Combined Synopsis/Solicitation for OCAR Fire Protection Services
This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This procurement is to support the Army Reserve Regional Support Command. The purpose of this contract is to provide technical fire services to each of the four RSC’s, one each at Joint Base McGuire-Dix-Lakehurst, NJ; Fort Jackson, SC; Fort McCoy, WI and Mountain View, CA. which include fire protection and health, life, and safety assessments of facilities and buildings. Services in Alaska, Hawaii, and OCONUS will not be required of this contract. Technical fire services include creating and maintaining a fire prevention program, assist in creating and overseeing fire system repair projects, providing input on life/health/safety facility issues, monitoring, and providing performance input on fire monitoring and on-post fire inspection programs, and providing technical fire expertise. The base period for this contract will be 12 months with the option of 4 additional 12 month periods. The contractor will be licensed and certified to perform inspections in accordance with the most recent version of Unified Facilities Criteria (UFC) 3-601-02. Most work products defined within this task order require the support of a NICET or NFPA licensed inspector. Military construction projects, facility modernization, rehabilitation, and repair projects where the scope of the fire protection and or life, health and safety require extensive or complex review, the contractor will provide review and analysis of the proposed elements by a licensed and/or certified fire protection engineer. The Government anticipates the award of a firm fixed price contract.
The combined synopsis/solicitation Request for Proposal (RFP) number is W912DY-22-R-0020.
This number shall be referenced by contractors on their proposals and related correspondence.
This RFP is 100% total small business set-aside. The NAICS code is 541330 (Engineering Services) with a small business size standard of $16.5 Million. Contractors must be registered in the System of Award Management (SAM) with no exclusions to be considered for award. The website for SAM is https://sam.gov/portal/. The clauses and provisions included in Section I are applicable to this acquisition. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-06.

Performance Work Statement
Army Reserve Support Technical Fire Services Support
United States Army Reserve Command (USARC)

1. PURPOSE
The purpose of this contract is to provide each Army Reserve Readiness Divisions with fire protection and health life and safety assessments of facilities and buildings located across CONUS. The contractor will be responsible for supporting and maintaining a fire and safety program in support of Army Reserve. For each of the four (4) locations detailed within this Performance Work Statement (PWS), the contractor will be required to:
A. Review design submittals, guidance documents and other documentation to assess compliance of those documents with current fire and life health and safety codes.
B. Upon the request of the Government to travel to a site location, the contractor will engage in on-site assessments of buildings and facilities in order to assess those buildings for compliance with fire protection and health, life and safety codes.
C. In the event a code compliance issue with a current building or facility is identified, the contractor will identify a means of mitigating and/or resolving that code compliance issue. An initial report detailing the code compliance issue(s) identified via an on-site assessment, the level of severity of the code compliance issue, and an assessment of mitigation measures will be provided to the Government within 24 hours of departure from the site location.
D. A more detailed assessment will be provided to the Government within 14 (fourteen) calendar days after departure from the site location. The purpose of this task order is to reduce health, life and safety risk of occupied buildings.
2. GENERAL REQUIREMENTS
This is a non-personal services contract to provide technical fire services support at various facilities in support four Readiness Divisions (RD). The Government shall not exercise any supervision or control over the contract service providers performing the services herein.
Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. Contractor personnel will be certified according to DoDM 6055.06, DoD Fire and Emergency Services Certification program version Jan 2, 2020, reference qualifications and certifications for fire inspectors. Pertinent code references include AR 385-10 Fire Protection, DoDI 6055.06, https://safety.army.mil/ON- DUTY/Workplace/Fire-Protection-Life-Safety-Code and other Government code and regulations requirements
A. Description of Services. The contractor shall provide all personnel, supplies, supervision, tools, materials, equipment, transportation and other items and non-personal services necessary to provide technical fire services in accordance with this Performance Work Statement (PWS) except as those items specified as government furnished property and services (refer to section 9.0 Government Furnished Items and Services below).
Provision of government furnished property will be limited to office space and support (telephone, printer, network access) at the various Readiness Divisions (RD). No Government personnel will provide services. The contractor shall perform to the standards in the contract as well as all local, state and federal regulations.
It is anticipated that each of the four RDs (see technical exhibit 4 below for actual locations) will require a dedicated individual to provide the level of support defined within this PWS. The Government preference is for a single contractor employee supporting this task order to be located at or near (within a four-hour drive) of each of the RD main office locations (see technical exhibit 4) or at an RD building in order to support training and network access. The Government is reluctant to fund relocation of an individual to any location. The contractor is directed to populate the four positions in direct support of each RD with individuals who are within this area of operations. RD locations are at the following locations: Joint Base McGuire-Dix-Lakehurst, NJ; Fort Jackson, SC; Fort McCoy, WI and Mountain View, CA.
a. Objective: The objective of this contract is to assist in providing technical fire services to each of the four RD’s, one each at Joint Base McGuire-Dix-Lakehurst, NJ; Fort Jackson, SC; Fort McCoy, WI and Mountain View, CA.
b. Scope. Technical fire services include creating and maintaining a fire prevention program, assist in creating and overseeing fire system repair projects, providing input on life/health/safety facility issues, monitoring and providing performance input on fire monitoring and on-post fire inspection programs, and providing technical fire expertise.
c. Period of performance. The period of performance will be a twelve (12) month base period beginning 30 September 2022 – 29 September 2023. In addition to four option periods to be exercised in accordance with FAR 52.217-8 (list option periods 1 – 4)

d. Quality Control (QC). The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. After acceptance of the quality control plan the contractor shall receive the Contracting Officer’s (KO) acceptance in writing of any proposed change to his QC system. The QC Plan will be submitted no later than 30 days after award to the contract. See attached QASP
e. Quality Assurance. The Government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan.
This plan is primarily focused on what the Government must do to ensure the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
f. Document Review: All documents produced as a result of this contract will be subject to Government review. The contractor will produce an initial draft version of all documentation and submit that draft document to the Government COR/KO/COTR for review. Any comments or requests for correction from any document produced will be produced by the Government within 14 days of receipt.
Comments and corrections to the documents will be completed by the contractor within a 14 day window. The contractor will engage the Government representative via telephonic or written documentation should the comment/question be ambiguous. Following the resolution of any comments/questions the contractor will produce a final version of the document.
g. Government Remedies. The KO Technical Representative (COTR) or Reporting Manager (RM) will notify the KO in writing of defective or unsatisfactory contractor performance. The KO will make the determination of appropriate remedial action based on the terms and conditions of the contract.
h. Special Qualifications: Fire protection inspection contractor shall be licensed and certified to perform inspections in accordance with the most recent version of Unified Facilities Criteria (UFC) 3-601-02. Contractor shall supply all certifications at time of bid. The vast majority of the work products defined within this task order should require the support of a NICET or NFPA licensed inspector as opposed to a licensed or certified engineer. In review of military construction projects, facility modernization, rehabilitation, and repair projects where the scope of the fire protection and or life, health and safety requires extensive or complex review, the contractor will provide review and analysis of the proposed elements by a licensed and/or certified fire protection engineer.
i. Type of Contract. The Government anticipates the award of a firm-fixed price task order.
B. SECURITY REQUIREMENTS.
This is an unclassified contract. There are no requirements for contractor personnel to have routine access to classified Government information in the performance of this contract effort; however, when required by the Government representative, because the contractor personnel are required to attend meetings, briefings or provide support on a full-time basis on-site at secure Government facilities, a valid, current final Secret eligibility and access must be granted and posted in the Joint Personnel Adjudication System (JPAS) to gain access.
Contractor personnel or any representative of the contractor entering the Reserve asset shall abide by all security regulations and shall be subject to security checks.
At no time shall the contractor allow anyone other than authorized contractor personnel into any locked or unlocked areas of the facility being serviced.
a. Personal Identity Verification (PIV). The Contractor shall comply with PIV procedures implemented by Homeland Security Presidential Directive-12 (HSPD- 12), Federal Information Processing Standards Publication (FIPS PUB) Number 201-1, Office of Management and Budget (OMB) Guidance M-05-24 and USARC.
The Contractor shall insert this clause in all subcontracts when the subcontractor is required to have physical access to a Federally-controlled facility or access to a Federally-controlled information system.
In accordance with HSPD-12, OMB M-05-24 and FIPS 201-1, unless a previous favorable background investigation has been completed in the last ten (10) years, all contractor employees will be the subject of a background investigation conducted by the Government. No contractor employee will commence work until the personnel security questionnaire (PSQ) paperwork has been completed, reviewed and submitted to the Office of Personnel Management (OPM) by USARC Security.
