PART 1
1.0 GENERAL INFORMATION
The mission of Naval Medical Center San Diego (NMCSD) is to prepare to deploy in support of operational forces, deliver quality health services and shape the future of military through education, training, and research.
1.1 This is a non-personal services contract to provide Roman Catholic Priest #1 Night-Time On-call Services.
1.2 Description of services/introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Roman Catholic Priest Night-Time On-call Services as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property and services. The contractor shall perform to the standards in this PWS.
1.3 Background: [The contractor shall provide Roman Catholic Priest Night-Time On-call Services for the Naval Medical Center San Diego, CA and associated Branch Clinics. The Roman Catholic faith is a significant cross section of patients and staff requiring religious support at NMCSD. Approximately 30% of the hospital nature of pastoral care to Roman Catholics is sacramental in nature. The celebration and administration of sacraments requires the presence of a Catholic Priest. The decreased availability of Navy Catholic Chaplains has created a situation in which adequate Catholic coverage is not available at NMCSD. Therefore, it is essential that Contract Catholic Priests are available to provide pastoral care and sacraments to Roman Catholic patients and staff at NMCSD.
1.4 Objectives: The contractor shall provide spiritual and pastoral care to Catholic patients and their families. Respond to emergencies or crises when pastoral care is appropriate.

1.5 Scope: Roman Catholic Priest Night-Time On-call Services. The contractor agrees to perform on behalf of the U.S. Government, the duties of a Roman Catholic priest for the spiritual care of active duty military personnel, their dependents, eligible Navy civilian employees, and other eligible beneficiaries, per the terms and conditions of the contract.

1.7 Administrative specifications
1.7.1 Place of performance: The work to be performed is located within the Pastoral Care Services Department, Naval Medical Center, San Diego (NMCSD), 34800 Bob Wilson Dr, San Diego, CA 92134-5000.

1.7.3 Hours of operation: The contractor is responsible for conducting business Sunday thru Saturday. The contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.
1.7.3.1. The contractor shall provide:
1) Roman Catholic Priest Night-Time On-Call Services. The contractor shall provide services (using a duty beeper or available phone number) from the 1st – 15th nights of each month from 1600 - 0700 on week nights, and/or 0700 - 0700 (24hrs) Saturdays, Sundays and holidays.
1.7.3.2. Billing for Services: – The contractor shall only bill for services performed.
1.7.4 Emergency Services: NA

