About this file

This document is a Sole Source (Including Brand Name) Justification for a federal contract to be awarded to ATI Systems Incorporated for Giant Voice Systems maintenance at Nellis and Creech Air Force Bases. The contract, valued under $750,000, will cover annual and bi-annual preventative maintenance, emergency maintenance, and telephone support for Giant Voice Systems and Towers. The justification emphasizes ATI Systems' proprietary equipment design, with software, central controllers, communications, and speakers that are exclusive to the company, making them the only viable provider without incurring excessive additional costs or system complexity.

The contract will be a firm-fixed price procurement under FAR 6.302-1 authority, citing only one responsible source capable of meeting agency requirements. Market research conducted through government databases (FPDS-NG, GSA, USASpending, and SAM) revealed that the Department of Defense has awarded seven contracts to ATI Systems in the past three years, supporting the sole source rationale. The 99th Contracting Squadron plans to post a synopsis on www.sam.gov indicating intent to award, and commits to conducting continuous market research in future acquisitions to potentially identify alternative manufacturers or distributors that could provide similar services.

March 2023 Page 2 of 3March 2023 Page 2 of 3

I. Contracting Activity.

99th ABW, 99th MSG, 99 Contracting Squadron

II. Nature and/or description of the action being processed.

This action will be a new firm-fixed price contract.

III. Description of supplies/services required to meet agency needs.

Contract ATI Systems incorporated to perform Annual, and Bi-Annual Preventative Maintenance, Emergency Maintenance and Telephone Support for Nellis and Creech AFB, Giant Voice Systems and Towers.

IV. Statutory authority permitting other than full and open competition.

FAR 6.302-1 Only One Responsible Source - No Other Supplies or Services Will Satisfy Agency Requirements

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Due to equipment design exclusive to ATI Systems Inc.; their software, central controller, communications, speakers, and so forth are all proprietary so any other alternative Giant Voice Maintenance solution would induce excessive additional costs to the government while increasing the complexities of the control systems. It is also manufacturer authorized.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

If the critical requirement features are not sustained properly, then direct loss of mission communication would cease to function as equipment software must be compatible; hence, all technicians must be ATI certified in order to maintain proprietary components. A synopsis/Notice of Intent will be posted on www.sam.gov indicating the the government's intent for at least seven (7) business days.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Prior to award, the Contracting Officer shall determine costs to to the Government to be fair and reasonable based on similar or like requirements. Procedures outlined in FAR 13.106-3(a) Award and Documentation shall be followed.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

A search via the following government databases: FPDS-NG, GSA, USASpending, and SAM has yielded a multitude of similar requirements; hence, further supporting the recommendation to solicit this action as a sole source to ATI Systems Inc. under the NAICS code 334290. Within the past three (3) years, the DoD has awarded seven (7) contracts to ATI for similar or like requirements; five (5) of which were for the upgrade/expansion of existing GVs and two (2) were for specific products/services. Of the seven (7) DoD awarded contracts, three (3) of which were solicited as a Brand Name Only requirement and two (2) were publicized using a Notice of Intent to Award on a Single/Sole Source basis.

Moreover, there is a GSA approved price schedule for ATI Systems Inc. under contract 47QSWA23D0027, that expires November 22, 2027; however, this requirement exceeds the ordering limit.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

In the future, continuous market research shall be performed for similar or like requirements to ascertain if other manufacturers/distributors are entering these specified markets that can meet the AFI and/or DoDI standards/requirements. Results from these shall determine if there are other brands available for future similar or like requirements that will neither hinder the mission of the customer nor increase the cost/price for the Government. The 99th Contracting Squadron will always thoroughly review each requirement and conduct the necessary market research in hopes to remove or overcome any barriers to competition before any acquisition takes place.
