DEFENSE LOGISTICS AGENCY (DLA)

DLA CONTRACTING SERVICES OFFICE-PHILADELPHIA

700 ROBBINS AVENUE

PHILADELPHIA, PA 19111-5092

JUSTIFICATION FOR OTHER THAN FULL AND FOR OTHER THAN FULL AND

OPEN COMPETITION (OTFAOC)

1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY.

Requiring Activity:

Defense Logistics Agency (DLA) Operations Research and Resource Analysis (DORRA) 8000 Jefferson Davies Highway Richmond, VA 23297-5002

Contracting Activity:

DLA Contracting Services Office Philadelphia Site 700 Robbins Ave Philadelphia, PA 19111

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

This justification authorizes the use of other than full and open competition for the procurement of brand name specific Arena Software. The solicitation will be issued via Open Market procedures as a Combined Synopsis/Solicitation-Request for Proposal (RFP) posted to the Federal Business Opportunities system. The award of a firm-fixed price contract is contemplated. Request purchase of Arena software maintenance for the period of one year (04/01/23 – 03/31/2024) plus two option years. The proposed vendor: Rockwell Automation, 2100 Corporate Drive, Suite 550, Wexford, PA 15090. Rockwell is the sole distributor of Arena.

3. DESCRIPTION OF SUPPLIES/ SERVICES

Arena software maintenance to include 5 concurrent users licenses) and product assurance support for (i) telephone, fax and e-mail support, and (ii)functional and performance enhancements to Arena that Rockwell Software may release from time to time. The current Rockwell Arena solution requires a sole source acquisition to Rockwell because they are the Original Equipment Manufacturer (OEM), and as the OEM only Rockwell can provide maintenance support for the perpetual licenses. To move away from a Rockwell solution would require purchasing of another OEM to replace all Arena software licenses and restructure the current architecture. DLA estimates that it is a better value to purchase an estimated $20,000.00 to procure the maintenance than spend an estimated $100,000.00 to procure a new product and then incur significant internal costs due to implementation, testing and training.

The amount for the maintenance for Arena licenses from April 1, 2023 – March 31, 2024 is $ The overall estimated value for this requirement is $ including two options.

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION:

The subject procurement is being made in accordance with the provisions of Federal Acquisition Regulation (FAR) 6.302-1 (c).

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF CITED

AUTHORITY:

Numerous DLA Operations Research and Resources Analysis projects rely on the use of simulation models developed in Arena. These models required years to develop. Therefore, we must purchase yearly software maintenance in order to continue using the models.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:

Research for other vendors and/or service partners was conducted. There are no other know sources of Arena software other than Rockwell Automation. Use of any other vendor will not allow the use of the current simulation models.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR l 5.404- l(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS:

No other sources have demonstrated the capability necessary to provide the maintenance support at this time.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

10. LISTING OF INTERESTED SOURCES

OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT
