PERFORMANCE WORK STATEMENT (PWS)
FOR
FIRE PUMPS EMERGENCY BACK UP GENERATOR BLDG 4425/4455
Project Number PYKL162023
1.0 General:
This is a non-personnel services contract with a requirement to install an emergency backup diesel generator to operate the fire pumps during power outages that support the fire suppression system in all three hangers at 164th Airlift Wing (AW) Tennessee Air National Guard Base, Memphis, TN. The three hangers were built in 2008, and support the current C-17 aircraft mission at the 164th AW. The current fire suppression system is approximately 15 years old and the fire pumps were installed without a backup generator. An emergency generator with a minimum capacity of 400 kW to operate the fire pumps during power outages is required. The diesel generator shall feed the existing emergency backup panel with an automatic start feature and an automatic transfer switch. The generator shall operate on diesel and be able to operate for a minimum of twenty four (24) hours without refilling the tank, it shall also include a battery charger/maintainer and a freeze protection system. The emergency backup generator shall comply with the following standards: UFC 3-540-01, UFC 3-600-01, National Electrical Code (NEC), National Fire Protection Association (NFPA) standards.
The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers will be accountable solely to the Contractor who in turn is responsible to the Government.
1.1 Scope: Install a Cummins (or approved equal) 400 kW emergency diesel backup generator (Name brands are for quality assurance, not for sole source) on a new concrete pad (remove/replace sidewalk as indicated in design plans) It shall include any conduit, cabling, and electrical work required to connect the new generator to existing panel.
1.1.1 Contractors shall include a narrative describing their work plan for installing the fire pumps emergency backup generators. Duration of the repair timeline and repair procedures shall be a consideration. The work done shall be in accordance with Pickering Firm, Inc Design plans (SBC NO. 361/10601-2020)(PFI NO. 25979.00).
1.1.2 The contractor responsibilities include but are not limited to removal and replacing a section of sidewalk, placing a new concrete pad, installing the generator on the new concrete pad, and installing all required conduit, cabling, and electrical work in accordance with Pickering Firm, Inc design plans (SBC NO. 361/10601-2020)(PFI NO.
25979.00), NFPA standards, National Electrical Code, UFC 3-540-01, and UFC 3-600- 01.
1.1.3 Except for items specified in Paragraph 3.0 as Government Furnished, the contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary to perform the installation of the emergency backup generator as specified in the Solicitation, Contract, Performance Work Statement, and Specifications. Performance shall achieve an acceptable quality level of ninety-eight
(98) percent Services, as defined in this PWS.
1.2 Background: The three 164th AW hangers require a 400 kW emergency backup generator that will ensure the operation of the fire pumps during power outages. The hangers currently do not have an alternative means to operate the fire pumps without power. A fire event during a power outage could result in loss of personnel, assets, equipment, and buildings. Install the 400 kW diesel emergency backup generator at the combined hanger on the 164th AW Tennessee Air National Guard Base, Memphis TN.
1.3 The Period of Performance shall be 365 days: 19 SEP 2022 – 18 SEP 2023.
1.4 General Administrative Information:
1.4.1 General Requirements: The primary responsibility for overall management and control of work and documentation lies with the contractor. The contractor is required to develop an organized project management process and controls. The Air National Guard does not follow a specific project documentation format for sustainment, minor renovation and restoration projects. The 164 AW does accept the use of USACE Engineering Regulation 1110-1-8155 Engineering Design Specifications and Construction Specifications Institute (CSI) Division 1 General Requirements.
Contractors shall use Air Force form AF3000 Submittal Form for all materials and documentation requiring Government approval. Contractors shall use Air Force form AF1477 Construction Inspection Report for documenting daily progress.
1.4.2 Quality Control (QC): The contractor shall develop and maintain an effective QC Plan (QCP) to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s QCP is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the contractor shall develop QC procedures that address the areas identified in Technical Exhibit 1, Performance Requirements Summary (PRS).
1.4.3 Quality Assurance (QA): The Government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government will do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) or defect rate(s).
