PERFORMANCE WORK STATEMENT
FOR LEASING AND MAINTENANCE OF
PORTABLE CHEMICAL LATRINES
JOINT BASE SAN ANTONIO, TEXAS
21 March 2022
1. DESCRIPTION OF SERVICES. The contractor shall provide all labor, tools, materials, equipment, transportation, and storage to provide and maintain leased portable chemical latrines, hand wash stations and stand-alone hand sanitizer dispensers to the Government at Joint Base San Antonio(JBSA), Texas including Lackland, Lackland Training Annex, Wilford Hall Ambulatory Surgical Center (WHASC), Kelly Field Annex, Fort Sam Houston, Camp Bullis, Randolph, Seguin Air Field and Canyon Lake Military Recreational Areas. The contractor is responsible for set up and removal of all equipment. The number of units and service frequencies for each location are provided within this Performance Work Station (PWS) para 5.0 Technical Exhibit; individual installation location maps will be provided at the post-award meeting. All portable chemical latrines shall have a lease price which includes servicing as defined by this PWS and the technical exhibits.
1.1. Portable Chemical Latrines. All portable chemical latrines shall be beige or tan. Portable chemical latrines provided shall be clean, in excellent condition, free of defects, and without graffiti. Contractor shall submit a sample of the portable chemical latrine, to include color scheme, to the Government for approval prior to the placement of units (picture/e-mail is sufficient). Units shall be waterproof, fiberglass or polyethylene construction, with a minimum holding tank capacity of fifty gallons, single seat capacity with one urinal, and tight-fitting, self-closing doors that contain inside locking capability. Each unit shall be equipped with a three roll toilet paper dispenser or single jumbo toilet paper dispenser. Each unit shall have a hand sanitizer dispenser installed inside the unit that will be filled with alcohol free antiseptic foam/gel that is rated to kill at least 99% of germs, to include E. coli, salmonella and Coronavirus. Handicap units shall be Americans with Disabilities Act (ADA) compliant to include wheelchair access and equipped with grab bars. Contractor shall anchor all permanent portable chemical latrines to prevent blowing over during heavy winds. Within 24 hours of a major rain event or high winds, the contractor shall check to ensure units have not been damaged or blown over. Any unit not upright shall be righted and appropriate spill measures initiated.
1.2. Stand-Alone Hand Sanitizer Dispensers. Stand-alone hand sanitizer dispensers shall have alcohol free antiseptic foam/gel that is rated to kill at least 99% of germs, to include E. coli, salmonella and Coronavirus. Dispensers shall be equipped with at least four dispensing units and shall provide approximately 3,000 single uses. Dispensers shall be beige, tan or gray in color and have a PC-000782 warning decal, Not for Drinking or Cooking. Upon delivery, contractor shall fill the base of each unit with water/sand to ensure dispenser does not blow over in high wind.
1.2.1. Hand Wash Stations. Hand wash stations shall have both a fresh water and gray water holding tank with at least a twenty-four gallon capacity each. Stations shall be equipped with at least two sinks per unit, foot pump operation, soap dispenser and paper towel dispenser. Dispensers shall be beige, tan or gray in color.
1.3. Scheduling. All portable chemical latrines provided shall have a lease price which includes servicing as defined in paragraph 1.4 and the technical exhibits of this PWS. The contractor shall provide a written, monthly schedule (to include dates and approximate times) for the maintenance of all permanent portable chemical latrines to the Contracting Officer’s Representative (COR) for each installation, ten business days after the start of the contract or 30 days after receipt of the maps. Updates shall be provided within five business days when there are changes due to additions/deletions.
