About this file

This Limited-Sources Justification document details a firm-fixed price procurement by the Department of Veterans Affairs (VA) for Statistical Analytical System (SAS) Cost and Profitability Management (CPM) software licenses, maintenance, and technical support. The VA Financial Services Center currently uses two perpetual and 15 term SAS CPM licenses in cloud environments and requires additional licenses. Executive Information Systems, LLC (EIS) is the sole authorized reseller, and the contract will be awarded through the GSA Federal Supply Schedule for a 12-month base period with one 12-month option period.

The justification emphasizes that only SAS or its resellers can provide the required software due to proprietary source code, and extensive market research confirmed EIS as the exclusive government-authorized reseller. The total estimated contract value is redacted, and the procurement cannot be set aside for service-disabled veteran-owned or veteran-owned small businesses. The VA determined that losing SAS CPM capabilities would significantly impact its ability to track budgets, facilitate vendor and veteran payments, and generate financial reports, making this a critical acquisition for VA operations.

Statistical Analytical System (SAS) Cost and Profitability Management (CPM) Software Licenses, Maintenance and Support Control Number VA-25-00077146

LIMITED-SOURCES JUSTIFICATION

1. Contracting Activity: Department of Veterans Affairs (VA)

Office of Procurement, Acquisition, and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724

2. Description of Action: The proposed action is for a firm-fixed price (FFP), brand name Statistical Analytical Services (SAS) Cost and Profitability Management (CPM) software licenses, maintenance and technical support currently provided through Executive Information Systems, LLC. (EIS).

3. Description of the Supplies or Services: VA Financial Services Center (FSC) currently has two (2) perpetual SAS licenses and 15 term SAS CPM licenses installed in cloud production and development environments and requires additional SAS licenses and maintenance support. FSC currently utilizes the SAS application as an integral part of the FSC’s cost accounting business operations. The SAS products provide the ability for VA to procure cost accounting reports for the FSC, Francise Fund Enterprise Centers, and FSC customers based on years of historical data. SAS CPM license and maintenance support is currently being provided through General Services Administration (GSA) Federal Supply Schedule (FSS) under Contract 47QTCA18D0081, Order 36C10A21F0339 awarded to EIS on October 5, 2020, with Option Period Four expiring on September 30, 2025. The period of performance shall be 12 months with one (1) 12-month option period. The total estimated value of the proposed action is , inclusive of the option period.

4. Statutory Authority: This acquisition is conducted under the authority of the Multiple Award Schedule Program. The specific authority providing for a limited source award is Federal Acquisition Regulation (FAR) 8.405-6(a)(1)(i)(B), “Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.”

5. Rationale Supporting Use of Authority Cited Above: Only SAS or its resellers can provide the required SAS software license and maintenance services because of the proprietary source code; therefore, no other source can provide support that allows VA-FSC’s continued use of SAS CPM to meet VA’s functional requirements. Without SAS CPM, VA-FSC could not produce cost accounting reports for FSC, Franchise Fund Enterprise Centers, and FSC customers. EIS is the exclusive reseller of SAS products and services as detailed in the market research section. As EIS is the only authorized reseller, no other vendors can provide the SAS licenses and maintenance support. Introducing a new software application would require additional costs and time to go through the Authorization to Operation process, which is estimated to cost based on historical purchase and installations. This would create an administrative burden and would introduce interoperability concerns. Losing SAS CPM capabilities would create a risk that FSC

Statistical Analytical System (SAS) Cost and Profitability Management (CPM) Software Licenses, Maintenance and Support Control Number VA-25-00077146 could not track and monitor budgets, facilitate payments to vendors and Veterans, or report on finances, which could impact VA operations.

6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that could meet the Government’s requirements. There is no competition anticipated for this acquisition. In accordance with FAR 5.301 and 8.405-6(a)(2) the award notice for this action will be synopsized on the Contracting Opportunities website and this justification will be made publicly available within 14 days of award.

7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are any changes in the marketplace that would enable future actions to be competed. Specifically, the Government will continue to monitor the marketplace to determine whether other brand SAS licenses could integrate into VA’s existing suite of SAS licenses.

8. Market Research: The Government’s technical experts have been performing market research since September 2020, when contract 47QTCA18D0081 36C10A21F0339 was awarded. Market research has been conducted by searching for other software providers as well as another system that may also provide services similar to the current SAS. An additional search by the Contract Specialist was performed on August 10, 2023, verifying with the OEM that the SAS software is only manufactured by SAS and that Executive Information Systems LLC (hereafter referred to as EIS) is the only government authorized reseller. EIS confirmed in a written letter dated August 8, 2025 that they are the sole manufacturer, publisher and sole source SAS in the United States. Additional market research with different software providers did not yield any that could meet VA’s requirements as outlined in Section 5 of this justification. Based upon the above market research, the Government’s technical experts have determined that only EIS SAS license and maintenance support can meet all of VA’s requirements.

Access to the OEM proprietary source code can only be provided by the SAS authorized reseller. Further market research was conducted on National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC), GSA e-Library and GSA Advantage, for other resellers, which did not yield any results. EIS holds a GSA MAS contract and be utilized for this purchase. Based on market research, it was determined that only EIS can meet all of the Governments requirements. Therefore, this action cannot be set-aside for SDVOSB, VOSB, or any other socioeconomic group. As a result, Limited-Sources Justification was completed for this effort. Based on market research, it was determined that only EIS, a small business, can meet all of the Government’s requirements.