1.4.4 Recognized Holidays: The following are recognized United States (US) holidays.

1.4.5 Place and Performance of Services: The contractor shall provide services between the hours of 7:00 a.m. – 4:15 p.m. on Monday through Friday, except on recognized US holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government-directed facility/installation closings. The duty day hours may be adjusted if previously identified and approved by the Base Civil Engineer or designee. Performance will be located at 164th AW Tennessee Air National Guard Base, Memphis, TN. The mailing address is 4593 Swinnea Road, Building 4425/4455, Memphis, TN 38118-7101. The contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government facility/installation is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the work force are essential.
1.4.5.1 Unscheduled gate closures by the Security Forces may occur at any time causing all personnel entering or exiting a closed installation to experience a delay. This cannot be predicted or prevented. Contractors are not compensated for unexpected closures or delays. Vehicles operated by contractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the contractor employee’s installation driving privileges.
1.4.5.2 RESERVED

1.4.5.4 The contractor’s employees shall become familiar with and obey the regulations of the installation; including fire, traffic, safety and security regulations while on the installation. Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All contractor employees shall carry proper identification with them at all times, and shall be subject to such checks as may be deemed necessary. The contractor shall ensure compliance with all regulations and orders of the installation which may affect performance. The Government reserves the right to direct the removal of an employee for misconduct, security reasons, or any overt evidence of communicable disease. Removal of contractor employees for reasons stated above does not relieve the Contractor from responsibility for total performance of this contract.
1.4.6 Security Requirements. The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the COR.
1.4.6.1 Access and General Protection/Security Policy and Procedures. This standard language is for contractor employees with an area of performance within Government controlled installation, facility, or area. The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the Contracting Officer’s Representative (COR). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the local installation’s Security Forces, Director of Emergency Services or local Security Office. The contractor shall ensure compliance with all personal identity verification requirements as directed by DoD, HAF and/or local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.
1.4.6.2 For Contractors that do not require CAC, but require access to a DoD Facility and/or Installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (AFI 10-245, AFI 31-101 and AFMAN 31-113), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
1.4.6.3 Communications Security/Information Technology (COMSEC/IT) Security. All communications with DoD organizations are subject to COMSEC review. All telephone communications networks are continually subject to intercept by unfriendly intelligence organizations. DoD has authorized the military departments to conduct COMSEC monitoring and recording of telephone calls originating from, or terminating at, DoD organizations. Therefore, the contractor is advised that any time contractor personnel place or receive a call they are subject to COMSEC procedures. The contractor shall ensure wide and frequent dissemination of the above information to all employees dealing with DoD information. The contractor shall abide by all Government regulations concerning the authorized use of the Government's computer network, including the restriction against using the network to recruit Government personnel or advertise job openings.
1.4.6.4 Antiterrorism Awareness Level I Training (AT Level I). This standard language is for contractor employees with an area of performance within a USGovernment controlled installation, facility or area. All contractor employees, to include subcontractor employees, requiring access to US Government installations, facilities and controlled access areas shall complete AT Level I training within XX calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. AT Level I may be accomplished by a Level I qualified instructor; completing the Force Protection computer-based training (CBT) course on the Advanced Distributed Learning System (ADLS), or Joint Knowledge Online at http://jko.jten.mil . Tracking for each contractor or subcontractor employee is the responsibility of the COR or unit AT Representative.
1.4.6.5 Advanced Distributed Learning Service (ADLS). All contractor employees and associated sub-contractor employees assigned to work on a government siteand/or requiring access to a DoD network will be required to register with ADLS at commencement of services in order to complete the necessary training required of them initially and annually for the duration of the contract (i.e., DoD IAA CyberAwareness, Protecting Sensitive Information, Force Protection, etc.). 1.4.6.6 OPSEC Training: In accordance with AFI 10-701, Operations Security, OPSEC PMs/SMO/SMNCOs/Coordinators will provide OPSEC training or training materials to contract employees within 90 days of employees’ initial assignment to the contract and annually thereafter. General organizational orientations may need to be supplemented by duty-related orientations in the work center targeted toward specific critical information and vulnerabilities associated with the work. Initial training (OPSE 1301 - OPSEC Fundamentals) and refresher training (Protecting Sensitive Information) are both available on the ADLS website.
