About this file
This is a Department of the Air Force Justification for Other Than Full and Open Competition (J&A) document for a sole-source award.
The 772 Enterprise Sourcing Squadron, under the Air Force Materiel Command (AFMC), seeks to award a contract on a sole-source basis to Getty Images (US), Inc. (CAGE: 79US7; UEI: KG5PWYBKVCA5) for a Premium Access subscription providing royalty-free photographic and video images to support the Department of the Air Force Library Program. The requirement supports the DoD Morale, Welfare, and Recreation Libraries' mission of providing resources to military personnel at contingency operations, remote sites, and military installations, as well as marketing materials for 80 locations with up to 250 downloads per month. The contract consists of a 12-month base period (30 September 2026 – 29 September 2027) and two optional 12-month extension periods, with an estimated total value for base plus options redacted in the document. The statutory authority for sole-source procurement is 10 U.S.C. 3204(a)(1) under the Simplified Acquisition Procedures (41 U.S.C. 1901). Market research and a Sources Sought Notice (FA8052260721, issued 21 July 2026 with responses due 3 August 2026) identified Getty Images as the only source capable of providing the required Premium Access subscription with exclusive photographic and video content, customized usage rights, and integrated cloud storage accessible across all DAF libraries and marketing locations. Two vendors responded to the Sources Sought, with only Getty Images meeting the government's minimum requirements. The J&A notes that Getty Images' Premium Access subscription is available exclusively through direct partnership and is not available through third-party distributors or alternative stock photography platforms. The document commits to conducting market research prior to each subsequent acquisition to determine whether additional authorized sources or licensing changes have occurred.

Department of the Air Force: Justification for Other Than Full and Open Competition
7. Shall be able to store in the cloud all downloaded images from Getty with access from all DAF Libraries and Marketing locations.
Two (2) vendors expressed interest and submitted responses:
GETTY IMAGES (US), INC. provided a capability statement that was determined acceptable by the requirement owner. Getty Images confirmed that its Premium Access subscription includes selections of royalty-free content exclusive to Getty Images. Getty Images further stated that while its content may be distributed through third parties for applications specifically tailored to users of those platforms, the Premium Access subscription with customized usage rights, download volumes, and pricing required by the Air Force is available only through direct partnership with Getty Images.
VII. Determination of Fair and Reasonable Cost (RFO 6.104-1 (a)(7)):
The Contracting Officer is responsible for evaluating, determining, and documenting the anticipated contract cost/price is fair and reasonable in accordance with RFO Subpart 15.4, Contract Pricing.
VIII. Any Other Facts Supporting the Justification (RFO 6.104-1 (a)(9)):
Due to the absences of alternative sources that can provide the required licensed content, there are no duplicated costs associated with a follow-on acquisition; however, the Government would be harmed by the loss of continuous access to the unique digital resources and exclusive analytical content.
IX. Actions to Overcome Barriers to Competition (RFO 6.104-1 (a)(11 ):
Prior to each subsequent acquisition, the Government will continue to conduct market research to verify whether additional authorized sources, distributors, or changes to Getty Images' licensing and distribution rights have occurred. If GETTY IMAGES (US), INC. authorizes additional distributors or licensing partners in the future, the Government will reevaluate its acquisition strategy to determine whether competition is feasible.
