Performance Work Statement FY2024

Title: Replace Fence at CPER site, located at Nunn, Colorado.

1. Background:

The Agriculture Research Service (ARS) is the chief in-house agency of the United State Department of Agriculture (USDA) located on Colorado State University (CSU) campus. The USDA ARS Central Plains Research Station is located at 58009 Weld County Road 37, Nunn, CO 80648. Facility department is responsible for providing an adequate and safe work environment supporting cattle research.

The mission of the Central Great Plains Resources Management Research Unit located at Nunn, Colorado is to enhance the economic and environmental well-being of cattle in limited dry land farming. The emphasis is on efficient use of Pastureland supporting livestock operations, and soil conservation/preservation.

A fence around sections of land is critical for the protection of the equipment from animals. The existing fence cannot effectively keep animals in or out due to age of gates and fencing no longer being properly braced.

2. Objective:

2.1. The intention of this solicitation is to remove and replace fence around various sections of land plots in the area. This will include the disposal, removal and new installation of new fence, posts, and concrete.

2.2. This contract is to ensure real property, research material, equipment associated with the current sections to protect cattle in the area.

3. Scope:

3.1 Approximately 18,480 feet (3.5 miles) of new 4-wire, wood post fence shall be installed at the USDA- Agricultural Research Service (USDA-ARS) Central Plains Experimental Range, one mile north of the intersection of Highway 85 and Weld County Road 114 Nunn, CO. There are four (4) segments of new fence to be installed, see attached files for fence map locations and specifics for each fence segment:

3.2. Wooden line posts, t-posts, and wire (both barbed and barbless) will be provided by the USDA-ARS. All other materials (including, but not limited to stapes and steel pipe H-braces (see specs below), and installation will be provided by the contractor. Removal of existing fence shall be done by the USDA ARS personnel.

3.3. The contractor shall install seven (7) 2 post-H-braces (terminal), eleven (11) single in-line ¼ mile posts, and approximately four (4) dead men.

3.4. For terminal 2 post H-braces (7 of these), both the primary and secondary corner posts in each of these braces will be 2 7/8 inch outside diameter (OD) steel posts with length of 10 feet (120 inches). These posts will be pounded into the ground a minimum of 60 inches, thereby leaving 60 inches aboveground. H brace posts

(minimum 2 7/8-inch OD and minimum length of 120 inches (or 10 feet)) will be connected by a steel pipe sleeve

(3 ½ inch OD and length 10 inches) and bolt (minimum ½ inch bolt). See pictures at end of attached file.

3.5. Single in-line ¼ mile posts (11 of these) will be a 2 7/8-inch OD post with length of 10 feet (120 inches).

These posts will be pounded into the ground a minimum of 60 inches, thereby leaving 60 inches aboveground.

3.6. Line posts will be wood (minimum 4-inch diameter at top, pointed/capped/round and doweled, with a length of 7 feet (or 84 inches). Line posts will be installed every rod (16 feet), to a minimum depth of 28 inches, thereby leaving approximately 56 inches aboveground. Posts will not be hammered in – all holes for posts must be either mechanically augured or dug.

3.7. Four strands of fence wire will be as follows, top 3 strands barbed wire (12 ½ gauge, Class I, 2pt, 4 inches spacing) and the 4th (bottom) strand being smooth (barbless) wire (12 ½ gauge, Class I). Each roll of barbed/barbless wire is approximately 1,320 feet (1/4 mile) in length. The smooth wire will be attached to wood line posts by barbed, galvanized staples (minimum length of 2 inches) at a minimum height of 16 inches from the ground. The 3 top strands of barbed wire will be attached to wood line posts with barbed, galvanized staples

(minimum length of 2 inches) at heights of approximately 28”, 40” and 52” (inches) from the ground.

3.8. All sixteen-foot tubular steel and wire gates will be provided by the USDA-ARS and installed by USDA-

ARS personnel.

5. Recognized Holidays:

5.1. Holidays to be observed are as follows. When scheduled services fall on an observed federal holiday contractor shall perform services on next business day.

5.2. HOURS OF OPERATION: The contractor is responsible for conducting business between the hours of 0730 to 1600 hours Monday through Friday, except Federal holidays or when the Government facility is closed due to local, national emergencies, administrative closings, or similar Government directed facility closings. Contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor is responsible for an adequate workforce for uninterrupted performance of all tasks.

5.3. Campus closures. When an unforeseen port closure occurs on a regularly scheduled day of work, the

Government shall have the following options:

5.3.1 Reschedule the work to be performed the following workday.

5.3.2 Reschedule the work on any day mutually satisfactory to both the contractor and Contracting Officer or his/her designated representative.

6. Delivery:

6.1. Materials Inspections are performed upon receipt of the first delivery of any given building product.

The QC representative(s) will make a physical examination of the materials to ensure they have been properly stored. This will be documented in the QC Daily Report by utilizing the Material Receiving Record. Additionally, the QC Representative(s) will periodically inspect additional material deliveries to ensure that materials continue to conform to the contract documents and are properly stored.