1.4. Cleaning, Maintenance or Replacement Requirements. The contractor shall completely remove the portable chemical latrine contents during each servicing. The contractor shall clean and sanitize the seat, urinal, door (inside and out), walls and any interior surface (to include floor and ceiling) or replace each portable chemical latrine in accordance with industry and commercial standards. Periodic scrubbing may be required to maintain a clean/sanitary condition due to the field training setting many of the units will be placed in. The contractor shall provide chemical solutions which will decompose waste material, inhibit bacteria growth, and control odor. Contractor shall remove all cleaning materials and trash (i.e., unusable tissue) both inside and outside of unit after servicing. Contractor shall stock units with three full rolls of two-ply toilet tissue or a single jumbo roll, depending on dispenser type, during each service. Exteriors of each unit shall be kept clean. Price includes all costs for disposal of waste materials off the installation at an approved facility in accordance with all applicable federal, state and local regulations. The contractor shall charge the latrine tank using the manufacturer’s recommended ratio of water and deodorizing mixture in order to maintain an odorless latrine. Hand sanitizer dispensers located inside latrines shall be cleaned/restocked in accordance with latrine schedule.
1.4.1. Cleaning Frequencies. Permanent units shall be cleaned according to the frequencies listed on the technical exhibits.
1.4.1.1. Temporary Units – Fort Sam Houston/Camp Bullis. Units leased for 7 days or longer shall be cleaned twice weekly on Tuesday and Friday between the hours of 7:30 a.m. and 12:00 p.m. Intervals between cleanings shall not exceed four (4) calendar days, and the units shall be cleaned on the same day each week. Units leased between 3-6 days shall be cleaned once during the rental period; approximately half way through the lease period (second day of 3 day lease, third day of 5 day lease, etc.).
1.4.1.2. Temporary Units – Lackland (including Lackland and Kelly Annexes and WHASC), Randolph, Canyon Lake and Seguin Airfield. Units leased for 7 days or longer shall be cleaned weekly, the same day every week. Units leased for a period of less than 7 days do not require service (in the instance they do require service, COR will request an on-call for extra service).
1.4.1.3. The contractor shall clean and re-stock stand-alone hand sanitizer dispensers and hand wash stations as necessary to ensure sufficient supply remains throughout the duration of the lease period.
1.4.1.4. The contractor shall provide extra cleaning/servicing as required on an on-call basis. Pricing shall be in accordance with the applicable contract line item number (CLIN).
1.4.2. Relocation or Movement of Portable Chemical Latrines, Hand Wash Stations and Stand Alone Hand Sanitizer Dispensers. The contractor shall be required to relocate or move portable chemical latrines/hand wash stations/stand-alone hand sanitizer dispensers within four duty hours of written notification by the COR or Contracting Officer (CO) (e-mail is sufficient). Relocations requiring additional time shall be completed within the time frame mutually agreed upon between the CO/COR and contractor. Payment for relocating or movement of units shall be in accordance with the applicable CLIN.
1.4.3. Routine/Emergency Maintenance or Service. The contractor shall provide extra routine or emergency on-call maintenance or service, in addition to the contractor’s scheduled maintenance or service, as requested by the COR.
1.4.3.1. Routine Maintenance or Service. The contractor shall be provided a minimum of two calendar days advance notice as requested by the COR to provide maintenance/service no later than the date provided by the COR.
1.4.3.2. Emergency Maintenance or Service. For emergency response, the contractor shall respond within 2 hours and provide maintenance and/or service to portable chemical latrines/hand wash stations/stand-alone hand sanitizer dispensers as required and identified by the COR.
1.4.4. Temporary Units: Routine/Emergency/Scheduled Events
1.4.4.1. Replacement or Temporary Placement Portable Latrines and Handicap Units. The contractor shall provide replacement of identified latrines when requested by the COR. The contractor shall also provide additional portable latrines and/or handicap units per the request of the COR for a specified/estimated time period either on an Emergency or Routine basis. Maintenance and service of temporary latrines will apply IAW PWS 1.4.1.1 or 1.4.1.2.
1.4.4.1.1. Routine Replacement or Placement. The contractor shall replace or provide additional temporary units as requested by the COR. The contractor will be provided a minimum of two calendar days advance notice to provide replacement/additional placement no later than the date provided by the COR.
