Defense Logistics Agency Energy
About this file
This is a Justification for Other Than Full and Open Competition (J&A) for a contract modification with the Defense Logistics Agency (DLA) Energy.
DLA Energy seeks to extend contractor-owned, contractor-operated (COCO) fuel storage and management services at Fort Campbell, Kentucky through a six-month option period modification to contract SP0600-05-C-5516. The incumbent contractor, TRC Government Services, LLC (TRC), will continue providing management, operation, maintenance, product quality surveillance, inventory control, accounting, security, safety, and environmental protection for retail and bulk fuel services. The current monthly usage charge is $22,606.36, with a total cost for the six-month option period of $135,638.16. The modification will increase the contract's total value from its current amount. The original contract was competitively awarded to Willbros Operating Services, Inc. on July 20, 2005, with a five-year base period (February 1, 2006 – January 31, 2011) and three five-year option periods. The contractor changed to TRC Government Services, LLC via modification P00035 on January 5, 2017. The third five-year option period was exercised via modification P00040 on September 21, 2020, expiring January 31, 2026. The anticipated award date is on or before January 29, 2026, with performance beginning February 1, 2026.
The J&A justifies sole-source procurement under Federal Acquisition Regulation (FAR) 6.302-1 (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements), citing that TRC possesses unique qualifications for COCO fuel facility storage and maintenance services, and that awarding to a new source would result in substantial cost duplication and unacceptable delays. The pricing of $22,606.36 monthly was established in modification P00055 on January 23, 2025, and represents current market labor rates adjusted annually in accordance with Secretary of Labor wage determinations (Wage Determination 2015-4675, Revision 24). No market research was conducted for this J&A, as market research was performed during the pre-award process for the original contract SP0600-05-C-5516.
