About this file

This is a Questions and Answers memo issued by the New York State Office for People With Developmental Disabilities (OPWDD) Contract Management Unit in response to inquiries regarding RFQ FL 090226 for temporary fence installation around Building 59 at the Finger Lakes Developmental Disabilities State Operations Office Newark Campus in Wayne County. The project requires design, procurement, and installation of approximately 1,600 linear feet of temporary chain-link fencing with a minimum of two 10-foot swing gates, with work to be completed within 120 working days of contract approval. A mandatory site visit was held on August 19, 2026, with quotes due by September 2, 2026. The procurement is restricted to MWBE-certified, SDVOB-certified, or New York State small business contractors, with two separate postings issued for the same work but only one award to be made.

The Q&A memo addresses technical specifications and contracting procedures relevant to bidders. Key clarifications include confirmation that all three fence rails (top, middle, and bottom) are required; corner posts must be 3 inches in diameter; only SCH40 pipe is acceptable, not Class B Steel Tubing; and galvanized fabric must meet ASTM A 392 class II specifications with 2.0 ounces per square foot. The memo confirms that no non-collusion form, bid bond, or retainage is required. Payment will be made in accordance with New York State Finance Law upon the Bronx Developmental Center's receipt of a complete and accurate invoice upon completion of work. The project is subject to prevailing wage requirements as a New York State Public Works project, and contractor responses must remain valid for 120 days from the due date.