1.4.4.1.2. Emergency Replacement or Temporary Placement. The contractor shall replace or provide additional temporary units as requested by the COR under circumstances requiring emergency response (within 2 hours).
1.4.4.2. Temporary Units for Scheduled Events.
1.4.4.2.1. Airfest/Air Show. This event is typically a two-day (weekend) event normally occurring every other year at Lackland and Randolph (for example: 2024 Lackland, 2026 Randolph, etc.), though the frequency and locations may be altered due to real world situations. The contractor shall ensure waste disposal vehicles and operators are present to service units and stock hand wash stations/hand sanitizer dispensers as directed by the COR throughout both days. The contractor shall furnish all necessary personnel, supplies and equipment to sustain operations for a large number of visitors each day. The COR will provide a spreadsheet or map indicating areas for placement and the number of units and hand wash stations/hand sanitizer dispensers. The COR will assign a staging area for contractor’s use prior to and after the event. The contractor shall have 2 days to place units as designated by the COR. Units shall be removed from the flight line area within 2 hours after the close of the Airfest/Air Show. Units not on the flight line or ramp area shall be removed within 72 hours after the close of the event.
1.4.4.2.2. October Fest, Veterans Day, Fiesta Celebration, and 4th of July Festivities. These events are typically two to three days (weekend) occurring every year at Fort Sam Houston. The contractor shall ensure waste disposal vehicles and operators are present to service units and stock hand wash stations/hand sanitizer dispensers as directed by the COR throughout the days. The contractor shall furnish all necessary personnel, supplies and equipment to sustain operations for a large number of visitors each day. The COR will provide a spreadsheet or map indicating areas for placement and the number of units and hand sanitizer dispensers. The COR will assign a staging area for contractor’s use prior to and after the event. The contractor shall have 2 days to place units as designated by the COR. Units shall be removed from the area within 24 hours after the end of the festivals.
2. SERVICE SUMMARY. The contract service requirements are summarized in performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The Service Summary (SS) provides information on contract requirements, the expected level of contractor performance and the expected method of government validation and confirmation of services provided. These thresholds are critical to mission success. Procedures as set forth in the FAR 52.212-4 (a), Contract Terms and Conditions – Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies. During the first initial 30 days of the contract, two additional errors on each work shall be allowed in an effort to identify normal phase-in problems.

1.3.

2.1. Quality Assurance. The government shall inspect and evaluate the contractor’s performance to ensure services are received in accordance with requirements set forth in this contract. The CO or COR shall inspect by validating actual work performance, physically checking an attribute of the completed task, checking a management information report, investigating customer complaints, conferring with facility managers, or otherwise inspecting the task or its results to determine whether or not performance meets the standards contained in this PWS.
Any unsatisfactory inspection (defect) result shall be recorded on a Surveillance Checklist and the Contractor shall re-perform the service at no additional cost to the government within 4 hours after notification by the CO or COR. The Contractor shall return the signed/dated Surveillance Checklist within 3 business days of receipt annotating what actions were taken to correct the discrepancy and what action will be taken to ensure no repeat discrepancies.
When a performance threshold has not been met, the Contractor will be issued a Contract Discrepancy Report (CDR). The Contractor shall respond to the CDR in accordance with instructions provided and return it to the CO within 10 calendar days of receipt.
Failing to meet the performance threshold as outlined in the SDS for any of these performance objectives in any one (1) month period shall constitute an immediate Progress Meeting with the Multi-functional Team.
Failing to meet the performance threshold as outlined in the SDS of these performance objectives in any combination for any two, or more consecutive or non-consecutive months during a contract period shall result in a warning or letter of concern from the CO. All remedies shall be in accordance with the FAR 52.212-4(a), Contract Terms and Conditions - Commercial Items, and Inspection/Acceptance.
