I. Contracting Activity.

II. Nature and/or description of the action being processed.

This acquisition will be for a one-time purchase for a ten (10) diesel-electric air conditioners and heating units for the 76th Aircraft Maintenance Group (AMXG). This has an estimated value of and an estimated award date of 15 April 2022. This effort will be solicited as a one-time, Firm-Fixed Price (FFP) type contract utilizing Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, and Part 13, Simplified Acquisition Procedures.

This is an individual Brand Name Justification covering this particular contract and is not a bridge action.

Currently, 76th AMXG utilizes ten (10) TDL America diesel-electric air conditioner and heating units (part number ACU-302) for multiple aircrafts maintained at Oklahoma City Air Logistics Center (OC-ALC) facilities and ramps.

III. Description of supplies/services required to meet agency needs.

Ten (10) each TDL America diesel-electric Air Conditioner and Heating Units Part number ACU-302

• Shall be able to be powered by both diesel and electric.

• Shall not require Diesel Exhaust Fluid (DEF) and must be Jet A fuel compatible (Tier 3)

• Shall be trailer mounted with tow bar actuated brakes, 4 tires, and pintle hook compatible tongue

• Air Conditioner specs:

- 24 nominal tons

- Air Flow of 190 lbs/min

- Supplied Air Temp (@100°F) 35-50°F using R134a refrigerant

• Heater specs

- Capacity 234,000 btu/hr

- Heating Air Temperature 100-110°F

• Automatic compressor capacity control

• Copper tube condenser and evaporator coils with frost resistant evaporator

• Low coolant shutdown

• Over a 75 gallon fuel tank

• Fuel filter with water separator

• Filter for Jet A fuel operation

• Generator for electric operation 60 kw or greater

• Engine block heater

• 30 ft. Hose with coupler

• Operating instructions

IV. Statutory authority permitting other than full and open competition.

AFFARS 5313.501 - 10 U.S.C. 2302b, implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

This requirement is for the purchase of ten (10) TLD America air conditioner and heating units, part number ACU-302.

Currently, the 76th AMXG utilizes ten (10) units of this specific brand of air conditioner and heating units on aircraft that is maintained within the OC-ALC facilities and ramps. By purchasing this specific type of air conditioning unit, it will minimize operator training time, costs, and procedure changes that would have to occur if a different unit was procured.

Furthermore, 76th AMXG has available on-hand interchangeable parts for ACU-302 and those parts cannot be used on other air conditioner and heating units.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Initial market research was performed reviewing Dynamic Small Business Search and System of Award Management databases using North American Classification System (NAICS) code 333415 looking of companies that could provide the item(s) listed above. A review of small businesses, to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted. The following vendors were discovered:

• TLD America, CAGE Code: 6L481 (Large Business)

• Aero Specialties, CAGE Code: 0T652 (Large Business)

• Western Industries Corp, CAGE Code: 0JVP4 (Small Business)

• Remington Express Enterprises, Inc., Cage Code: 06HN8 (Small Business)

This cannot be set aside for a small business because the Non-Manufacture Rule (NMR) applies and NAICS 333415 is not listed on the waiver list for air conditioner and heating units.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will utilize price competition in accordance with (IAW) FAR 13.106-3(a)(1), to ensure the price is fair and reasonable. Specifically, the Contracting Officer will compare the quotes received to one another for price competition. If only one quotation is received, then the Contracting Officer will compare the proposed price by using multiple pricing methods listed in FAR 13.106-3(a)(2). The Contracting Officer will ensure that the deliverable described herein are priced at a fair and reasonable rate to the Government and the contractor. Based on the forgoing, the Contracting Officer hereby determines the anticipated price will be fair and reasonable.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market Research was conducted on 22 January 2022 with a review of Small Business RSS Feed to locate potential businesses through NAICS 333415 and/or keyword searches (air conditioner, heating units, ACU-302) and a search of

Additional methods used to arrive at market research: internet searches of the specific units and TLD authorized vendor searches, telephone calls to vendors, information from Subject Matter Experts (SME's) and previous awarded contracts for air conditioner and heating units.

IX. Any other facts supporting the use of Other Than Full and Open Competition.
