About this file
This document is a Simplified Acquisition Procedures (SAP) form for a sole-source procurement by the U.S. Coast Guard (USCG). The procurement is for repairing one Electronic Control Unit (ECU) Box, Part Number 258600-102, for C27J aircraft parts, to be placed in ALC Ready-For-Issue Inventory. The sole source is MOOG INC, AIRCRAFT GROUP (CAGE code 0ZWK8), which owns all technical rights to the item and is the original equipment manufacturer (OEM).
The justification for sole-source procurement stems from the unique characteristics of the part, which are specific to the aircraft and require compliance with OEM requirements and USCG engineering authority. The government does not own the technical data rights and has determined it is uneconomical to purchase them. USCG has conducted market research using procurement history and aviation inventory services to verify no alternative sources exist. The procurement is constrained by operational safety and flight-critical requirements that prevent competition, with USCG continuing to explore potential future procurement alternatives through industry channels and trade shows.

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER.
WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE
SOURCE PURCHASE.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.
Initial procurement to repair 1 EA BOX, ECU P/N 258600-102 NSN 1680-01-551-9704 for C27J aircraft parts. Item(s) will be placed in
ALC Ready-For-Issue Inventory for future issue and installation on a USCG Aircraft.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE
USED. These items (to include its Form, Fit, and Function) are unique to a specific aircraft, and any installation, operation, or servicing must comply with the Aircraft OEM requirements and/or the U. S. Coast Guard’s authorized engineering authority for this particular airframe. As the original Equipment Manufacturer (OEM) of this item, MOOG INC, AIRCRAFT GROUP (CAGE code 0ZWK8) owns all rights to the technical data, specifications, and drawings required to manufacture these items. The rights to the technical data necessary in order to purchase these items from other than the OEM or an OEM approved source are not owned by the Government, and it has been determined that it is uneconomical to purchase these rights.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS
PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). USCG uses past procurement history and the international aviation subscription service (Inventory Locator Service or ILS®), to seek available sources of supply. All potential sources must provide (1) traceability to the OEM for each part identified in this procurement, (2) documentation to support material condition as NEW, and (3) can meet the required Delivery Date.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES. This service is procurable from the OEM, MOOG INC, AIRCRAFT GROUP (CAGE Code 0ZWK8). Procedures and data are protected under the proprietary rights of the OEM (Proprietary Claim Certificate File). The OEM owns the rights to the technical data, specifications and drawings required to manufacture the parts. These parts are procurable only from the OEM or any distributor approved by the OEM.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION
HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. Due to Operational Safety and/or flight critical requirements, the USCG cannot legally change the service requirement for this item as it is directed by the OEM and/or the OEM’s manager of such data. Therefore, procurement processes are dictated by the OEM or an approved source of the OEM. The government does not own or possess any rights to the technical data, specifications, and drawings required to manufacture these parts. In addition, the government has not developed the technical data required to manufacture these parts and has no plans to do so.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION
BEFORE FUTURE ACQUISITIONS ARE REQUIRED. Although the government has not been willing to bear the cost of procurement of the necessary OEM data for this service, USCG ALC MRS still continues to check procurement-based subscription services, alternate approved systems, and industry periodicals, and also sends representatives to various aviation trade shows and conferences to seek out all possible legally achieved procurement options and sources.
