About this file

This document is a justification for other than full and open competition submitted by the United States Marshals Service. The agency seeks to award a sole source contract to D-Fend Solutions AD Inc. to provide two Counter-Unmanned Aircraft Systems with associated maintenance services and training for six to ten personnel. The total estimated value of the two-year contract is redacted. The justification cites FAR 6.302-1, indicating D-Fend's system is the only one that meets the agency's requirements. Efforts made to promote competition included a fifteen-day notice on SAM.gov. Pricing will be determined to be fair and reasonable based on comparison to similar products. The justification also notes consultation with other law enforcement agencies that have tested and deployed various C-UAS systems. The agency plans future outreach to identify emerging technologies. Required approvals by contracting and procurement officials are included.

Any Other Facts Supporting the use of Other Than Full and Open Competition

The USMS contacted numerous law enforcement components (FBI, FPS, CPB, USSS) to gather what C-UAS systems have been utilized and their opinions after testing and evaluation. These DHS and DOJ components have been testing these systems for over two years and created a list that meets the standards and qualifications. The USMS relies heavily on the testing and opinions of our partner federal law enforcement agencies.

Planned efforts to avoid future sole-source situations.

In future, USMS will continue to reach out to the Federal Law Enforcement community and industry for emerging technology and to ascertain what’s being deployed throughout the community.