1.4.7 Safety Requirements:
1.4.7.1 The contractor is directly responsible for complying with Federal and State OSHA standards for its employees including subcontractors.
1.4.7.2 Contractor shall submit a written Health/Safety Plan and Accident Prevention Plan to the local Contracting Office. The Prime Contractor Superintendent, Project Manager, Foreman shall ensure all employees and subcontractors understand the Health and Safety plans submitted for this project. The contractor shall be familiar with the Health Protection Conditions (HPCON). The HPCONs may increase or decrease rapidly depending upon the local health threat. At the time this PWS was written, the 164 AW was in HPCON ALPHA due to the COVID-19 pandemic. The use of face coverings are required for unvaccinated individuals while indoors. The 164 AW leadership determines the specific policies that will be followed. The Center for Disease Control (CDC) guidance and posture is generally followed at the 164 AW. The 164 AW Commander may adopt additional protective measures as local Health threats and CDC guidance change or are updated. Face Coverings are considered PPE and will not be provided by the Government.
1.4.7.3 RESERVED
1.4.7.4 All work shall follow be performed in accordance with OHSA & DoD Regulations.
If there is a conflict in regulations, the most stringent applies.
1.4.8 Physical Security. The contractor shall safeguard all Government property provided for contractor use. At the close of each work period, Government facilities, equipment and materials shall be secured.
1.4.8.1 Key Control. All references to keys include key cards. The contractor shall establish and implement methods of ensuring that no keys/key cards issued by the Government are lost or misplaced or are used by unauthorized persons. No keys issued by the Government shall be duplicated. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The contractor shall immediately report any occurrences of lost or duplicated keys/key cards to the
COR.
1.4.8.2 In the event keys, other than master keys, are lost or duplicated, the contractor shall, upon direction by the KO, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the Government replaces or re-keys the locks, the Government will deduct the total cost of lock replacement or re-keying from the monthly payment due the contractor. In the event a master key is lost or duplicated, the Government will replace all locks and keys for that system, and will deduct the total cost from the monthly payment due the contractor.
1.4.8.3 The contactor shall prohibit the use of the Government issued keys/key cards by any persons other than the contractor’s employees. The contractor shall prohibit the opening of locked areas by contractor employees to permit entrance of persons other than contactor employees engaged in the performance of services in those areas, or personnel authorized entrance by the KO.
1.4.8.4 Lock Combinations: The contractor shall establish and implement methods of ensuring that no lock combinations are revealed to unauthorized persons. The contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations.
1.4.9 Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the KO in accordance with FAR Subpart 42.5. The KO, COR and other Government personnel, as appropriate, may meet periodically with the contractor to review the contactor’s performance. At these meetings, the KO will apprise the contractor of how the Government views the contractor’s performance and the contractor shall apprise the Government of problems, if any, being experienced. The contractor shall resolve outstanding issues raised by the
Government. Contractor attendance at these meetings shall be at no additional cost to the Government.
1.4.10 Contract Manager (CM): The contactor shall designate a CM who shall ensure performance under this contract. The name of this person, and an alternate who shall act for the contractor when the CM is absent, shall be designated in writing to the KO.
The CM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The CM shall work through the COR, to resolve issues, receive technical instructions, and ensure adequate performance of services. The CM shall ensure that contractor employees do not perform any services outside the scope of the contract without an official modification issued by the KO. The CM shall ensure contractor employees understand that services performed outside the scope of the contract are performed wholly at the expense of the contractor.
1.4.11 Identification of Contractor Employees: All contractor personnel attending meetings, answering Government telephones and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression that they are Government employees. The contractor shall ensure that all documents or reports produced by contractor personnel are suitably marked as contractor products or that contractor participation is appropriately disclosed. The contractor’s status as a “contractor” shall be predominantly displayed in all correspondence types (to include signature blocks on e-mail) and dealings with Government or non-Government entities. Contractor personnel shall wear identification badges distinguishing themselves as such. The badges shall have the company name, employee name and the word “contractor” displayed. The contractor shall retrieve all identification media (including vehicle passes) from its employees who depart employment for any reason. The contractor shall return all identification media (i.e., badges and vehicles passes) to the KO within 14 days of an employee’s departure.
