About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for a lease renewal for the Social Security Administration. The General Services Administration (GSA) seeks to renew the lease for 23,061 ABOA/26,175 rentable square feet of office space located at 3875 Faber Street in North Charleston, South Carolina, under lease number GS-04-LSC60047. The five-year renewal will run from August 12, 2024, through August 11, 2029, with a three-year firm term ending on August 11, 2027, and includes termination rights beginning August 12, 2027.
The estimated rental rate is $36.02 per rentable square foot ($28.50 shell rate and $7.51 operating costs), resulting in an annual rent of $942,798.73 and a total contract value of $4,713,993.65. The justification for sole-source procurement is based on the cost-prohibitive nature of relocation, the need to maintain operational continuity for the Social Security Administration's office, and market research confirming the rental rate is within the local market range. The incumbent lessor expressed written interest, and no other federal space is available in the specified location.

Justification for Other Than Full and Open Competition, Renewal Option
U.S. General Services Administration
Public Buildings Service
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
PROJECT NUMBER: 1SC2095
Agency Name: Social Security Administration
1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.
The General Services Administration currently leases 23,061 ABOA/ 26,175 rentable square feet (RSF) of office space at 3875 Faber Street in North Charleston, South Carolina, under lease number GS-04P- LSC60047 for the Social Security Administration. The current lease expired on August 11, 2024. The lease has been in holdover. Approval is requested to negotiate a five-year, three-year firm term renewal option with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The renewal term will be August 12, 2024, through August 11, 2029. The firm term will end on August 11, 2027. The Government will have termination rights beginning on August 12, 2027, upon sixty
(60) days written notice. The procedures for pursuing a renewal option are detailed in GSAM Subpart 570.401.
2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
(INCLUDING ESTIMATED VALUE)..
This requirement is for 23,061 ABOA/ 26,175 RSF of space for a five-year renewal with three years firm term. The Social Security Administration needs additional time to evaluate its space requirements as they anticipate a significant reduction for this servicing area.
The five-year renewal will begin upon lease expiration on August 12, 2024, and continue through August
11, 2029. The three-year firm term will expire on August 11, 2027. The estimated rental rate for the renewal option is $36.02/RSF (Shell: $28.50/RSF & Operating Costs: $7.51/RSF) with an annual rent of
$942,798.73 and total contract value is $4,713,993.65. The delineated area is North Charleston: North
Interstate 526; South: Riverland Drive to For Johnson Road; East: Interstate 526 to 17 East and 703; and
West: Interstate 526 to 17 west and 700. There is no vacant Federal space available.
3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.
41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.401. In accordance with GSAR 570.401, use of the sole source authority is appropriate where the Government determines that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.
4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR
NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.
It is in the best interest of the Government to remain at the current location. Award to other than the current Lessor would require relocation of the entire requirement and would cause the Social Security
8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
The current lease has been in a holdover status since August 12, 2024. The Lessor has continued to comply with the Government lease. Relocating the lease would be cost-prohibitive and disruptive to the public as this office must remain operational. If this agency were to relocate there would not be significant time and proper planning to allow for the rescheduling of hearings.
9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUISITION.
Incumbent Lessor located at 3875 Faber Place in North Charleston, South Carolina, expressed a written expression of interest in the acquisition
10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME
ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.
There are no systemic barriers to competition. If the agency has a continuing need for space upon lease expiration, the General Services Administration will follow all authorities, regulations and policies applicable to lease acquisition. Should there be remaining useful life in the Government’s tenant improvements, the Government will consider the cost of moving from the existing location, and the cost to build out new space when deciding whether to undergo a competitive action.
Additionally, objective scrutiny will be given to the customer agency’s mission and security requirements (if applicable) to eliminate unnecessary agency space requirements that may be deemed unduly restrictive.
11. CONTRACTING OFFICER CERTIFICATION.
By signature on this Justification for Other than Full and Open Competition, the Lease Contracting Officer certifies that the award of a succeeding lease of 26,175 RSF is in the Government’s best interest and that this Justification is accurate and complete to the best of the GSA Lease Contracting Officer’s knowledge and belief.
