Performance Work Statement
Land Rights Acquisition Support Services San Joaquin River Restoration Program
Dated: August 9, 2023
1.0 Background
The Government is acquiring real property along the San Joaquin River in the area more accurately described and shown as the San Joaquin River Restoration Program (Merced, Fresno, Madre, and Stanislaus Counties). The land will be used to construct physical features (fish ladders, flow bypass, fish screens) to reconnect dewatered segments of the river to the upstream and downstream sources. The area is identified in Attachment 1 and hereinafter shall be referred to as the "Program Area" and the action further referred to as the “Program”. Real property acquisition will occur throughout the Program Area and will be supported by this Performance Work Statement (PWS). The PWS will aide the Program by providing: support for residential and non-residential relocation benefits: preparing and collecting titles for federal acquisition: and performing land survey work associated with property acquisition.
2.0 Scope
Public Law 91-646, the Uniform Relocation Assistance and Real Property Acquisition Policies of 1970 as amended, hereinafter referred to as the "Act", requires that whenever the acquisition of real property by a federal or federally assisted program will result in displacement, relocation advisory assistance services shall be provided, and payments made to Eligible Parties who will be displaced by the Program. The contractor will provide relocation services. All relocation services shall be performed in accordance with Public Law 91-646, the Uniform Relocation Assistance and Real Property Acquisition Policies of 1970 as amended.
The relocation consultant firm shall provide all management, supervision, labor, materials, supplies, and equipment, (except as otherwise provided), and shall plan, schedule, coordinate, and ensure effective performance of all services described herein. The contractor shall be required to provide these services in accordance with the requirements of this contract.
Base Services —
1. Relocation Services (time and materials) - The Government authorizes the contractor to provide turnkey relocations services in accordance with the Act, the Uniform Relocation Assistance and Real Property Acquisition Regulations for Federally Assisted Programs (49 CFR Part 24), the Government wide implementing regulations issued pursuant to the Program, and any and all applicable regulations governing, to relocate the occupants and complete the federal action. Assume 18 relocations of moderate complexity.
2. Examining, Cleaning and Clearing of Title Encumbrances (time and materials) - To ensure that there are no adverse or unacceptable encumbrances or “clouds” of title on the title. The Department of Justice Title Standards serve as a guide for the preparation of evidence of title for all acquisitions by the United States of land or interests in land, including acquisitions by direct purchase, exchange, donation, and condemnation. Additionally, the unique purpose of title evidence in condemnation actions is not to confirm that the title is properly vested in the United States, but instead it is to identify all parties who have, or may have, or claim to have an interest in the land, so that they may be named and joined in the action. Assume 30 titles to be examined, cleaning, and cleared of moderate complexity.
3. Cadastral Survey to Support Land Acquisition (time and materials) - To ensure adequate description of acquired land interests and the protection of boundaries once acquired, a land survey resulting in a sufficient legal description and associated maps, and with appropriate documentation, must be completed for the land rights acquired. Additionally, standard boundary evidence and exceptions maps will be developed to adequately support acquisition of land rights. The resulting legal description must be prepared by a surveyor licensed in California where the acquisition is to take place, or by a Bureau of Land Management (BLM) cadastral surveyor. The resulting documents must meet all requirements for recording or notice including the following: “Department of the Interior Standards for Federal Lands Boundary Evidence” (600 DM 5), the instructions and guidance in the “Department of the Interior Standards for Indian Trust Lands Boundary Evidence” (303 DM
7) and the accompanying BLM Manual and Handbook, 9672 and H-9672-1.
