PERFORMANCE WORK STATEMENT (PWS)

LED ONE-FOR-ONE FIXTURE REPLACEMENT W/PHOTOMETRICS

at LITTLE ROCK AFB, AR 72099

SECTION I

1.0 Description of Services/Introduction: The contractor shall provide all qualified personnel, transportation, lifts, tools, equipment, materials and services required to accomplish LED One-For-One Fixture Replacement w/Photometrics on Little Rock AFB, AR 72099. The contractor shall accomplish all services below to meet the requirements of this Performance Work Statement (PWS). The contractor is to replace existing light fixtures as defined in each delivery order on a one-for-one basis, retaining light fixture locations, requiring no electric circuit modifications other than occasional light switch/control. Light level shall be in accordance with IESNA, UFC and LRAFB electrical design guide requirements, validated by photometric layouts and post-installation light level checks. Work shall be in compliance with all Federal, State and local regulations, codes and contractor must hold a commercial State of Arkansas Electrical License to meet requirements. Work shall be accomplished within 60 days of material arrival per delivery order. Estimated delivery date of material is required to be sent to the CO and Contracting Officer Representative (COR) within 15 days of delivery order award.

1.1 Objectives: This Performance Work Statement (PWS) describes the services required to replace LED one-for-one fixtures with Photometrics. These services include:

· Replace facility lighting on a one-for-one basis, validated by photometrics and post-installation light level readings.

· Replace light switches, occupancy sensors, photocells, lighting contactors, conduit and conductors as required/defined in individual delivery orders

1.2 Benefit to United States Air Force (USAF): This acquisition will benefit the United States Air Force (USAF) by optimizing lighting design for efficiency, ensuring consistent light levels, and identifying potential issues before installation, ultimately leading to cost savings and improved visual comfort.

1.3 Background: Facilities exist on Little Rock AFB that utilize non-LED lighting technology. In an effort to improve lighting levels, efficiency and reliability, a service contract is needed to replace existing lighting in existing layout configurations with new LED light fixtures in the existing layout configurations.

1.4 Inherently Governmental Function. The contractor shall not perform inherently governmental functions as defined in FAR Subpart 7.5 in relationship to this PWS.

1.5 Type of Contract: The government will award a Firm Fixed Price Indefinite delivery/indefinite quantity (IDIQ)

1.6 Period of Performance. This is a four-year contract with 1 basic year and three (3) option years.

1.7 Place of Performance: The contractor shall perform the services in the PWS at Little Rock Air Force Base, AR.

1.8 Deliverables. See Table 3 in Section V.

1.9 Data. The government has unlimited rights to all deliverables of this contract.

1.10 Inspection. Not Used

SECTION II

2.0 Services Summary

2.1 General

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success but do not represent all contract performance requirements. All contract performance requirements in this PWS will be monitored.

2.2 Performance Evaluation

Performance of a service shall be evaluated to determine whether or not it meets the performance requirements of this contract. Re-performance of unacceptable services at no additional cost is the preferred course of action when appropriate. In the case of issued Corrective Action Reports (CARs), the Contracting Officer shall take appropriate measures according to inspection of services clause in the contract, i.e., FAR 52.246-4, 52.246-5, or 52.212-4(a). Corrective Action Reports may categorize nonconformance as minor, major or critical IAW the following FAR 46.101 definitions:

“Minor nonconformance” means a nonconformance that is not likely to materially reduce the usability of the supplies or services for their intended purpose or is a departure from established standards having little bearing on the effective use or operation of the supplies or services.

“Major nonconformance” means a nonconformance, other than critical, that is likely to result in failure of the supplies or services, or to materially reduce the usability of the supplies or services for their intended purpose.

“Critical nonconformance” means a nonconformance that is likely to result in hazardous or unsafe conditions for individuals using, maintaining, or depending upon the supplies or services; or is likely to prevent performance of a vital agency mission.