1.4.12. Combating Trafficking in Persons: The United States Government has adopted a zero tolerance policy regarding trafficking in persons. Contractors and contractor employees shall not engage in severe forms of trafficking in persons during the period of performance of the contract; procure commercial sex acts during the period of performance of the contract; or use forced labor in the performance of the contract. The Contractor shall notify its employees of the United States Government’s zero tolerance policy, the actions that will be taken against employees for violations of this policy. The contractor shall take appropriate action, up to and including termination, against employees or subcontractors that violate the US Government policy as described at
FAR 22.17.
1.4.13 RESERVED
1.4.14 Data Rights: The Government has unlimited rights to all documents/materials produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the KO. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.
1.4.15 Organizational Conflicts of Interest (OCI): The contractor and subcontractor personnel performing services under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent OCIs, as defined in FAR Subpart 9.5. The contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO. In the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may impose other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.

2.0 Definitions and Acronyms:
2.1 Definitions:
2.1.1 Contractor: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2 Contracting Officer (KO): A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3 Contracting Officer Representative (COR): An employee of the U.S. Government designated by the KO to monitor contractor performance. Such appointment will be in writing and will state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications.
This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4 Defective Service: A service output that does not meet the standard of performance associated with the PWS.
2.1.5 Deliverable: Anything that can be physically delivered and includes non-manufactured things such as meeting minutes, reports, testing & commission, drawing & schematics.
2.1.6 Key Personnel: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7 Physical Security: Actions that prevent the loss or damage of Government property.
2.1.8 Quality Assurance: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9 Quality Assurance Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.10 Quality Control: All necessary measures taken by the Contractor to ensure that the quality of an end product or service shall meet contract requirements.
2.1.11 Subcontractor: One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

3.0 Government Furnished Property, Material, Equipment and Services (GFP/M/E/S):

3.5 Utilities: All utilities in the facility will be available for the contactor’s use in the performance of this contract. The contractor shall instruct employees in utilities conservation practices. The contractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.
4.0 Contractor Furnished Property, Materials, and Equipment (CFP/M/E):
4.1 General: Except for those items specifically stated to be Government-Furnished in Paragraph 3.0, the contractor shall furnish everything required to perform these services as indicated in Paragraph 1.1.
4.2 The specification hierarchy is the collection of technical specifications to be used for all projects. The hierarchy is listed in the order of precedence (i.e. “A” supersedes “B”, “B” supersedes “C”, etc.). Any conflict in specifications shall be resolved by following the more stringent requirement. The local approving authority is the 164 Base Civil Engineer. The hierarchy is as follows:
A. Any Specifications/Installation guidance by the Manufacturer
B. Federal Specifications (i.e. United Facilities Criteria, DoD, ANG, or
FAA)
C. MATOC Default Specifications
5.0 Construction Performance Requirements
5.1 The contractor shall: perform work as specified in Solicitation, Contract, Performance Work Statement (PWS), Specifications, and Drawings. Performance shall achieve an acceptable quality level of ninety-eight (98) percent. Final cleanup of each phased work area is required before moving to the next area. Work to include but is not limited to:
5.1.1 CLIN 0001: Install a Cummins (or approved equal) 400 kW emergency diesel backup generator at Building 4425/4455 in accordance with Pickering design plans (SBC NO. 361/10601-2020) (PFI NO. 25979.00) adhering to NFPA standards, UFC 3- 600-01, UFC 3-540-01. (Name brands are for quality assurance, not for sole source).

5.2.3 Progress Schedules: Required for all construction projects with a performance period of 30 days or longer. Project Schedules must be approved by the government and mandatory for projects in the aircraft hangar complex.
5.2.3.1 Contractor's proposed schedule (AF Form 3064 or detailed progress chart), prepared by the Contractor and submitted through the Base Civil Engineer/Facilities Management (BCE/FMO) to the Contracting Officer, must be accomplished within ten (10) days after award. The Progress Schedule shall indicate the order in which the Contractor proposes to perform the work, the date which work will begin, and the date of anticipated completion. The schedule must continue through the entire contract period, even if earlier completion is anticipated.