1.10 Quality
1.10.1 Quality Control (QC): The contractor shall develop and maintain an effective QC program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure nonrecurrence of defective services. The contractor’s QC program is the means by which the work complies with stated requirements. Within 30 days after contract award a comprehensive written QCP shall be submitted to the CO and COR within 5 working days when changes are made thereafter. After acceptance of the Quality Control Plan (QCP) the contractor shall receive the CO’s acceptance in writing of any proposed change to his QC system.
1.10.2 Quality assurance (QA): The government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan provides a systematic method for the Government to evaluate performance and to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.11 Contractor personnel
1.11.1 CAC requirements: For all contractors who will work in Government facilities, the Facilities Security Officer (FSO)/Company's Security point of contact (POC) will provide the Government all the required information per the DHA CAC request process current version 2.1, January 2018, or more recent when updated. See process attached at Part 7 Section 7.1.1 of the PWS. A CAC is the standard identification for eligible DoD contractor personnel.
1.11.1.1 The contractor shall return all CACs to the COR upon the departure of the contractor(s).
1.11.2 Contractor onboarding and training. The contractor shall complete all requirements, training, and forms as prescribed in the following requirements: As required by the MTF Leadership.
1.11.3 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.12 Key personnel (Contractor): The contractor shall provide a list of key personnel within 5 days of contract award.
1.12.1. Contractor Representative – The Contractor shall designate a representative who will be the Contractor’s Point of Contact (POC) at the contract level. The POC shall be an individual who is knowledgeable of the terms and conditions of the contract and authorized to make decisions regarding the contract. The Contractor shall submit the representative’s contact information, to include email address and phone number, and any other key personnel, in writing, to the PKO not later than 10 business days after receiving notice of contract award.
1..12.2. Representative Status Change: The Contractor shall notify both the contract KO and the task order KO(S) in writing of changes in the status (i.e., termination or replacement) of designated contract-level contractor representative within one (1) business day of the change.
1.13 Data rights: Reserved
1.14 Reporting
1.14.1 Contractor Manpower Reporting (CMR): RESERVED.
1.14.2 Non-Disclosure Agreement (NDA): All contractor personnel who will obtain access to proprietary, classified, or confidential information or any information release of which is protected or governed by law or regulation associated with DHA acquisitions shall be required to complete and sign a DHA contractor NDA (DHA Form 49) prior to beginning work on the subject contract. The contractor shall execute an NDA on behalf of the company and shall ensure that all staff assigned to, including all subcontractors and consultants, or other personnel performing on contract/Task order execute an NDA protecting the procurement sensitive information of the Government and the proprietary information of other contractors. The NDA shall be executed not later than first day of employment and to be renewed upon exercising a contract option period. Assignment of staff who has not executed this statement or failure to adhere to this statement shall constitute default on the part of the contractor. The contractor shall maintain originally signed NDAs of individual employees and provide copy to the COR.
1.14.3 Government’s COR: The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor contractor's performance and notifies both the CO and contractor of any deficiencies; coordinate availability of government furnished property; and provide site entry of contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting contract.
1.14.4 Post award conference/periodic progress meetings: The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The CO, COR, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the CO will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.15 Contractor Identification
1.15.1 Contractor personnel performing services in a contractor capacity in a Government facility are required to possess and wear an identification badge that displays his or her name and the name of their company. All contractor personnel shall identify themselves as contractor support personnel in all forms of communication with all entities with whom DHA/Deputy Assistant Director for Acquisition (DAD-A)/Head of the Contracting Activity (HCA) has business dealings. The contractor shall: Answer all telephone calls and have a personalized voice message with an introductory statement that includes the fact that the person is contractor support personnel. Ensure all those with whom the person interacts in any face-to-face dealings while supporting the DAD-A understands that the person is contractor support personnel. Include a title block in all emails that states the fact that the person is contractor support personnel. Ensure all those with whom the person interacts in any face-to-face dealings while supporting DHA/DAD-A/HCA understands that the person is contractor support personnel.
1.15.2 Contractor personnel will be required to attend meetings or otherwise communicate with Government and/or other contract representatives to meet the requirements of this order. Contractor personnel shall make their contractor status known during introductions.
1.15.3 Contractor personnel, while performing in a contractor capacity, are prohibited from using their retired or reserve component military rank or title in any written or verbal communications associated with the contracts in which they provide services.

