About this file
This is a Questions and Answers document for a television broadcasting and production contract opportunity issued by UW-Milwaukee Athletics. The contract seeks a qualified vendor to produce, record, and broadcast the UW-Milwaukee Panthers Men's and Women's Basketball games and coaches shows exclusively in the Milwaukee television market on a dedicated sports channel. The bidder must provide all necessary equipment, personnel, production elements, graphics, music, clearance, market coverage, copyrights, advertiser affidavits, and transmission services. UWM will provide hosts and guests for the coaches shows and reserves the right to use this contract for additional similar service needs in the future. The contract is structured on a per-broadcast payment model rather than a fixed annual fee.
Key contractual requirements and clarifications include that all broadcasting is limited to the Milwaukee market with no current plans for expansion or online simulcasting through platforms such as Facebook or YouTube. Contractors must include all costs in their bid price, including overtime events, with no separate contingency budgets available. UWM retains all intellectual property rights to logos and trademarks and must approve any usage plans submitted by the contractor. The contractor is not responsible for filing IP for broadcast copyrights, as UWM has historically not pursued such filings. Compensation is structured as a cost per game or show, with all travel and ancillary expenses required to be included in the bid price rather than reimbursed separately. Additionally, bidders must be able to meet the location requirements specified in Section 2.5.2, and UWM is not willing to amend this requirement to accommodate vendors based outside the Milwaukee area.

Questions and Answers 5/11/2017 P17-010-O22 Broadcasting Q1: The contract dictates broadcasting to the Milwaukee Television Market. Is there now or will there ever be an opportunity to broadcast outside of Milwaukee?
Answer: At this time just Milwaukee.
Q2: What if any contingency budget can be set aside for events that go into overtime or require additional post editing services for tangible DVD/Blu-ray?
Answer: We have never had any contingencies for overtime games. If a game goes overtime, it has always just been considered part of that event. Your bid price must be fully inclusive of all costs.
Q3: Is there now or will there ever be a dual-cast/simulcast broadcast video “livestream” for online markets, such as Facebook, YouTube or independent Real Time Messaging Protocol (RTMP) server?
Answer: Currently there is not and no discussion that I am aware of. I can't say there will never be, things change from time to time.
Q4: Does UW-Milwaukee Athletics intend for the successful bidder to file for IP (logos, graphics, broadcast copyrights) (vendor name redacted) to release to the University?
Answer: UWM owns all IP rights of their logos/trademarks. UWM can grant permission in writing for use of the logos/trademarks, but UWM would need to see the plan from the contractor on how the logos etc. are going to be used. UWM would have to approve the plan before any use of the logos/trademarks. The contractor will not need to file IP for logos/trademarks. Historically UWM has not filed IP for broadcast copyrights.
Q5: Our uniform, consists of black polo and embroidered logo, dark shoes, and khakis, are there additional requirements like a photo ID passes that should be generated?
Answer: Credentials are issued, but do not feature photos on them.
Q6: There is also the question of an ancillary travel budget; will this be based on mileage or rather a fixed amount?
Answer: UWM will only pay cost per game or show. Any additional costs or fees must be included in your price bid per game or show.
Q7: How will compensation occur / what intervals?
Answer: See previous answer.
Q8: Does UW Milwaukee Athletics Department have its own advertising executives, or are you asking us to issue our advertising affidavit (under the Federal Trade Commission Guide Concerning the Use of Endorsement and Testimonial) so we can sell ads on top of paid programming?
Answer: This bid is for broadcasting of the games and coaches shows only. UWM may be interested in entering into a separate agreement with the contractor in regards to advertising programming. UWM currently shares advertising inventory with our current contractor.
Q9: On the chance that two or more events are simultaneous or overlap in time, how should we decide to priority?
Answer: We have never scheduled 2 events at the same time. If that were ever to happen, UWM would determine the priority.
Q10: With consideration to outside collaboration and the stipulation in Section 2.5.2.4, would the Purchasing Office consider bids from company’s based in Madison with key partners, studios and or offices thirty (30) minutes travel to Milwaukee.
Answer: We are not willing to amend this section at this time.
