Memo To File

U.S. General Services Administration

GSA Region 2

PBS Leasing Division

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

May 22, 2020

Agency Name:

Project Number: 9NY2863

Lease Location:

Unevaluated Lease Option: Five (5) Years

Lease Summary:

The General Services Administration currently leases thirty (30) structured self-parked parking spaces for at under parking lease license agreement number GS-02P- LNY00632, which commenced on September 4, 2019 and expires December 31, 2020. PBS Region 2 is requesting approval to add and simultaneously exercise an unevaluated lease option for a five (5) year term for thirty (30) self-parked parking spaces at an anticipated cost of per space per month, for thirty (30) spaces per month and for thirty (30) spaces per annum. The total contract value for five (5) years is commencing on January 1, 2021 and expiring on December 31, 2026 with the incumbent Lessor without full and open competition for continued occupancy at the existing leased location.

It is paramount to detail mission to have ready access to self-parked vehicles.

The offices and related space are currently housed at .

The garage located at is within the delineated area and two (2) blocks from and will provide with thirty (30) self-parked garage spaces for five

(5) years, which are required to perform their law enforcement mission.

The current location at is located in a five hundred (500) year floodplain zone.

Since GSA R2 already has a lease at and a four (4) Step Flood Mitigation was completed and on file, according to GSA’s NEPA & Sustainability Program Manager all that is required is a Critical Action Determination letter form signed by the Agency.

There is no immediate federal vacant space available to accommodate this requirement.

The Delineated Area is two (2) blocks from as follows: north to Beaver Street/Wall Street; south to South Street/Broad Street; east to Wall Street/South Street; and west to Broad Street.

It is in the best interest of the Government to house parking a garage located at since the garage is located two (2) blocks from offices at New York, NY and also offers the ability to self-park thirty (30) vehicles and a five (5) year lease license option can be secured. New York City garages normally only offer valet parking, month to month leases, or one (1) year lease terms.

GSA’s market research for garage rates in New York City’s Financial District showed rental rates for monthly parking ranging from per month per parking space for valet parking spaces with a market average of per space per month based on GSA R2 market research performed for garages with the delineated area.

The total estimated contract value of this unevaluated lease option action is estimated to be:

The projected unevaluated lease option rate is per space per month, which is twenty-four percent below the GSA market research average of per parking space per month;

is self-parked vs. valet parked; and is a five (5) year lease term.

GSA placed an advertisement conforming to 570.402-5 on the Federal Business Opportunities Website (https://beta.sam.gov/) on April 10, 2020 indicating its intent to exercise an unevaluated lease option with the incumbent landlord with Other Than Full Competition. GSA received no responses to its advertisement.

On February 28, 2021, the GSA R2’s independent market research identified five (5) potentially acceptable locations (four (4) plus the incumbent) that might meet the agency’s needs within the delineated area, however these locations do not offer long lease terms or the option to self-park.