SS1. The contractor shall provide installation of lighting systems that meet the requirements of IESNA using only current installed fixture locations

The post installation light levels shall be tested and must be within 10% of IESNA required light levels

2.3 Government Quality Assurance. The government shall inspect and evaluate the contractors’ performance to ensure services are received in accordance with requirements set forth in this contract. The COR will use the contractor’s work schedule, or modified version thereof, to record validation results. Results of the validation then becomes the official Air Force record of the contractor’s performance. Government surveillance of tasks not listed in the PWS or by methods other than those listed in the PWS (such as provided for by the Inspection of Services clause) may occur during the performance period of this contract. Such surveillance will be done according to standard inspection procedures or other contract provisions. Any action taken by the CO as a result of surveillance will be according to the terms of this contract.

2.3.1 The government will periodically evaluate the contractor’s performance in accordance with the Quality Assurance Surveillance Plan (QASP). The government may inspect each task as completed and increase the number of quality assurance inspections if deemed appropriate because of repeated failures discovered during surveillance inspections or because of repeated customer complaints. Likewise, the government may decrease the number of quality assurance inspections if performance dictates.

2.3.2. When an observation indicates defective contractor performance, the COR will require the contractor’s Contract Manager or representative at the site to initial the observation. The formal process is, when a performance threshold has not been met or contractor performance has not been accomplished, the COR will initiate and provide the CO a Corrective Action Report (CAR) for issuance to the contactor. The contractor shall respond to the CAR IAW instructions provided and in the CAR. While the formal process of this paragraph to address unacceptable contractor performance is always available, the Government reserves the right to initiate a less formal process involving the contractor, the COR and the CO meeting together at no additional cost to the Government regarding unacceptable contractor performance.

2.4 Performance Assessment.

2.4.1 Periodic Surveillance. This method requires the COR to employ a “spot check” style of evaluation based on the contractor’s services. Periodic surveillance will be conducted on a scheduled basis (daily, weekly, monthly, quarterly, semi-annual or annually) and may be adjusted, based on quality trends.

2.4.2 Customer Complaints. The COR will receive and investigate all complaints. The COR will be responsible for validating customer complaints. The CO shall make final determination of the validity of customer complaint(s) in cases of disagreement with the COR and the contractor. Validated customer complaints shall be reperformed, if possible, within 3 business days of notification at no additional cost to the Government IAW the inspection clause of the contract and the direction of the Contracting Officer.

2.4.3 Review of Audits. COR reviews result of the contractor’s accepted quality management system audits and related quality metrics.

2.4.4 100 Percent Inspection. This method requires the COR to do 100 percent inspection on all task performed. Appropriate for tasks that occur infrequently. Usually only deals with Safety and/or Security, unless mandated by an Air Force Instruction (AFI) or industry standard.

2.5 Quarterly Progress Meetings. The CO, Government’s Program Manager (PM), / Services Acquisition Leader (SAL), COR, other government personnel as appropriate, and the contractor shall meet quarterly to discuss the contractor’s performance.

The following issues, at a minimum, shall be discussed:

· Opportunities to improve the contract,

· Any modifications required of the contract,

· Unsatisfactory inspections,

· Valid customer complaints against each performance objective observed, and

· Steps taken by the contractor to prevent occurrences in the future.

The contractor shall provide a summation of unsatisfactory inspections and customer complaints and provide insight into any identified trends.

2.5.1 The minutes of these meetings will be reduced to writing, signed by the CO and any other signatures as deemed appropriate, distributed to the functional area and the contractor. Should the contractor not concur with the minutes, the contractor will provide a written notification within 5 working days to the CO identifying areas of non-concurrence for resolution.

2.6 Contracting Officer Representative (COR). CORs are representatives of the CO and will participate in the administration of this contract. After award of the contract, the contractor will be provided a letter identifying the COR and setting forth their duties and authorities. The COR is not authorized to change any of the terms and conditions of the contract/task order.

2.6.1 Acquisition Team Meetings. The contractor’s Contact Specialist (CS) with the CO, COR, and other government personnel constitute an acquisition team [See FAR 1.102 (c)] and shall meet on a regular basis. The Acquisition Team will establish how often meetings are needed based on contract complexity. As a subset of the Acquisition Team, Government members of the Acquisition Team are often referred to as the Multi-Functional Team (MFT) and may meet as determined by the MFT. The contractor may request a meeting with the CO when the contractor believes such a meeting is necessary. If the CO or CS deems necessary, written minutes of any such meetings shall be recorded by the CS in the contract file and signed by the PM and the CO or CS. If the contractor does not concur with any portion of the minutes, such nonoccurrence shall be provided in writing to the CO within 10 calendar days following receipt of the minutes.