6.2. A laydown area for material related to this project will be coordinated with local staff.

7. Government Furnished Property (GFP):

SUPPLIES AND MATERIALS FURNISHED BY THE CONTRACTOR: The government will supply wooden posts. It is the responsibility of the contractor to furnish or supply all equipment, material, safety equipment, and material related to project. No government equipment, tools, labor, or material are to be supplied by government personnel or agency.

Contractor is responsible for removal of any/ all material and debris from site locations fence being replaced.

8. Responsibilities:

8.1 SUPERVISION OF EMPLOYEES. Contractor shall provide for supervision of employees. Prior to commencement of services under this contract, the Contractor shall furnish to the COR a list of employees who will work on-site performing the services, and the name of the individual who will be responsible for supervision of such employees and who will function as the Project Manager. The Project Manager shall:

8.1.1 Have the Contractor’s full authority to act on matters pertaining to the performance of services.

8.1.2. Be on-site or on-call whenever work is being performed.

8.1.3. Report damage to Government property, loss of keys, personal injuries and/or hazardous conditions to the COR within twelve work hours after occurrence.

8.1.4. All work shall be performed in a skillful manner. The COR may require the Contractor to remove from work any employee the COR deems incompetent, careless, or otherwise objectionable.

8.1.5. The Contractor shall supply PPE such as gloves, goggles, and face masks, hearing protection, hard hats, steel toe boots, etc. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer Representative (COR).

8.2 PROPERTY. Except for reasonable wear and tear, the Contractor assumes full responsibility for and shall indemnify the Government for any and all loss or damage of whatsoever kind and nature to any and all Government property including any equipment, supplies, accessories, or parts furnished while in the Contractor’s custody and care for storage, repairs or services to be performed under the terms of this Contract, resulting in whole or in part from the negligent acts or omissions of Contractor, and subcontractor, or any employee, agent or representative of Contractor or subcontractor.

8.3 PERSONS. The Contractor will be responsible for any negligent or wrongful acts or omissions of the Contractor, his employees or agent’s incident to the performance of this contract. The Contractor will hold and save the Government harmless from all liability for any death or damage to all persons (other than the liability of the contract as provided under the Federal Employees Compensation Act) or to real or personal property, which results from the operation of, or incident to, equipment furnished by the Contractor. The Contractor will not be responsible for any negligent or wrongful acts or omissions of the U.S. Department of Agriculture; its employees, the U.S. Department of Agriculture’s Cooperators, or their employees.

8.4 LIABILITY INSURANCE. The Contractor shall maintain such insurance as will protect him/her from claims under Workmen’s Compensation, General Liability, Property Damage and from any other claims for damages for personal injury including death which may arise from operations under this Contract, whether such operation by himself or by any subcontractor or anyone directly or indirectly employed by either of them.

9. Security Considerations:

9.1. SECURITY: Only authorized Agricultural Research Service, Agricultural Research Service Cooperator employees, the Contractor and Contractor’s employees shall be allowed in the building during performance of this contract. The Contractor will close any open windows, turn off lights (except those left on for security), and lock designated interior and all exterior doors. The building is considered closed for business from 4:30pm to 7:30am daily, all weekend hours, and Federal Holidays.

9.2. SECURITY CLEARANCES: Upon contract award, all contractor personnel who will be working in the building will be required to complete a background investigation. Upon clearance, contractor personnel will work with the designated USDA, Agricultural Research Services employees to obtain a Linc Pass, which will serve as a permanent ID and authorize building access after normal business hours.

9.3. CONDUCT OF CONTRACTOR AND EMPLOYEES: All federal government facilities are considered smoke and drug free. Contractor personnel shall not smoke in the building or areas except for designated areas. Contractor personnel shall comply with the installation traffic laws and other regulations and instructions pertaining to conduct of persons on Government facilities.

9.4. Contractor shall place his/her employees on notice that infraction of any of the above rules, regulations or prohibitions may be grounds for removal from Federal Property.

10. Inspections

10.1 Definition: “Services” includes services performed, workmanship and materials furnished or utilized in the performance of services.

10.2. The COR will review the performance of services and receive complaints related to non-performance. The COR, or other designated representative, will make random inspections of parts of the building where services are to be performed. Inspections will not interfere with or delay the Contractor’s work.

11. Deficiencies

If any service performed does not conform to the contract, the Government may require the Contractor to perform the services again to conform to requirements, at no increase to the contract amount. When defects in performances cannot be corrected by re-performance, ARS may (1) require the Contractor to take necessary action to ensure that future performance conforms to requirements, and (2) terminate the contract for default.

12. Payments

Payments shall be made monthly, in arrears, upon electronic submission of invoices to the Invoice Processing Platform (IPP).

13. Travel: Not applicable for this contract.

14. Special Material Requirements: Not applicable for this contract.

15. Other Unique Requirements and Considerations:

Due to precautions relate Covid-19 pandemic, the contractor will be responsible for supplying material to ensure the safety of the contractor’s employees and subcontractors working on Federal facilities. All personnel are required to wear these items while working on site. The Contractor shall supply PPE such as nitrite gloves, goggles, and face masks.

16. Place of Performance:

The work to be performed under this contract will be performed at the Nunn location.

17. Period of Performance:

The period of performance shall start approximately 30 days after Contract award for the fence installation. The period of work will be 120 days. Contract Officer will make determination if additional time will be needed for long lead time relating to the purchase of equipment.
