About this file
This Questions and Answers document addresses clarifications for Illinois Department of Human Services Invitation for Bid B-54398 concerning removal and replacement of courtyard fencing at Chicago Read Mental Health Center (CRMHC) Units A and C. The project involves approximately 340.7 linear feet and 2,919 square feet of fencing work, including complete removal of existing chain link fencing and installation of new galvanized chain link fencing with curved upper sections featuring fine steel mesh. Work also encompasses demolition of the Unit A center concrete walkway and installation of three inches of asphalt over a prepared gravel base, along with new double equipment gates and staff gates for both units. The project is located at 4200 N. Oak Park Avenue, Chicago, IL 60634, with bids due October 28, 2026. The contract term extends from execution through June 30, 2027, with an initial term not to exceed ten years including renewals or extensions.
The document clarifies three significant bidding requirements. First, vendors must provide a USDOL Apprenticeship and Training Certificate or Program Letter documentation from both the prime contractor and any subcontractors performing labor. Second, the prime contractor must satisfy a 51% on-site self-performance requirement with its own permanent, full-time W-2 employees, meaning fencing installation cannot be performed entirely by subcontractors. Third, a performance bond is required only when the quoted cost exceeds $150,000 pursuant to 30 ILCS 550/1; contracts valued at $150,000 or less do not require a bond at contract execution. This is a Small Business Set Aside Program opportunity restricted to certified small business vendors, and prevailing wage requirements apply to this public works project.

B-54398 DHS IFB CRMHC Courtyard Fencing Questions and Answers
| 1. | Apprenticeship Requirement: The CO150 requires bidders to provide a USDOL Apprenticeship and Training Certificate or Program Letter. If the prime contractor does not independently maintain an apprenticeship program, can this requirement be satisfied through a qualified subcontractor who holds the appropriate documentation? |
| Answer: | The USDOL Apprenticeship Program letter applies to both Prime vendor and sub-contractor. So documentation is required for Prime only if self-performing all the labor. If sub-contracting, documentation is needed for both Prime Vendor and Sub-Contractor. |
| 2. | Subcontracting Requirements: Are there any minimum self-performance requirements for the prime contractor, or may the fencing installation be performed entirely by a qualified subcontractor under the prime contractor's supervision and management? |
| Answer: | Please see Section 1.5 of the contract. There is a 51% on site Self-Performance Requirement for the Prime Vendor. |
| 3. | Performance Bond: The BidBuy pricing schedule indicates that vendors should enter $0 for the performance bond if the quote is under $150,000. However, the CO150 appears to require a performance bond regardless of contract value. Could you clarify whether a bond is required for contracts below $150,000? |
| Answer: | Per 30 ILCS 550/1, any work on a Public Building, where the quoted cost to complete is over $150K, needs a Performance Bond before work can begin or at contract execution. If your quote is under $150K, a performance bond would not be needed at contract execution. |
