About this file
This document is a Request for One Time Exemption from Competition submitted by the Idaho Office of Information Technology Services (ITS) to the State of Idaho Division of Purchasing (DOP) for the direct procurement of IRON (Idaho Regional Optical Network) network services. The exemption request seeks to bypass competitive bidding procedures for internet and network access services at multiple state agency sites, with initial focus on two Idaho Transportation Department (ITD) DMV locations in Emmett and Grangeville. ITS completed a proof-of-concept demonstration at these sites that documented significant improvements in performance, reliability, and service restoration compared to legacy service providers. The agency intends to expand IRON services to additional ITS-supported sites where similar service gaps exist, with implementation proceeding as sites are identified and prioritized based on business requirements.
The exemption justification centers on the impracticality of competitive procurement under current market conditions. ITS asserts that existing contracted service providers either cannot provision services to specific locations, cannot deliver adequate bandwidth to meet business requirements, or cannot provide services within reasonable installation intervals and costs. The agency indicates that no State or NASPO contract vehicle currently exists for these services, and that the proof-of-concept results at the DMV locations demonstrate IRON's capability to meet critical performance and bandwidth requirements. Costs vary by site and were not specified in the request. The exemption would authorize direct procurement where no contracted provider is available, where incumbent carriers cannot meet bandwidth needs, or where incumbent carrier costs are deemed exorbitant. The request was submitted on July 1, 2016, with DOP Administrator approval noted as of November 26, 2024, and DOP has invited suppliers to submit information supporting or contradicting the exemption claim prior to the Administrator's final decision.

Request for One Time Exemption from Competition from

Request for the Purchase of: IRON (Idaho Regional Optical Network) network services
Cost (attach quote): Costs will vary by site
IDAPA 38.05.01.042.10 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to: special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.
Background and Justification (attach additional sheets as needed):
ITS has completed a proof-of-concept (POC) for IRON as an alternative service provider for internet/network access for several specific sites (304 E MAIN ST Emmett ID and 320 W Main St Grangeville) where the legacy service provider has had chronic service interruptions, could not provide requested higher bandwidth and/or could not provide higher requested bandwidth at a reasonable recurring cost. The POC sites are ITD DMV locations where major service impacts occurred and effectively made DMV services unavailable to the public for extended periods of time. The IRON POC locations significantly boosted performance and reliability and brought the DMV’s back online when the existing service provided failed to restore services within a reasonable timeframe.
ITS is seeking an exemption from a competitive procurement to order and install IRON internet/network services where there is no other practical option available. Currently there is no State or NASPO contract vehicle available to procure these services and the current contracted service providers are either unable to provision services to a site or cannot provision the services within a reasonable installation interval with a reasonable recurring and non-recurring cost.
The proof-of-concept sites have proven that IRON can provide adequate bandwidth and meet critical performance requirements to meet business needs. We would like to move forward with adding IRON service to more of the ITS supported agency sites where there is no other option or to ease the burden of slow connectivity and exorbitant costs where costly and/or inadequate data connections are the only other available option from the current contract service providers.
Maintaining services at the POC sites and any additional sites would be provisioned with IRON internet/network services when there is either:
• no current contracted service provider available for the site
• contracted or incumbent local carriers cannot provide the service or cannot provide adequate bandwidth to meet the sites’ business requirements mailto:purchasing@adm.idaho.gov mailto:Kevin.heesch@its.idaho.gov/(208 https://adminrules.idaho.gov/rules/current/38/380501.pdf

• contracted or incumbent local carrier could provide bandwidth to meet the locations’ business requirements but, the onetime and/or ongoing proposed costs from contracted service providers are exorbitant