3.0 GOVERNMENT FURNISHED PROPERTY AND SERVICES
3.1 Government Furnished Facilities. None.
3.2 Government Furnished Supplies and Equipment. None.
3.3 Government Furnished Utilities. None.
3.4 Security, Fire and Medical Services. The Government will provide police and fire protection. In the event of a medical emergency, base ambulance service for transporting an injured employee to a local hospital is available on a cost reimbursement basis.
4. GENERAL INFORMATION.
4.1. Hours of Operation. The contractor shall maintain or replace the portable chemical latrines/hand sanitizer dispensers during the following hours: 7:30 a.m. to 4:15 p.m. Monday through Friday, except for federal holidays, emergency response and on-call service. Service at Canyon Lake shall be provided between the hours of 8:00 a.m. to 4:00 p.m., Mondays through Fridays. Weekend hours of operation for on-call service shall typically be from 7:30 a.m. to 6:30 p.m. with occasional events (Airfest, July 4th, etc.) running later. The contractor shall provide the government with phone number(s) where they can be contacted to respond to emergency calls within two hours, twenty-four hours a day/seven days a week.
4.2. Contractor Representative. The contractor shall provide a point of contact that shall be responsible for the performance and coordination of all work. Contractor point of contact shall be able to receive emergency calls twenty four hours a day, seven days a week. The name and telephone numbers of this person and alternate(s) shall be designated in writing to the CO within five working days after contract award.
4.3. Traffic Laws. The contractor and their employees shall comply with base traffic regulations at all times.
4.4. Security Requirements: The Contractor shall comply with AFI 10-245, Air Force Antiterrorism Standards, paragraph 2.17.3 and all installation security policies. These regulations are available for review at http://www.e-publishing.af.mil/. Security and base access requirements are contained in clause AFFARS 5352.242-9000 “Contractor Access to Air Force Installations.”
4.4.1. Contractor employees will be required to obtain and display identification badges. Anticipate delays in getting commercial vehicles on base and allow time for commercial vehicles to reach their destination by driving designated routes at posted speed limits throughout the base. Procedures for commercial vehicle access to the base are subject to change without prior notice. The Contractor shall be required to work in restricted and controlled areas of the base. The Contractor shall furnish and obtain all proper documentation and permits for entry in the restricted and control areas. All Contractor personnel working on JBSA must have a completed background check prior to being employed on JBSA, and must have a Government issued Contractor I.D. badge IAW paragraph 4.5 of this PWS.
4.4.2. The Contractor shall also obtain personnel identification badges as required for entry to the installation. The Government will provide all forms and procedures to the contractor to obtain personnel identification and vehicle passes during the pre-performance conference. The contractor shall provide the CO with a current list of employees needing access within 3 working days after receiving award or Notice of Award. The list shall include employee’s name, date of birth, state driver’s license/state ID number and state of issue. Within 10 business days after Government submits the list to the JBSA Security Office(s), the Government will notify the Contractor that installation access passes are available for those employees clearing the criminal history check. The duration of any pass issued will not exceed one year or the duration of the contract, whichever is shorter. Contractor personnel and property shall be subject to search and seizure upon entering the confines of JBSA installations, while on JBSA installations, and upon leaving the confines of JBSA installations.
4.5. Personnel: The Contractor shall not employ any person who is an employee of the United States Government, or the Department of Defense (DOD), either military or civilian, if such employment would create a conflict of interest, or be contrary to the policies contained in the DOD Joint Ethics Regulation, DOD 5500. 7-R.
4.5.1. The government is authorized to restrict the employment under this contract of any contractor employee, or prospective contractor employee who is identified as a potential threat to the health, safety, security, general well-being, or operational mission of this installation and its population.
4.5.2. Contractor personnel shall present a neat appearance and be easily recognized. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges, which contain the company name and employee name.
4.6. Safety Requirements. The Contractor shall perform work in a safe manner as required by Occupational Safety and Health Act (OSHA) Safety and Health Requirements and follow all Air Force Safety regulations.
