About this file

This is a Memorandum for the Record documenting a determination to use other than full and open competition for an acquisition under the simplified acquisition threshold.

The acquisition involves procurement of proprietary Austal USA Ride Control System (RCS) parts and associated industrial technical assistance required to configure, integrate, and maintain the RCS onboard T-EPF class vessels. The required delivery date is 01 March 2027. The intended use is to provide OEM industrial technical assistance and proprietary replacement parts necessary to maintain, configure, and ensure continued operational capability of the vessel's Remote Control System. The required source is Austal USA. The product is not designated as critical ship equipment. The determination selected restricts competition based on restrictive rights and exclusive licensing agreements. Austal USA is identified as the Original Equipment Manufacturer of the proprietary hardware, software, programming, and technical data required to configure, integrate, troubleshoot, and maintain the vessel's Ride Control System. The proprietary nature of these components and technical information precludes other vendors from providing the required supplies and services without access to Austal USA's proprietary data, software, and engineering support. The document indicates that both restrictive rights and exclusive licensing agreement justifications have been marked as applicable to support the sole-source determination.
