About this file

This is a Brand Name Justification memorandum for a non-competitive purchase order issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD). The contracting activity seeks to acquire Swagelok high-pressure fittings and adapters for the manufacture and repair of Damage Control Equipment for NAVSUP. The estimated total contract value is approximately $53,370.66, which will be conducted using simplified acquisition procedures and funded with 2026 Navy Working Capital Funds (NWCF). The requirement will be competed among Swagelok distributors and does not exceed the simplified acquisition threshold of $350,000.

The justification is based on the determination that Swagelok brand components are the only responsible source capable of meeting the Government's requirements under 10 U.S.C. 2304(c)(1) and FAR 6.302-1(a)(2)(iii)(B). The components form highly specialized life support systems certified under the NAVSEA Diving Certification Authority per SS521-AA-MAN-010 U.S. Navy Diving and Manned Hyperbaric Certification Manual. Using alternative equipment would necessitate costly recertification of oxygen mask control manifold assemblies and could introduce harmful parameters to users. The ten line items include cylinders, O-rings, elbows, connectors, adapters, couplings, and nipples with quantities ranging from 10 to 70 units and unit prices from $9.36 to $555.17. The memorandum includes certification by Richard Allred, DCPPE Depot Production Manager, and approval authority reserved for contracting officers Nicole Stevens, Jamell Kilgore, or Kaitlin Summerville. The requirement will be published on SAM.gov as it exceeds $25,000.

2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency

Requirements FAR 6.302- 1(a)(2)(iii)(B).

Swagelok is the only brand of fittings and connectors that can be used in Damage Control Equipment for the following reasons. These components form highly specialized life support systems under the NAVSEA Diving

Certification Authority. Only those articles which have been successfully tested are qualified. Procedures are specified under SS521-AA- MAN-010 U.S. Navy Diving and Manned Hyperbaric Certification Manual. The objective of this process is to verify that the life support system provides acceptable levels of operator safety throughout the specified operating range. Swagelok Company is a global developer and provider of high-quality and reliable fluid system solutions including products, assemblies and services for the research, instrumentation, process, oil and gas, power, petrochemical, alternative fuels, and semiconductor industries. Using alternate equipment would prove costly in time and dollars to the Government and to the mission by having to recertify the oxygen mask control manifold assemblies. Additionally, use of alternative components may change or introduce new parameters that may be harmful to the user of the oxygen masks. Therefore, it is imperative that Swagelok brand of equipment is purchased.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Swagelok brand hoses and fittings is the only brand of equipment that will meet Government requirements. Additionally, since this requirement exceeds $25,000, this requirement will be published in the Government point of entry beta.SAM.gov.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, the Swagelok brand, is the only brand that can meet this requirement.
