SOLE or LIMITED SOURCES JUSTIFICATION Determination Memorandum for Acquisitions Over $3,500 but not Exceeding the SAT
All solicitations and orders shall be competed unless a justification to limit competition using an exception in FAR Part 8, 13, or 16, as applicable to the acquisition, is approved by the Contracting Officer. Naval Special Warfare Command (NSWC) has requirements across the claimancy for contracted services to support various Government-owned vehicles, equipment and watercraft. Requirements include repair, maintenance, upgrade, and/or operation of Civil Engineering Support Equipment (CESE), Material Handling Equipment (MHE), Surface Support Craft (SSC) and Ground Support Equipment (GSE).
FAR 13.106-1(b)(1)(i), only one source can logically perform services in the time frame required. Contract H92240-19-D-0034 was awarded to Orion Solutions, LLC of Jacksonville, Florida as a result of solicitation H92240-19-R-0011, which was set-aside and competed among small businesses under NAICS 811111. Multiple orders were issued against resulting indefinite-delivery, indefinite quantity type contract for services.
Order H9224020F0360 was issued on 22 June 2020 and tasking under this order is complete in January 2021 In September the undersigned contracting officer was notified by the contractor of a calculation error in excel pricing sheet for the order resulting in a shortfall on the awarded order of $55,517.28. Excel calculation error was confirmed by the contracting officer.
Increase in order value of $55,517.28 is a result of an administrative error. In order to correct this error, the order value and additional funding is required. Due to the low dollar value, it is not in the Government's best interest to re-compete the requirements. The calculation error is associated with two labor categories awarded to support a Dam Neck, VA for a total of 1,312 hours. The Government does not anticipate industry would be interested in competing for these two requirements given the short period of performance and the low number of hours required. The overall ceiling of basic contract H92240-19-D-0034 will need to be increased by $50,565.69 in order to accommodate the increase in funding under the order. Future requirements will be competed against the MSOF multiple award contract.
Notification of this action will be posted in accordance with acquisition regulation requiremens.
None, future actions to be competed against MSOF multiple award contract.
