About this file
This is an AB 339 Compliance Check document for RFB #4523 issued by the City of Santa Monica Fire Department in California regarding Class B Aqueous Film-Forming Foam (AFFF) Removal and Disposal. The City is seeking bids for a five-year firm-fixed contract to provide removal, cleaning, and disposal of Class B AFFF from City Fire Apparatus and Fire Station foam storage barrels and containers. The compliance check document verifies that the solicitation meets all applicable regulatory requirements under Assembly Bill 339, which restricts the use of aqueous film-forming foams containing per- and polyfluoroalkyl substances (PFAS) due to environmental and health concerns.
The document confirms that the City's procurement process complies with AB 339 regulations, ensuring that any awarded contractor will handle AFFF removal and disposal in accordance with California state law. The solicitation follows standard municipal contracting procedures for the City of Santa Monica, with the compliance verification serving as a prerequisite step in the bid evaluation process. This document establishes that the City has properly assessed legal and regulatory compliance requirements before awarding the contract, protecting both the City and the selected contractor from potential liability related to PFAS-containing foam handling and disposal.