Contractor employees not meeting the minimum requirements will be the subject of a National Crime Information Center (NCIC) check prior to beginning work.
b. Visit Notifications. If the Contractor has previously been granted a facility clearance (FCL) through the Defense Industrial Security Contracting Office (DISCO), the Contractor Facility Security Officer (FSO) shall submit visit notifications via the Joint Personnel Adjudication System (JPAS) and in the format prescribed and provided by USARC Security through the Government COR.
Contractor is responsible to request access to a site location in a timely manner in order to gain access and stay current with base and facility access requirements.
i. If the Contractor is not cleared through DISCO, the Contractor will submit a signed visit request on company letterhead stationary through the Government COR. The request will include the full name (first, last, middle), date of birth, place of birth (city, state, country), citizenship, type of last investigation and date last investigation was completed.
ii. Non-US citizens will not be used in the performance of this contract unless the provisions of Army Regulation 25-2, Information Assurance have been fully completed and approval has been granted by the Government for the non-US citizen to perform the required support.
iii. Contractor employees performing the requirements of this contract, may be required to read and sign a Non-disclosure Agreements (NDA). Performance of this contract may require the contractor to access data and information proprietary to the Government agency or of such a nature that its dissemination or use, other than in performance of this contract, would be adverse to the interest of the Government or others. Requests for NDAs will be made on an as needed basis.
c. Responsibilities. All contractor employees shall read all applicable security regulations, to be provided by the Government. Contractor personnel shall familiarize themselves with the Government’s regulations and policies and site-specific regulations regarding access to sensitive materials, computer facility/IT network access, issue of security badges, etc., which shall be provided as required by the Government.
d. Physical Security. A portion of the work will be performed off the Government worksite. In the event that the contractor is required to work on a government site the following shall apply: (1) The contractor shall be responsible for safeguarding all government property provided for contractor employee use; (2) At the close of each work period, Government facilities, equipment and materials shall be secured.
e. Access Credentials. The Contractor shall establish and implement methods of ensuring all access credentials issued to the contractor employee by the Government are not lost or misplaced and are not used by unauthorized persons.
NOTE: All references to access credentials include Department of Defense (DoD) Building Pass, CAC, Kastle Key cards, or similar means of access credentials. No access credentials issued to the Contractor by the Government shall be duplicated.
The Contractor shall develop procedures covering access credentials that shall be included in the Quality Control Plan. Such procedures shall also include turn-in of all issued access credentials by contractor’s employees who no longer require access to secured areas or Government information systems. The Contractor shall immediately report any occurrences of lost access credentials to the COR who will report the loss to USARC Security.
f. Key Control. If the contractor is provided with keys to allow access to areas requiring service, they shall ensure they are not lost or misplaced and are not used by unauthorized personnel. The contractor shall not remove the keys from the premises nor are these keys to be duplicated. All keys that are provided to the contractor will require a logged entry signed signature and date. Keys shall be retained in possession of the janitorial staff while on the premises and returned to the Government representative prior to leaving the premises including a logged entry signed signature and date. All keys lost by Contractor’s personnel shall be reported to the COR immediately and shall be replaced at the Contractor’s expense.
In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the KO, re-key or replace the affected lock or locks;
however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock, or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total costs deducted from the monthly payment due the Contractor. The Contractor shall prohibit the use of Government issued access credentials by any persons other than the contractor employee to whom the credential was issued. The Contractor shall prohibit the opening of locked areas by contractor employees to permit entrance of persons other than contractor employees engaged in the performance of assigned work in those areas.
g. Security Training and Reporting Requirements. Personnel must maintain a valid
Common Access Card registered with approved credentials in Army Knowledge On-line.
h. AT Level I Training. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Upon request, the contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training by all employees and subcontractor personnel. AT Level I awareness training is available at the following website: https://atlevel1.dtic.mil/at/; or it can be provided by the RA ATO in presentation form which will be documented via memorandum.
i. Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractors’ employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
i. For contractors requiring Common Access Card (CAC). The contractor and all sub-contractors employees will be issued a CAC only if duties involve one of the following: (1) Both physical access to a DoD facility and access, via logon, to DoD networks on-site or remotely; (2) Remote access, via logon, to a DoD network using DoD-approved remote access procedures; or (3) Physical access to multiple DoD facilities or multiple non-DoD federally controlled facilities on behalf of the DoD on a recurring basis for a period of 6 months or more. At the discretion of the sponsoring activity, an interim CAC may be issued based on a favorable review of the FBI fingerprint check and a successfully scheduled NACI at the Office of Personnel Management.
ii. For contractors who do not require CAC, but require access to a DoD facility or installation Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
iii. Suspicious Activity Reporting Training. The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.
iv. Contractor Employees Who Require Access to Government Information
Systems. All contractor employees with access to a government info system must be registered in the Army Training Certification Tracking System (ATCTS) at commencement of services, and must successfully complete the DOD Information Assurance Awareness prior to access to the information systems and then annually thereafter in accordance with personnel security standards listed in AR 25-2 (Information Assurance), an appropriate background investigation will be conducted prior to accessing the government information systems. All contractor employees and associated sub-contractor employees must complete the DoD IA awareness training before issuance of network access and annually thereafter. All contractor employees working IA/AT functions must comply with DoD and Army training requirements in DoD 8570.01, DoD 8570.01-M and AR 25-2 within six months of employment.
v. OPSEC Training. All new contractor employees will complete Level I OPSEC
Training within 30 calendar days of their reporting for duty. Additionally, all contractor employees must complete annual OPSEC awareness training. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee, to the COR, within 5 calendar days after completion of training. OPSEC awareness training is available at the following websites: https://www.iad.gov/ioss/ or http://www.cdse.edu/catalog/operations-security.html; or it can be provided by the RA OPSEC Officer in presentation form which will be documented via memorandum.
vi. Escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas. All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.
vii. Pre-screen candidates using E-Verify Program. The Contractor must pre-screen
Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
viii. Threat Awareness Reporting Program. All new contractor employees will complete annual Threat Awareness and Reporting Program (TARP) Training provided by a Counterintelligence Agent, IAW AR 381-12. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee(s) or a memorandum for the record, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training. C. POST AWARD CONFERENCE/PERIODIC PROGRESS MEETINGS.
The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The KO, COR, and other Government personnel, as appropriate, will meet quarterly with the contractor to review the contractor's performance. At these meetings the KO will apprise the contractor of how the Government views the contractor's performance according to the stipulations of the QASP and the contractor will apprise the Government of problems, if any, being experienced.
Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.
3. SPECIFIC TASKS
A. GOVERNMENT REVIEW
All submittals will be subject to a 14-day Government Review period upon submission of a document. The contractor will be responsible for addressing each comment or question posed by a Government Reviewer.
B. TASK 1. TECHNICAL REVIEW
a. Contractor will provide technical review of plans for all military construction projects, facility modernization, rehabilitation, and repair projects, and self-help projects to ensure that all construction contains fire protection and life safety features required by Unified Facility Criteria (UFC) 3-600-01, and applicable NFPA codes. Technical design review will not include hydraulic calculations, occupant load/exit calculations, etc., but will ensure all required features are present and local emergency response elements are incorporated.
b. Contractor will provide technical review all fire alarm monitoring signals.
Contractor shall monitor and track status of the signals and provide guidance and assistance to have systems repaired as needed.
c. Contractor will evaluate all programs referenced and develop recommendations to inform decision makers on suggested implementation for continual change.
C. TASK 2. TECHNICAL SUPPORT
Contractor is required to respond to a request for technical support as defined below within 24 hours of receipt. An email acknowledging the request for support must be sent via email to the request originator and the COR. See QASP, section 5. Performance Standards.
a. Contractor will provide technical support and analysis on all fire protection system inspections conducted throughout the assigned AOR. Contractor shall monitor and track the status system inspection using an existing software program accessible to the USARC and provide reports to the assigned AOR on at regular intervals.
b. Contractor will provide technical specifications and resource estimates to inform AOR leadership in properly planning, programming, and executing all fire protection system inspections required throughout the assigned AOR.
c. Contractor will provide technical specifications to inform AOR leadership in creating and monitoring projects to repair or replace fire protection systems.
d. Contractor will provide technical expertise on all fire protection systems where needed, including advanced troubleshooting of systems to provide guidance on repairs or replacement when needed.
e. Contractor will provide technical specifications and resource estimates to inform the development and implementation plans to ensure all fire protection systems are properly inspected and maintained. Implementation plans shall be regularly reviewed and updated as necessary.
