Amendment #09

Revisions, Questions, Answers and Clarifications to the EIS RFP

This amendment includes the following:

- A note regarding a current protest.

- Questions received from potential offerors regarding the RFP. All questions received thus far have been answered.

- Answers to the questions listed. Answers include changes to the RFP Sections and clarifications that do not require changes to the RFP Sections.

The revisions, questions, answers and clarifications are listed based on the UCF Sections. The question numbers are from the Acquserve portal and are not in sequential order. Please note that some answers revise more than one section of the RFP.

Current Protest

Compuline International has filed a pre-award protest at GAO against the terms of the EIS solicitation. GSA will receive proposals and evaluate proposals, but will not make award until such time as GAO either issues a decision on the merits, or dismisses the protest. The GAO has docketed this protest as B-412747, with a decision date of May 26, 2016.

The RFP is amended as follows:

Question # 1003 Section: Section J Section # 2.10.3.1.2

Question:

The access_type data element as defined in J.2.10.3.1.2 is derivable from the CLIN. Can this data element be removed?

Answer:

The RFP will be amended as follows:

In Sections J.2.10.2.1.12, J.2.10.2.1.18, and J.2.10.3.1.2 to remove the line for element name access_type.

In Section J.2.10.1.3.3.1 (attachment) to remove the access_type element from the SOCN.xsd

In Section J.2.10.1.3.3.2 (attachment) to remove the access_type element from the SOCN.wsdl

In Section J.12 to change the definition for "Access Type" to read "The type of access being provided. Five access types are defined: 1. Wireline Access 2. Ethernet Access 3. Cable Access 4. Fiber to the Premises (FTTP), 5. Wireless Access." vs "The categorization of facilities used to provide access."

Questions and Answers That Do Not Include RFP Changes

Question # 998 Section: Section B

2.5.3.1.1.1

Question:

We request an exception to the fixed price column formulas specified in table B.2.5.3.1.1.1. The economic constraints of the service do not permit compliance with the pricing formulas, which establish a fixed mathematical relationship between the variable price and the fixed price component. We have proposed an alternate pricing scheme that is compliant with the table structure but that deviates from the recommended formulas.

Answer:

The request for an exception is denied. The offeror can use the CDNS TUC price constructs as described in B.2.5.3.2.1 and B.2.5.3.2.2 to propose alternative price schemes at the task order level.

Question # 999 Section: Section B

1.2.5

Question:

We are taking exception to the requirement in the EIS proposal Section B.1.2.5, which restricts pass through cost for non-domestic plans. Primary carriers in each country can change rates, plans, and supported features as they choose. As is standard commercial practice, those changes in rates, which are subject to change on a quarterly basis at a minimum, are passed on to our customers. Also, allowing the pass through of international rates are consistent with our GSA FSSI Contract #GS-35F- 0119P and GSA FSSI BPA #GS00Q13NSA3003. Recently, the government released two procurements with similar requirements--a Department of State RFI and an USAID RFP--that were both withdrawn after industry feedback on the issues regarding country coverage and pricing methodologies. Industry convinced the Government that the requirement cannot be supported. We feel the best approach is to leverage the catalog approach GSA is establishing under EIS to offer international cellular services to its customers based on established and evolving commercial practices for those services.

Answer:

The FAR 15.402 requires Contracting Officers to purchase supplies and services at fair and reasonable prices. This cannot be done in the case of pass through prices since the CO does not know the price prior to placing the order. However, Question 385 in Amendment 04 states "both the International Mobile Roaming Bucket and Unlimited Prices Table and the International Mobile Roaming Catalog Table are optional. Therefore, one of the tables may be offered without offering the other table." This allows the contractor to strictly offer pricing through the catalog if desired. Although pass through costs are not allowed, the catalog pricing may be based upon a contractor's costs and can be quickly changed, or priced TUCs can be awarded at the TO level.

Question # 1000 Section: Section B Section #

Question:

According to some of our employees who were on the AcquServe training yesterday, the Government provided pricing information that was not clearly articulated in the RFP. Specifically the fact that services have to be priced at a the same level across all of the CBSAs. This fact was not spelled out properly in the solicitation, and this is requiring a bit of re-work of our pricing inputs. Because of this late instructions, MicroTech requests a short "no more than two week" extension to the submission deadline. Thanks for your consideration. Regards, Sandy Scott

Answer:

The training session information was not in conflict with the RFP. The transport price tables clearly do not provide variability in pricing more granular than the specific country/jurisdiction code.

There will be no extension to the due date based on this question.

Question # 1001 Section: Section B

2.6.6.2

Question:

Exception to Wireless CLINs: WL01100: MRC Canada & Mexico 150 MB Data: 150 MB of data, unlimited messaging, and unlimited Wi-Fi and WL01110: MRC Global* 300 MB Data: 300 MB of data, unlimited messaging, and unlimited Wi-Fi. Regarding CLINs WL01100 and WL01110, the availability of these services in each of the defined jurisdictions is determined by the local carrier, not by us. These services vary from country to country and carrier to carrier. Further, both the services and prices charged for the services in these countries can change at any time and are not under our control. These requirements and pricing methodologies are not on or a part of the current GSA FSSI contract nor are they standard industry commercial practice. We feel that leveraging the catalog approach GSA is establishing under EIS is the best way to offer international cellular services to its customers.

Answer:

Question 385 in Amendment 04 states "Both the International Mobile Roaming Bucket and Unlimited Prices Table and the International Mobile Roaming Catalog Table are optional.

Therefore, one of the tables may be offered without offering the other table." In other words, if the contractor prefers to only offer International Mobile Roaming Catalog pricing and not CLIN WL01100 or CLIN WL01110 under the International Mobile Roaming Bucket and Unlimited Prices Table, it may do so.

Question # 1002 Section: Section B Section # 2.2

Question:

After reviewing the government's answer to question #995, we have the following issue: If we populate table B.2.2.2.1.9.1, then we are required to select the related non-domestic locations in Step 5. However, if we select non-domestic locations in Step 5 then we must price origination from those locations in tables B.2.2.2.1.7 ('csvs_oc_nondom_2co_usage_prices') and B.2.2.2.1.8 (' csvs_ocnondom_2ocnondom_usage_prices'). If we do not intend to bid CSVS non-domestic origination in tables B.2.2.2.1.7 and B.2.2.2.1.8, then we cannot populate table B.2.2.2.1.9.1 without error. If we leave table B.2.2.2.1.9.1 empty, then it shows as incomplete in our AcquServe progress. Does the government intend to have this result? We have a similar issue for IPVS as well with table B.2.2.1.3.3.1.

Answer:

The AcquServe portal will be updated to not require an offeror to select the non-domestic locations in Step 5 in order to populate tables B.2.2.2.1.9.1 and B.2.2.1.3.3.1. This supersedes the answer in question 995.
