III. Description of supplies/services required to meet agency needs.
The request Bobcat repair services. The contractor shall perform 1000 hr service, engine fuel injection repair, and engine fuel injection pump repair on Bobcat model 753, X00469. The work shall be performed at the vendors location within 30 days of vehicle tow to the vendor's location.
IV. Statutory authority permitting other than full and open competition.
FAR Subpart 6.302-1(a)(2), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
Vendors who wish to repair Bobcat vehicles/equipment must be licensed as an authorized service dealer by the parent company, Bobcat Company. This license provides the vendor the possession of proprietary diagnostic software and machine programing. These proprietary items allow for vendors to properly troubleshoot, diagnose and properly repair problems in their vehicles. As confirmed by the contractor and Bobcat Company, the only company within the state of Arizona that is an authorized dealer and has access to the proprietary software and programming is Bingham Equipment Company.
Several contractors were contacted to determine their capability in meeting all elements of the Performance Work Statement (PWS), however they all stated that they do not perform Bobcat repairs. The proprietary software and programming has discouraged vendors from performing Bobcat maintenance; vendors who wish to perform maintenance without the software and programming would have to coordinate with the authorized dealer for it's usage. This would be expensive and cumbersome for secondary vendors, and is likely the reason Market Research revealed only one capable vendor. Therefore, it was determined that with consideration of the market forces creating a lack of available vendors, there is a reasonable basis to conclude that the unique services available from a limited number of suppliers with unique capabilities is applicable under FAR 6.302-1.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Market research efforts were utilized to identify as many potential sources as practicable capable of meeting the requirement.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