D. TASK 3. TECHNICAL COORDINATION
a. Contractor will liaison with RD Safety Office to provide inspections and technical documentation to facilitate their mission.
b. Contractor will provide life safety inspections in compliance with USAR, NFPA, and all other referenced codes and standards, including completing the forms at Technical Exhibits 1 and 2 when applicable.
c. Contractor will disseminate fire & life safety information throughout their associated RD to provide for a fire safe environment.
d. Contractor will investigate, or coordinate to be investigated, all fires on and within AOR owned properties
e. Contractor must conduct an information program to elicit an involvement in fire prevention, detection, and suppression. Regularly disseminate information through a variety of media, such as special command events, regular orientations, and workshops. Interact with a wide variety of employees and others in all aspects of fire prevention. Develop Standing Operating Procedures (SOP), program planning documents, and other material to establish and direct the fire inspection and life safety program for the assigned RD DPW.
E. TASK 4. TRAVEL
a. When requested, contract staff will travel to an Army Reserve Center to execute applicable elements of tasks 1, 2, or 3 above. The potential locations and assets which the contract staff may be requested to serve are not at this time defined. The contractor is advised that they may be required to travel to any location within the continental United States (CONUS); travel outside the continental United States will not be required. Travel to the States of Hawaii, Alaska, or OCONUS locations WILL NOT be required under this scope of work.
b. The output and required deliverable from a site visit will be two deliverables. An initial informal report to be provided to the on-site Government representative with 24 hours of contractor departure from the site location. A formal Life/Safety Inspection report, including forms at Technical Exhibits 1 and 2 (if necessary) to be provided within fourteen (14) calendar days after departure from the site location.
c. Given the uncertainty in the frequency and location of travel, the total travel budget for this effort will not exceed $75,000 per each 12 month period of performance. As the total cost of travel remunerated to the contractor approaches $75,000, the Government will begin 633to restrict travel. All travel will be discontinued if at any time the cost of travel exceeds $75,000. Contractor will provide a trip report summary of activities initiated and complete.
d. The Government anticipates that the majority of support as defined within this scope of work will be conducted at the contractor’s office location. When travel is required, it will be at the behest of the RD point of contact specified Technical Exhibit 4 below and will be approved by the PM/COR.
e. Upon the request of the RD PoC and subsequent to the approval of the PM/COR, the contractor will commence with making travel arrangements. The Contractor shall submit to the COR an SVAAPP for approval by the HNC Safety Office.
Contractor will only engage in finalizing travel arrangements (airfare purchase) after receipt of the approved SVAAPP (signed Form 7) from the COR. Contractor shall not execute any official site visit without advanced notification prior to requested official site visit nor will the Contractor execute official site visits without an HNC Safety Office accepted SVAAPP.
f. All travel receipts of the traveler will be submitted to the COR/KO along with the invoice in order to be eligible for reimbursement. All invoiced expenses will be reviewed, and determination made if the expense is in accordance with Joint Travel Regulations. All cost submitted for reimbursement will be determined by the KO to be reasonable, allowable, and allocable in accordance with DoD travel guidance.
F. MONTHLY REPORTS
Contractor will prepare written monthly progress report showing work accomplishments and backlogs and present executive summaries on all fire safety related issues and deficiencies for review by the DPW, Regional Engineer, COR, and others as required.

5. PERSONNEL
The Contractor shall provide the KO and COR or Regional Facilities Operational Specialist (RFOS) with a list of the names of employees or alternates to be employed in performance of the work within 15 calendar days of performance start date. The Contractor shall also notify the COR with any additions or deletions to the list of employees immediately.
A. Employees of the contractor assigned for performance of this contract shall be capable employees with sufficient experience and training to assure compliance with the contract requirements. The employees shall be required by the Contractor to maintain themselves and their clothing in a neat and clean manner. A fully qualified workforce shall be on board no later than the second week of the contract.
B. Conduct of personnel. The KO may require the contractor to remove from the job site any employee working under this contract for reasons of misconduct, security, or found to be or suspected to be under the influence of alcohol, drugs, or other incapacitating agent. Contractor employees shall be subject to dismissal from the premises upon determination by the KO that such action is in the best interests of the government. The installation commander has the authority to bar individuals from the installation. Such removal from the job site or dismissal from the premises shall not relieve the contractor of the requirement to provide sufficient personnel to perform the services as required by this PWS.
C. Identification of contractor employees. All contract personnel working in situations where their contractor status is not obvious to third parties are required to identify themselves by wearing clearly written and visible nametags at all times, as such to avoid creating an impression in the minds of members of the public that they are Government officials.
D. Organizational conflict of interest. The contractor shall not employ any employee of the United States Government, either military or civilian, if such employment may create a current or subsequent Organizational Conflict of Interest (OCI) as defined in Federal Acquisition Regulation Subpart 9.5. The contractor shall notify the KO immediately whenever it becomes aware that participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary.
E. Contract Manager. The contractor must provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the KO. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.
6. OPERATIONAL AND SAFETY REQUIREMENTS
The elements under this section are applicable contract personnel performing work under this effort.
A. Vehicle operation. Contractor personnel operating motor vehicles used in performance of this contract shall have a valid state operator’s license and shall operate all motor vehicles in accordance with policies and procedures established by the Reserve Center.
The contractor’s vehicles shall have an identification tag clearly visible while on site.
Parking by contractor employees shall be in non-reserved spaces available to the public.
B. Safety. The contractor shall maintain a safe working environment to prevent accidents and preserve the life and health of contractor personnel and Government personnel. The Contractor shall instruct employees in appropriate measures as specified by the applicable provisions of the Occupational Safety and Health Act, 1970, PL 91-596 (84 Stat 1590). The Contractor’s employees shall not place equipment in traffic lanes or other locations in such a manner as to create safety hazards.
a. The Contractor shall protect the safety and health of employees and of members of the public and minimize dangers from all hazards of life and property and shall comply with all Health, Safety, and Fire Protection regulations and requirements (including reporting requirements) of the Army and Safety and Health regulations issued by the Secretary of Labor in 26 CFR (1910) and any subsequent amendments. The Contractor shall permit safety inspections of all work being performed under this contract.
b. The information shall be recorded with the COR and KO within 24 hours of time of notification of occurrence to the contractor by the employee.
7. ADMINISTRATIVE REQUIREMENTS
A. DEFINITIONS: As used throughout this contract, the following terms shall have the meaning set forth below.
a. Contracting officer. The KO is a person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the KO acting within the limits of their authority as delegated by the contracting officer.
b. Contractor. The term contractor as used herein refers to both the prime contractor and any subcontractors. The prime contractor shall ensure that his/her subcontractors comply with the provisions of the contract.
c. Regional facilities operational specialist (RFOS). A designated individual who shall have the primary responsibility for assuring that all supplies, service or workmanship presented to or performed for the government meet all conditions of the contract when contractor employee is away from Government work site.
d. Contracting Officer Representative (COR). The government employee designated by the KO to be responsible for monitoring of contractor performance.
e. Performance requirements summary (PRS). Identifies the key performance indicators of the contract that will be evaluated by the government to assure contract performance the contractor meets standards.
f. Quality assurance surveillance plan (QASP). An organized written document used for quality assurance surveillance. The document contains specific methods to perform surveillance of the contractor for each item of the performance requirements summary.
g. Quality assurance (QA). A method used by the government to provide some measure of control over the quality of purchased goods and services received.
h. Quality control (QC). A method used by the contractor to control the quality of goods and services received.
i. Identification of Contractor Employees. All contract personnel attending meetings, answering Government telephones are required to identify themselves as a contractor to avoid creating an impression that they are Government officials. All documents and reports produced must be marked as contractor products to ensure that contractor participation is appropriately disclosed. The contractor employee is required to obtain a Government issued identification badge (DD Form 1466) and DoD Identification Card (Common Access Card; CAC) for the performance of assigned duties.
j. Hours of operation. The contractor is responsible for conducting business between the hours of 7:30 AM to 4:00 PM, Monday through Friday except Federal Holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar directed facility closings. No work shall be performed during non-duty hours, weekends or when the Government has no workforce on duty available for inspection of the Contractor’s work unless prior approval has been obtained.