1.17 Personnel Security
1.17.1 The contractor shall comply with DoD 8570.01-M, “Information Assurance Workforce Improvement Program, CH4” November 10, 2015 as amended; 8500.01, “Cybersecurity”, dated March 14, 2014; DoD Manual (DoDM) 6025.18, “Implementation of the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule Compliance in DoD Health Care Programs” dated March 3, 2019, Department of Defense Instruction (DoDI) 6025.18 “HIPAA Privacy Rule Compliance in DoD Health Care Programs”, dated March 13, 2019; and DoDM 5200.02 “Procedures for the DoD Personnel Security Program (PSP),” incorporation change 3, effective September 24, 2020. Contractor responsibilities for ensuring personnel security include, but are not limited to, meeting the following requirements:
1.17.1.1 Follow the DHA Personnel Security Office guidelines for submittal of security clearances. Contact the DHA Personnel Security Office for guidance on the appropriate background investigation required for personnel on the contract.
1.17.1.2 Initiate, maintain, and document personnel security investigations appropriate to the individual’s responsibilities and required access to Controlled Unclassified Information (CUI).
1.17.1.3 DHA Personnel Security Office does not deny any access to any automated information system (AIS), network, or Controlled Unclassified Information (CUI). If a contractor receives an unfavorable background investigation, the request for access will be sent back to the FSO for further action. Any unfavorable adjudication will result in DHA Personnel Security Office not signing off on any access request.
1.18. Initial Placement: The contract shall ensure contractor begin performance as follows: 18 Mar 2024.
1.19. Absences: Unplanned absences due to illness or other incapacitation of the contractor will be allowed up to a maximum of 15 days per contract year. The contractor shall advise the Pastoral Care Services Department Head of such absences. If the contractor is absent for three or more days due to illness, he shall provide a written documentation from a qualified health care provider that he is free from any communicable disease. The Government reserves the right to examine or reexamine any such contractor who meets this criterion.
1.20. Health Requirements: A physical examination certification, which states the date on which the physical examination was conducted, the name of the doctor who performed the examination, and a statement concerning the physical health of the contractor. The certification must contain the following statement: “(Name of contractor) is suffering from no physical disability or medical condition which would restrict or preclude his/her from providing services as a Roman Catholic Priest. (Name of contractor) is suffering from no contagious diseases to include but not limited to AIDS, tuberculosis, hepatitis, and venereal disease, and is not positive for HIV antibodies.”

2.0 DEFINITIONS, ACRONYMS, AND APPLICABLE PUBLICATIONS/INSTRUCTIONS
2.1 Definitions:
2.1.1 Category D: Information Technology (IT) and Telecommunications Services (called D-Services)
2.1.2 Category R: Support (Professional/Administrative/Management) Services (called R-Services)
2.1.3 Contracting Officer (CO): A person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.
2.1.4 Contracting Officer’s Representative (COR): An individual, including a contracting officer’s technical representative (COTR), designated and authorized in writing by the CO to perform specific technical or administrative functions. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.5 Nonpersonal services contract: a contract under which the personnel rendering the services are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.
2.1.6 Quality Assurance Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance. The Government may either prepare the QASP or require the offerors to submit a proposed quality assurance surveillance plan for the Government’s consideration in development of the Government’s plan.

3.2.2. Legal Authorization to Work in the United States: Contractors performing under this contract must be a U.S. Citizen. U.S. citizens who are also dual citizens are not specifically excluded from occupying either sensitive or designated IT positions, however, a dual citizenship status raises foreign influence and foreign preference concerns that will most likely prohibit interim assignment pending favorable investigation and adjudication of these issues. Eligibility will not be established for persons who hold a foreign passport.