2.8. Contractor’s Performance: The Government assesses a contractor’s performance on an ongoing basis, both positive and negative, and provides a record on a given contract during a specified period of time.

2.8.1 Past Performance Information (PPI): PPI can be provided to other government agencies as requested.

2.8.2 Contractor Performance Assessment Report (CPARS). Depending on the estimated value of the contract, formal assessment and reporting of contractor performance is required and is documented using the CPARS system. An assessment usually provided on an annual basis is sent to the contractor’s representative for their comment. The contractor will have up to 60 days to review and comment on the assessment.

SECTION III

3.0 GOVERNMENT FURNISHED PROPERTY AND SERVICES

3.1. Government Furnished Services (Base Support). The government will provide:

3.1.1 Utilities. The government will provide all electricity, water and sewage when available and appropriate at no additional cost to the contractor. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish requirements under this PWS.

3.2 Government Facilities. Not Used.

3.3 Government Furnished Property (to include equipment and material). The government will provide existing drawings as availability permits.

3.3.1 Government Furnished Property (GFP). The contractor shall conduct an inventory of all GFP listed above during the phase-in transition period. The contractor shall sign receipt for all equipment provided by the government. The contractor shall determine and certify the working order and condition of all equipment. Items of equipment missing or not in working order shall be recorded. If the contractor does not elect to participate in the inventory within the timeframe listed above, the contractor must accept as accurate, the listing and stated condition of equipment provided by the government. If the contractor participates in the inventory but does not agree with the government representative's determination as to the working order of the equipment, the equipment will be turned in as excess or the matter will be turned over to the CO for resolution. The contractor shall designate a property custodian throughout the life of the contract to receipt and account for all GFP. By completion or extension of each yearly option of the contract, an inventory of GFP shall be conducted by the contractor and an audit performed by the government Property Administrator (PA). All equipment in need of repairs/maintenance shall be repaired/maintained by the government, depending on contract type and clauses elected for use in contract (i.e. 52.245-2(a) “as-is, where-is” condition) or unless the damage was caused by willful negligence of contractor.

3.4 Contractor Furnished Property and Services. Except for those items or services specifically stated to be government-furnished in Section III and any appendixes, the contractor shall furnish everything required to perform this contract in accordance with all of its terms. The following mentioned requirements are not all inclusive of the contractor furnished items and services required in the performance of this contract.

3.4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

3.4.2 Materials: The Contractor shall furnish materials, supplies, and equipment necessary to meet the requirements under this PWS.

3.4.3 Equipment: The Contractor shall furnish tractors, lighting and sound, containers, etc. to meet the requirements under this PWS.

SECTION IV

4.0 GENERAL INFORMATION

4.1. General Services: This is a non-personal services contract to provide LED One-For-One Fixture Replacement w/Photometrics. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the contractor feels that any actions constitute, or are perceived to constitute personal services, it shall be the contractor’s responsibility to notify the Contracting Officer (CO) immediately. These services shall not be used to perform work of a policy/decision making or management nature, (e.g., inherently governmental functions). All decisions relative to programs supported by the contractor shall be the sole responsibility of the Government.

4.2 General Scope: This contract is for multiple year/multiple facility lighting replacement on a one-for-one basis, validated by photometrics. Information on the facility shall be given with the issue of delivery order. The contractor shall accomplish all work in accordance with all regulations regarding the installation of commercial, residential and industrial lighting, including but not limited to the latest version of the National Electric Code (NEC), Unified Facilities Criteria 3-530-01 and the Illuminating Engineering Society of North America. If a crane is required for any of the installation of the equipment by Federal Law an airfield waiver must be accomplished and signed off by the FAA. This takes a minimum of 60 days to complete and will delay work till completed.

