About this file

This document provides justification for a sole source award of Court Security Officer contracts for the 1st, 5th, and 8th Federal Judicial Circuits. The United States Marshals Service requires Court Security Officer services through new contracts for a six-month period to ensure continuity of security for the judiciary and judicial facilities. The agency intends to competitively solicit offers by August 2021 for a new period of performance beginning October 2021. Due to changes in scope from COVID-19, the Marshals Service canceled a prior competitive solicitation and will award sole source contracts to Walden Security through inclusion of an option to extend services, to prevent a lapse while new requirements are solicited.

JSD solicited circuits 1, 5, 8 on April 15, 2020 under 15M20020RA32CSO20 with the intention to make awards by no later than July 2020, for period of performance to begin October 2020.

ue to the COVID-19 and growing concern with in-person training, the program office substantive changes in requirement for CSO Phase II training in the contracts .

This training is currently provided by Government instructors at Government facilities. Execution of CSO Phase II training is a significant impact to scope, this training requires delivery from expert instructors, requires on site x-ray equipment, and is one week in duration. The contracting office finds that it would be impractical to return to the solicitation requirement as issued in April 2020 and make contract awards for a base year plus four option year periods because that requirement is not inclusive of contractor provided Phase II training. These changes in scope precipitates a need to cancel the current solicitation and provide more robust requirements during the next round of solicitations for the CSO contracts.

The contracting officer has exhausted all other options to extend services. In consultation with the USMS Office of Procurement and DOJ Justice Management Division (JMD), USMS JSD canceled the competitive solicitation and will issue a sole source contracts to Walden Security for a six month period of performance. JSD intends to competitively solicit and issue the competitive solicitation's contract awards by no later than August 2021 for period of performance to begin on 10/1/2021. The other than full and open competition contract award supported by this Justification and Approval will ensure there is no lapse in current services while the new requirements are solicited. Should award delays occur on the competitive solicitation such as a Government Accountability Office (GAO) protest, the contracting office has provided for additional continuity of CSO services in Circuits 1, 5, and 8 in the contract awards supported by this Justification and Approval through inclusion of FAR 52.217-8 Option to Extend Services.
