, specific plans and other public facility planning policies

(e.g. level of service standards); development impact fee ordinances and resolutions, and prior nexus studies;

o Incorporate the City’s existing public facility master plans and CIPs to identify needed facilities;

o Types of facilities to be funded by the water and wastewater fee;

o Incorporate the City’s current land use categories for imposition of fees;

o Nexus approach to determining facility standards;

o Nexus approach to allocating cost burden among land uses, including need for separate fee zones;

o Potential alternative funding sources, if needed;

o Funding existing deficiencies, if identified;

o Implementation concerns and strategies; and o Identify and clarify existing fees, and interview City staff regarding service levels for specific services.

• Deliverables: 1) Information requests: 2) revised project scope and schedule (if needed); and 3) a brief summary of policy decisions (if needed).

Task 3 – Identify Existing Development and Future Growth

• Objective: 1) Work with the City to identify the existing levels of development; and 2) identify a projection of future growth, consistent with current planning policy and the current future land use plan.

• Description: Identify base year for existing levels of development and for facility standards based on existing facility inventories (see Task 3). Include entitled development that would be exempt from the fee program.

Task 4 – Infrastructure Improvements Plan (IIP)

• Objective: For existing facilities fees, the project team will identify the type, amount and cost of facilities required to accommodate growth and correct deficiencies, if any from the City’s current Capital Improvement Plan.

• Description: Quantify total planned facilities, based on growth projections from Task 2 and facility standards from Task 3. Distinguish between: 1) facilities needed to serve growth (that can be funded by impact fees); and 2) facilities needed to correct existing deficiencies (that cannot be funded by impact fees). Use one of three cost allocation methods (existing inventory, system plan, or planned facilities) from the City’s current Capital Improvement Plan.

• Gather planning-level data on new facilities costs, based on lump sum project cost estimates or unit costs and project quantities (acres, building square feet, lane miles, etc.) from the City’s

Current Capital Improvement Plan.

• Review and make suggestions to the City’s current Capital Improvement Plan in accordance with

TLGC §395.042

• Identify capital improvements needed to serve new development from the City’s current Capital

Improvement Plan.

• Separate existing deficiencies from growth-related improvements

Task 5 – Calculate Fees and Prepare Report

• Objective: Provide technically defensible development impact fee report that comprehensively documents project assumptions, methodologies, and results.

• Description: Generate a fee schedule (impact fees and exactions) to apportion facility costs to individual development projects. The project team will take into account any existing fees and compare the projected fees to nearby and comparable municipalities.

• Prepare draft report tables for City staff to review that document each step of the analysis, including schedule of maximum justified fees by facility type land use category.
