About this file

This document contains the Special Terms and Conditions for a solicitation issued by the Virginia Department of Forensic Science (DFS). The solicitation is for the purchase of Dayton V-Belts in various sizes and quantities, to be delivered FOB to the Norfolk, VA laboratory. The Commonwealth reserves the right to request additional information from bidders, and prohibits the contractor from using the Commonwealth's name in advertising without prior written consent. The contract will be awarded to the lowest responsive and responsible bidder that is a DSBSD-certified micro business if the bid is $10,000 or less, or to the lowest responsive and responsible DSBSD-certified small business if the bid is $100,000 or less, provided the Commonwealth deems the price to be fair and reasonable. If those criteria are not met, the award will go to the lowest responsive and responsible bidder of any size, as long as the Commonwealth deems the price fair and reasonable. The solicitation includes a 60-day bid acceptance period, a most favorable commercial warranty requirement, and an ordering option allowing the DFS to place additional orders up to 100% of the original quantity during the first 60 days.

The pricing must include FOB Destination to Norfolk, VA and a lift gate delivery. No equivalents to the Dayton V-Belts will be accepted. The contract will be awarded on a grand total basis. The solicitation is limited to the Norfolk City jurisdiction.

2. ADVERTISING: No indication of such sales or services to the Virginia Department of Forensic Science (DFS) and/or the Commonwealth of Virginia will be used in product literature or advertising without the prior, written consent of DFS. The Contractor shall not state in any of its advertising or product literature that the Commonwealth of Virginia or any agency or institution of the Commonwealth has purchased or uses its products or services without the prior, written consent of DFS.

3. AUDIT: The contractor shall retain all books, records, and other documents relative to this contract for five (5) years after final payment, or until audited by the Commonwealth of Virginia, whichever is sooner.

The agency, its authorized agents, and/or state auditors shall have full access to and the right to examine any of said materials during said period.

4. AWARD: The Commonwealth will make the award(s) on a grand total basis to the lowest responsive and responsible bidder that is a DSBSD-certified micro business if such a bid is received, provided that the bid is up to and including $10,000 and the agency in its sole discretion determines that the bid price is fair and reasonable. Otherwise, award of the contract shall be made to the lowest responsive and responsible bidder that is a DSBSD-certified small business if such a bid is received, provided that the bid is not more than $100,000 and the agency in its sole discretion determines that the bid price is fair and reasonable. If, in the agency’s opinion, the criteria in the previous two sentences are not present, then award shall be made to the lowest responsive and responsible bidder of any size, provided the agency in its sole discretion determines that the price is fair and reasonable. If applicable, unit prices, extensions and grand total must be shown. In case of arithmetic errors, the unit price will govern. If cash discount for prompt payment is offered, it must be clearly shown in the space provided. Discounts for early prompt payment will not be considered in making awards. 6. WARRANTY (COMMERCIAL): The contractor agrees that the goods furnished under any award resulting from this solicitation shall be covered by the most favorable commercial warranties the contractor gives any customer for such goods and that the rights and remedies provided therein are in addition to and do not limit those available to the Commonwealth by any other clause of this solicitation and rights and remedies permitted under applicable law. A copy of this warranty should be furnished with the bid.

7. eVA ORDERS AND CONTRACTS: The solicitation/contract will result in one (1) purchase order with the applicable eVA transaction fee assessed for each order.
