Justification and Approval (J&A) for Other Than Full and Open Competition

CONTROLLED UNCLASSIFIED INFORMATION

13 May 2022 CONTROLLED UNCLASSIFIED INFORMATION Page 3 of 4

This procurement for Genesys PureConnect license maintenance and support is necessary in order to maintain the system software. The purchase of Genesys PureConnect maintenance must be performed through the use of a Genesys PureConnect provider and/or authorized Genesys PureConnect resellers. The use of “or equal” would not satisfy the agency needs due to compatibility issues with the current Genesys PureConnect license system. Field Assistance Service (FAS) Program Management Office has developed customized software used in the Help Desk Telephone System that is specific to Genesys PureConnect.

Maintenance for Genesys PureConnect licenses is necessary in order to maintain the system and support/ update software. The Field Assistance Service has invested years and program dollars into customizing and migrating the system. A change to a new OEM would not only cause a potential degradation in service provided and require close to $1M in additional funding, but would also require additional training for all the analysts and most likely several years' worth of customization to make it functional.

V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under FAR 5.202 applies.

This requirement will be solicited to the open market via Beta Sam. In accordance with FAR 5.2 this requirement will be publicized.

VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

FAR 16.505(b)(3) states if the contract did not establish the price for the supply or service, the contracting officer must establish prices for each order using the policies and methods in subpart 15.4. The Contracting Officer anticipates determining price reasonableness based on competitive quotations IAW FAR 15.404-1(b)(2)(i). The evaluation of this effort will be conducted using experienced technical representative and contracting personnel. The Contracting Officer has determined the anticipated cost to the Government of the item being procured will be fair and reasonable.

VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Various techniques were used to conduct market research to include: use of historical data/existing contract information and web searches. As these licenses are produced exclusively by Genesys and are the only authorized software for use by the FAS, a brand name justification has been created. Market research indicated there exist four authorized resellers in North America capable of providing PureConnect licenses:

Avtex, Cognizant, ConvergeOne, and IBM, none of which are small businesses under any NAICS code.

While IBM offers PureConnect licenses, it does not include any support services, so could not meet that portion of the requirement and must be excluded. GSA's 2GIT blanket purchase agreement is BES's mandatory contract vehicle for network infrastructure. Neither are there agreements for this software on DoD ESI or NASA SEWP. As none of the three capable authorized resellers have 2GIT agreements nor any other agreements on DoD ESI or NASA SEWP, open market quotes are required.
