About this file

This document is a Request for One Time Exemption from Competition submitted by the Idaho Department of Juvenile Corrections (IDJC) to the Idaho Division of Purchasing (DOP). IDJC is requesting an exemption to allow the agency to directly procure fire prevention and detection services for their Saint Anthony facility, valued at $11,700. The request is due to the ongoing construction and integration of the fire systems across IDJC's 15 connected facilities, and the need to maintain continuity of services with the current vendors to ensure proper troubleshooting and collaboration during the transition.

The agency cites concerns about potential issues and blame shifting if a new vendor is brought in before the overall fire system is fully operational and integrated. IDJC is seeking the exemption to be valid through June 2026 to provide time for the construction project to be completed and to evaluate long-term service needs. The DOP Administrator has the discretion to approve or reject the requested exemption, and suppliers are invited to provide information that may support or contradict the agency's claim that competition would be impractical, unreasonable, or disadvantageous under the circumstances.

IDAPA 38.05.01.042.10 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to: special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.

Background and Justification (attach additional sheets as needed):

Agency Certification: The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State:

EMAIL FROM BUSINESS OPERATIONS SPECIALIST:

I really worry about the current construction status of our facility and getting all of our fire services under contract. The facility has 15 buildings that are all connected to a central alarm and emergency system.

We have found, especially after the lighting strike how problems in buildings effect its operation.

My worry is that until we get the entire system up and running there will be no collaboration to fix the bugs and issues I am sure will come up.

So a problem on Owyhee would be blamed on the new Bitterroot installation. Problem on new installation blamed on a repair in administration and so on.

I think this could jeopardize integrity, safety, and service of the systems.

The companies that currently inspect and repair our equipment are the same contractors working on the new buildings.

I think it would be a huge advantage to finish the installations, trouble shooting, and getting the system 100% operational before we risk another contractor getting into the mix with different methodologies, systems and teams of technicians.

Request for the Purchase of: Fire prevention and detection services
Cost attach quote: $11,700.00
Background and Justification attach additional sheets as needed: We have a RFQ 430 out right now for our Nampa and Lewiston facilities (two out of three facilities), but our Saint Anthony facility finds that it has a need to continue services with its current vendors for continuity and safety reasons. Text from an email from the Saint Anthony Business Operations Specialist is on the next page, which I think justifies this request. A cost breakdown is attached as well. We are making this request for exemption to be through June, 2026, to provide time after construction at the facility is complete (12/25 is the projected date for that) to determine what our needs are and possibly issue a solicitation for Saint Anthony. I say possibly, because RFQ 430 allows the addition of facilities.