4.2.1 General Scope of Services include but not limited to:

4.2.1.1 Pre-Install Requirements: Before services are commenced, the contractor shall inspect the work site and ascertain all information for the diligent performance of the service(s). The contractor shall notify the ordering agency of any conditions that prevent the suitable completion of these services to include operations that could endanger Government personnel or property and require appropriate abatement action. If the contractor discovers problems associated with the work after starting, he or she shall immediately notify the Contracting Officer (CO) for their approval if the work is to continue. Coordinate with the Government designated representative to have utilities/fire alarms etc.…turned on or off during the competition of the task.

4.2.1.2 Disposal of waste: All waste disposals are the responsibility of the contractor to include any fees or permits. Recycling containers will be provided for the operation. Coordinate through your government representative or Contracting Officer Representative (COR). All florescent light bulbs shall be treated as hazardous material, packaged and disposed of in accordance with existing regulations for disposal.

4.2.1.3 The contractor shall replace existing facility lighting fixtures with new LED lighting fixtures on a one-for-one basis, with lumen performance validated via photometrics provided by the contractor. The contractor shall also replace light switches, occupancy sensors, photocells, lighting contactors, conduit and conductors as required/defined in individual delivery orders.

4.3 General Information

4.3.1 Continuation of Mission-Essential Services During a Crisis: The Functional Commander/Director has determined these services are not mission-essential and will not continue in the event of a crisis.

4.3.2.1 Holidays and Facility Closings: Contractor/subcontractor personnel shall observe holidays and facility closings as authorized for government personnel. Contractor/subcontractor personnel shall only be permitted access to Government facilities when Government personnel are present.

4.4 Security Requirements

4.4.1 Security Regulations: The Contractor shall ensure personnel, information, system, property, facility and, if applicable, international security requirements are met. The Contractor shall ensure contractor/subcontractor personnel who perform work on a Government facility comply with the security requirements of the facility.

4.4.2 Operations Security (OPSEC): The purpose of OPSEC is to reduce the vulnerability of USAF missions to adversary collection and exploitation of critical information. DoDD 5205.02E and DoD Manual 5205.02-M require contractors supporting DoD activities use OPSEC to protect critical information for specified contracts, subcontracts, and information used in the performance of duties in support of Air Force requirements/missions. The Contractor shall ensure Contractor personnel who perform work on (or in) a Government facility comply with the OPSEC procedures and training requirements of the facility as specified in AFI 10-701.

4.4.3 Vehicle Requirements: Contractor personnel and vehicles must possess appropriate passes. These passes shall be obtained from Installation Security Forces Pass and ID at the Vehicle Inspection Center.

4.4.4 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

4.4.5 Trafficking in Persons: The Contractor shall comply in accordance with the FAR and applicable supplements and shall be in compliance with all applicable guidance and clauses listed in the contract as it relates to Trafficking in Persons. 4.4.6 Service contracts shall require contractor employees to identify themselves as contractor personnel by introducing themselves or being introduced as contractor personnel and displaying distinguishing badges or other visible identification for meetings with government personnel. In addition, contracts shall require contractor personnel to appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence.

4.5. Access to Government Facility or Military Installation: The Contractor shall ensure contractor/subcontractor personnel who require access to a Government facility or military installation comply with the security requirements of the facility or installation.

4.5.1 Identification (ID) Card/Badge

4.5.1.1 The Contractor shall ensure an ID card is obtained by all contractor/subcontractor personnel who require recurring access to a Government facility, but not local area network (LAN) access. The Contractor shall submit a letter to the CO listing all contractor/subcontractor personnel requiring access to the facility. The CO will approve the request and forward it to the issuing/registration office for processing. Contractor/subcontractor personnel shall report to the issuing/registration office to obtain the ID card(s).

4.5.1.2 The Contractor shall submit a letter to the CO immediately if contractor/subcontractor personnel no longer require access, upon transfer/termination of contractor/subcontractor personnel or upon completion/termination of the contract/order. The letter shall identify the name(s) and social security number(s) of the contractor/subcontractor personnel. The Contractor shall return the ID card(s) to the issuing/registration office upon expiration, upon transfer/termination of contractor/subcontractor personnel, or once contractor/subcontractor personnel no longer require access to the facility. The Contractor shall return any and all ID cards to the issuing/registration office upon completion/termination of the contract

4.6 Hours of Operation: The contractor is responsible for conducting business, between the hours of 7:30 am and 4:30 pm Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential. Work scheduled but not accomplished because of base closure due to weather, exercises, or actual alert, will be accomplished as soon as possible after reopening the base.