5.0 SPECIFIC TASKS
5.1 Duties: Roman Catholic Priest Night-Time On-Call Services
5.1.1. An ordained Roman Catholic priest endorsed by the Archdiocese for the Military Services shall provide Roman Catholic on-call and scheduled non-personal services.
5.1.2. The contractor agrees to perform on behalf of the U.S. Government, the duties of a Roman Catholic priest for the spiritual care of active duty military personnel, their dependents, eligible Navy civilian employees, and other eligible beneficiaries, per the terms and conditions of the contract. The contractor, although in fact not a Government employee, shall comply with Executive Order 11222 of May 8, 1965, “Prescribing Standards of Ethical Conduct for Government Officers and Employees”, and shall also comply with Department of Defense (DOD) and Department of Navy (DON) regulations implementing this Executive Order.
5.1.3. On-call services include the sacraments, visitation, and counseling of Catholic patients/personnel, their dependents and other beneficiaries. The contractor shall respond within one (1) hour from the time of call.
5.1.4. The contractor shall perform, within the parameters of his ordination and the dictates of his faith group, a full range of pastoral services on-site.
5.1.5. On-call service as scheduled by the Pastoral Care Services Department Head includes visiting any Roman Catholic patient/personnel who request the presence of a priest directly or through family or staff, the normal process of notification as a result of being placed on Serious/Very Serious List, and on the occasion of death. The contractor shall refer 2 patient/personnel to Pastoral Care Services for consultations and continuation of pastoral care, respecting and following normal privilege or confidential communications.
5.1.6. Providing spiritual and pastoral care to Catholic patients and their families.
5.1.7. Responding to emergencies or crises when pastoral care is appropriate.
5.1.8. As an independent contractor, all medical, dental and professional liability insurance is the responsibility of the contractor.
5.1.9. Communicating effectively with persons of diverse races, cultures, religions, nationalities, ages, and persons having varying types and degrees of disability, in order to understand and address their specific needs.
5.1.10. Work shall be performed on site. Meetings between the contactor and the Pastoral Care Services Department Head, or her/his representative, shall be performed on site.
5.1.11. Communication. The contractor is authorized to meet with Department Heads, Directors, supervisors, and other staff personnel as well as patients and their families in the performance of pastoral responsibilities. The contractor shall pursue all administrative matters through the Pastoral Care Services Department Head. The Pastoral Care Services Department Head will provide a written performance evaluation to the contractor mid-year and at the close of the fiscal year.
5.1.12. The contractor shall become acquainted with and obey all pertinent Command, Navy, and DOD regulations, shall perform in a manner which precludes any waste of utilities and shall not use Government telephones for personal business. All motor vehicles operated on this installation by the contractor shall be registered with base security and operated according to applicable directives. Eating and smoking by the contractor are prohibited in patient care areas and restricted to designated areas.
5.2. General Qualifications: Roman Catholic Priest Night-Time On-Call Services
5.2.1. Personal Qualifications. The contractor shall be a valid ordained Roman Catholic priest in good standing with his diocese or religious order and endorsed by the Archdiocese for Military Services. The Archdiocese for Military Services will not endorse a third party contractor submitting for endorsement on behalf of the Roman Catholic priest. The Catholic priest shall demonstrate reliability, good relational skills and the ability to serve on an ecumenical ministry team. The contracted priest shall comply with Government policies and regulations in regard to identification badges, parking, and professional decorum.
5.2.2. Ecclesiastical Endorsement. An ecclesiastical endorsement, dated within 12 months prior to the closing date of this announcement. Ecclesiastical endorsements for Roman Catholics are issued only by the Archdiocese for the Military Service USA in Washington, DC.
5.2.3. Education. A Master of Divinity from an accredited institution or the equivalent. Equivalent education is a bachelor's in Theology from a pontifical institution plus an additional year of pastoral and academic work toward the licentiate degree.
5.2.4. Experience. At least 3 years of professional ministry experience. At least 2 years of this experience must have been obtained after completion of the Master of Divinity or equivalent. Experience obtained during graduate education may be counted for up to one year of the 3 years required.
5.2.5. Clinical Pastoral Education (CPE). Recommend completion of four units of Clinical Pastoral Education in a program certified by a national body that certifies CPE programs.
5.2.6. Board Certification. Recommend Board Certification from Association of Professional Chaplains (APC) or National Association of Veteran Affairs Chaplains (NAVAC).
5.2.7. Peer Review. Contractor shall meet the Bureau of Medicine and Surgery (BUMED) professional requirements in BUMEDINST 1730.2A, section 11 (Competencies and Professional Development) letter “g.” which states “All chaplains, pastoral counselors, and Contract Religious Ministry Professionals (CRMPs) are expected to participate in ongoing interdisciplinary peer and case reviews. Contractors are expected to complete 50 hours of Professional Continuing Education (CE) and submit one verbatim per fiscal year.
5.2.8. Primary Point of Contact. The Pastoral Care Services Department Head at NMCSD is the primary point of contact for the contracted priest.
5.2.9. No Non U.S. Citizens shall be allowed to perform under this contract without an Alien Registration Card (“green card”) and/or in violation of the Immigration Laws of the United States.
5.2.10. The contractor shall be neat, clean, well groomed, and in appropriate clergy clothing (shirt with Roman collar) when in patient care and public areas. The contractor shall display an identification badge on the right chest area of his/her clothing, which includes the contractor’s full name, professional statues, and expiration date. A command issued identification will be provided.
5.2.11. The contractor shall be able to read, write, speak, and understand the English language fluently.
5.2.12. Interview. The Pastoral Care Services Department Head conjointly with at least one other NMCSD staff chaplain will interview each applicant. The interview will reflect a review of the overall package with emphasis on the following:
(1) Overall professional training and experience of the candidate as a hospital chaplain.
(2) Military experience and/or understanding of military methods by the candidate.
(3) Flexibility of the candidate in meeting the needs of the hospital patients and staff within the parameters of the contract.
(4) Perceived ability of the candidate to do sustained and intense hospital ministry.
(5) Perception of the candidate as a team player who can edify and be edified by the Pastoral Care Service team.
(6) Overall evaluation of package and all of the above.