5.2.3.2 The schedule shall begin in the form of a Progress Chart of suitable scale to indicate appropriately the percentage of work scheduled for completion at any time.
5.2.3.3 In the event of differing site conditions, change in specifications, additional work, etc., which would require a time extension in excess of 60 calendar days, a revised schedule is to be prepared. The revised schedule will reflect work completed up to the date of revision, the percentages adjusted accordingly, and performance time extended to the new completion date established by a Modification (MOD) to the contract as a result of the change.
5.2.3.4 The initial and revised schedules will include time for a final inspection and correction of any punch list items, which might be discovered during the final inspection.
5.2.3.5 AF Form 3064, Contract Progress Schedule and AF Form 3065, Contract Progress Report, will be used to satisfy the requirements of FAR 52.236 15, "Schedules for Construction Contracts". The Contractor's proposed progress schedule shall be submitted in a minimum of three hard copies and one electronic copy. After review by the BCE/FMO, and approval by the Contracting officer, distribution will be made as follows:
5.2.3.6 Original copies will be maintained within the Contracting office.
5.2.3.7 Signed copy maintained by the BCE/FMO.
5.2.3.8 Signed copy maintained by the Contractor.
5.2.3.9 Instructions concerning the use of the AF Form 3064, Contract Progress
Schedule, are on the reverse of the form. Additional instructions are as follows:
5.2.3.10 Block 2 will be the actual date that the contract performance period begins as determined by receipt of the Notice to Proceed.
5.2.3.11 Block 3 will be the completion date established by the contract terms.
5.2.3.12 Block 6 will be the date Contractor physically starts work under the contract.
5.2.3.13 Block 7 Self-explanatory (cannot be completed until work is completed).
5.2.3.14 Column B "Work Elements" must be in sufficient detail to identify all elements of work required to complete the project. Work elements must be limited to those tasks, which indicate progress and which can be readily identified and measured by the Government inspector. These elements of work shall correspond with the elements of work shown on the AF Form 3065, Contract Progress Report. Some contracts will require supplies /services with very long lead times. While this delivery time is included in the construction period, it can have an impact on the performance. Long lead time is relative to available performance period and the critical path of work.
5.2.3.15 Dates entered above columns D through Q will be the ending date for the period covered by each column. Each column will represent the performance period covered by each AF Form 3065, Contract Progress Report. Since AF Form 3065's are required semimonthly, these dates will be the 15th or the last day of the month.
5.2.3.16 The top half of the space under each column will be used by the Contractor to show the percentage of each work element that will be accomplished during that period. The percentage contained in Column D through Q for each work element must equal the percentage in Column C.
Each column will be totaled and the total entered in the top half of line 16.
The totals of Column D through Q on line 16 must equal 100%.
5.2.3.17 Starting on line number 16, on the extreme right hand side of the form, number upward from 0 to 100 as follows: line 15 in "0", line 14 is "10", line 13 is "20", etc.
5.2.3.18 Beginning at the lower left corner of line 15, column D, the Contractor will graph his proposed progress, using a broken line.
5.2.4 Maintenance Plan: Contractor will submit a maintenance plan as specified. The contractor will perform daily area cleanup at all equipment upgrade/installation locations until completion of work at each site. The contractor will remove all excess debris (boxes, wrapping, cables, etc.) and return facilities to previous condition once all upgrade/install actions are complete. The contractor will repair and/or replace all facilities and/or equipment damaged by the contractor or their subcontractors and warranty said facilities and/or equipment for the specified warranty period of new equipment of like kind, no less than one year. All affected areas will be restored to their original condition. Contractor will submit a maintenance plan for the equipment and address interconnection of equipment due to heat, moisture, and routine maintenance as it applies and the maintenance required for equipment items. The contractor will furnish the manufacturer, model number, and date of calibration for all equipment used installed, repaired, or updated by contractor.
5.2.5 Documentation: Contractor will provide accurate, complete documentation for this contract 99% of time. In the event of errors, the contractor will provide corrections timely.