4.7 Special Qualifications: The contractor is responsible for ensuring all employees work is supervised by a journeyman electrician.

4.8 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

4.9 Inspection of Services: In accordance with the Inspection of Supply/Services clause(s) identified in the contract/order, the Government reserves the right to inspect Contractor performance.

4.9.1 Quality Assurance: The Government shall inspect and evaluate the Contractor’s performance to ensure services are received IAW requirements set forth in this contract. The COR will periodically inspect by watching actual task performance, physically checking an attribute of the completed task, checking a management information report, investigating customer complaints, conferring with facility managers, or otherwise inspecting the task or its results to determine whether or not the performance meets the standards contained in this PWS. The COR will use the Contractor’s work schedule to record surveillance results. This surveillance record then becomes the official Air Force record of the Contractor’s performance. When a performance threshold has not been met or Contractor performance has not been accomplished, the COR will initiate and provide the CO a Corrective Action Report (CAR), who will then issue the CAR to the Contractor. The Contractor shall respond to the CAR, IAW instructions provided and return it to the CO NLT ten calendar days of receipt.

4.9.2 Contracting Officer Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

4.10 Key Personnel: The follow personnel are considered key personnel by the government: contract manager/alternate contract manager, lighting design technician and journeyman electrician. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 7:30 a.m. to 4:30 p.m, Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons.

4.10.1 Qualifications for all key personnel are listed below:

· Contract Manager and Alternate must have 24 semester hours in mathematical, engineering, and/or quantitative analysis courses; 15 or more years cost analysis experience; and familiarity with Defense Department Data Sources (e.g. cost and software data reporting, EVM).

· Lighting design technician must have one year of experience performing lighting photometrics using computer-based lighting design software.

· Journeyman electrician must have five years electrician experience and hold a journeyman’s electrician’s license.

4.11 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

4.12 Organizational Conflict of Interest (OCI): Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may put into effect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

4.13 Safety and Regulatory Requirements: The Contractor is subject to all installation fire, safety, security, and traffic regulations.

4.13.1 The Government contracts on the understanding that the Contractor is complying with applicable laws concerning workplace safety.

4.13.2 The Contractor is subject to all citations and penalties for violation of applicable workplace safety laws. The burden of compliance rests with the Contractor. Enforcement of workplace safety laws is the responsibility of the agency specified in the applicable law.

4.13.3 The Contracting Officer may notify the Contractor of hazards in Contractor operations that endanger Government personnel or property and require appropriate action. This provision does not constitute assumption of liability for Occupational Safety and Health compliance on the part of the Government or negate other agency responsibility for enforcement of applicable laws.

14.13.4 Accident prevention principles must be thoroughly integrated into all operations. Unsafe conditions and practices, as identified by the designated representative, must be corrected immediately.

4.13.5 Contractor Employees: While on the installation, the contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the Contracting Officer as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the organization or by wearing appropriate badges containing the organization's name and the employee's name. Contractor personnel must wear issued base identification cards at all times while on the installation.

4.14 Warranty: Contractor shall guarantee all material, workmanship and labor from defects for a period of 5 years from the date of acceptance of the work. A warranty letter detailing the work accomplished per facility is required to be furnished to the government representative upon acceptance of the work.

4.16 Definitions and Acronyms:

DEFINITIONS:

CONTRACTOR: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

CONTRACTING OFFICER(CO): A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

CONTRACTING OFFICER'S REPRESENTATIVE (COR): An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

DEFECTIVE SERVICE: A service output that does not meet the standard of performance associated with the Performance Work Statement.

DELIVERABLE: Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

KEY PERSONNEL: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

PHYSICAL SECURITY: Actions that prevent the loss or damage of Government property.

QUALITY ASSURANCE: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

QUALITY ASSURANCE SURVELLANCE PLAN (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

QUALITY CONTROL: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

SUBCONTRACTOR: One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

WORKDAY: The number of hours per day the Contractor provides services in accordance with the contract.

WORK WEEK: Monday through Friday, unless specified otherwise.