6.0 INFORMATION TECHNOLOGY & SECURITY

6.3 Personally Identifiable Information (PII)/Protected Health Information (PHI), Procurement, and Federal information requirements:
Use of Protected Health Information (PHI). Performance of this PWS may include access or exposure to private information subject to compliance to FAR Subparts 52.224-1 and 52.224-2. The contractor shall use PHI for their designated project. The contractor shall not use the PHI to create databases, or any other product not intended for use specifically for this requirement. The contractor shall destroy all PHI related to the requirement, that is not delivered to the government at the conclusion of the tasking. All hard drives containing unclassified data outside of DOD shall be removed and destroyed through sanitation of SI from storage media in a manner that gives assurance that the information is unrecoverable by technical means. Destruction of hard drives shall comply with National Institute of Standards and Technology (NIST) Special Publication 800-88, Revision 1, regarding destruction of computer hard drives prior to disposal.
Personally Identifiable Information (PII)/PHI that is processed and printed out on government or contractor Information Systems (ISs) and networks is considered SI and will be treated as “For Official Use Only” (FOUO) information, as directed by DoDD 5400.7, “DoD Freedom of Information Act Program.” . Any SI, e.g., PHI and privacy data, processed, printed, stored, or manipulated on government or contractor ISs and networks will be protected, marked, and labeled IAW DoD 5200.1-R.
The contractor shall maintain, transmit, retain in strictest confidence, and prevent the unauthorized duplication, use, and disclosure of PHI IAW the regulations at Parts 160 and 164 of title 45, Code of Federal Regulations, DoD Health Information Privacy Regulation (DoD 6025.18-R), the Privacy Act, and DoD Privacy Program (DoD 5400.11-R). The contractor shall ensure that beneficiary information is only accessible to employees, contractors, subcontractors, and government personnel having a need to know such information in the performance of their duties for this requirement.
Health Insurance Portability and Accountability Act (HIPAA) Requirement. The contractor shall comply with the most current version of all government privacy and security regulations and directives and other applicable DoD Service privacy and security instructions and regulations. In addition, the contractor shall comply with the most current version of all relevant rules and regulations that implement the applicable requirements of the Health Insurance Portability and Accountability Act (HIPAA) of 1996. This shall include the regulations at Parts 160 and 164 of title 45, Code of Federal Regulations, TRICARE Operations Manual 6010.51-M, August 1, 2002, Chapter 21, Section 3; DoD Health Information Privacy Regulation (DoD 6025.18-R); Privacy of Individually Identifiable Health Information in DoD Health Care Programs (DoDI 6025.18); the Privacy Act; and DoD Privacy Program (DoD 5400.11-R). Additions, supplements, amendments, or changes to these publications may be issued during the life of the contract. Changes to mandatory publications which cause a change in performance that will increase or decrease price will be incorporated into the contract by mutual agreement of the parties.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any service within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 days of contract expiration.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.