4.6.1. The Contractor shall also provide a verbal notification to the CO/COR within 2 hours of any occurrence of damage to Government property or 2 hours of any accident resulting in death, injury, occupational disease, or adverse environmental impact. In addition, the Contractor shall also provide a completed written copy of the required Accident Investigation Reports to the CO/COR within five calendar days of each occurrence.
4.6.2. The Contractor shall provide for the safety and well-being of personnel employed in the administration of this contract. The Contractor shall comply with the provision of AFI 90-801, Environmental, Safety and Occupational Health. The Contractor shall develop and implement a company safety program for employees performing work under this contract. The Contractor shall submit the Company Safety Plan to the CO ten (10) calendar days prior to contract start date. Revisions shall be submitted five (5) calendar days prior to the effective date of change. The Contractor shall comply with the OSHA. Contractor personnel shall wear all safety items as required by the OSHA during the performance of tasks requiring protective equipment or clothing.
4.7. Hazardous Materials. The Contractor shall obtain approval using the application requirements of the AF Form 3952, Chemical/Hazardous Material Request/Authorization. Once the process is implemented and contractor is trained, the contractor may submit the AF Form 3952 electronically for each JBSA Location The CO has the right to prohibit the use of hazardous materials deemed to be especially hazardous to human health and the environment. In the event the CO does not approve a hazardous material for use, the COR may provide the contractor a list of suitable substitutes; however, the Contractor shall retain responsibility for finding an acceptable substitute. The Contractor shall take appropriate actions to comply with waste minimization and pollution prevention practices and policies at JBSA. The Contractor shall maintain spill control material on hand at all times sufficient to contain a worse case spill, both volume and hazard level.
4.7.1. IAW AFI 32-7086, Hazard Materials Management the Contractor shall register with the base HAZMAT Office at each location and comply with all the rules and regulations for the storage, usage and disposal of hazardous materials and products. The Contractor shall not bring any hazardous materials on base until all registration and documentation has been accomplished with the HAZMAT Office. The Contractor shall provide a copy of each MSDS on all hazardous materials to be used by the contractor in performance of work on this contract. The Contractor shall forward the monthly usage reports to the HAZMAT Office and the COR by the 5th of each month.
4.7.2. The Contractor shall dispose of used oil and filters in accordance with Base Environmental procedures. Contractor shall ensure used oil and filters are properly stored, accounted for, labeled and all documentation accomplished in accordance with the Environmental Office instructions. The Contractor is responsible for all fees, permits, manifests, etc. for the disposal of hazardous material. Contractor shall not dispose of hazardous material until a Government representative from the Environmental Office has signed a hazardous waste manifest.
4.7.3. Unless otherwise specified in this contract, the Contractor shall obtain all necessary permits, licenses, and certifications; give all required notices; and comply with applicable federal, DOD, Air Force, state, county, and local laws, codes, and regulations in performance of the requirements of this contract. Maintain records of such requirements and make the documentation available to the Government for review. The Contractor will be responsible for all OSHA, STATE, ENVIRONMENTAL, FIRE HAZARD, CHEMICAL, FUEL SPILL, FINES that occur as a result of company negligence.
4.8. Environmental Control/Compliance. The contractor shall comply with all applicable federal, state and local environmental laws, and with San Antonio Water System (SAWS) regulations.
4.8.1. Contractor personnel shall have all required licenses and permits necessary to perform services and disposal prior to the performance of any work on this contract (includes San Antonio Water System Liquid Waste Hauler permit, Texas Commission on Environmental Quality Sludge Transporter Registration). The contractor shall not use any ozone depleting substances or products. The contractor shall not pollute lakes, storm lines, sewer lines or wells with fuels, oils, bituminous, calcium chloride, acid, contraction wastes or other harmful materials.
4.8.2. Contractor shall provide a spill plan to the CO no later than 10 days after award. Any required revisions to the plan shall be accomplished and approved by the CO prior to the performance of any work on the installation. Spill plan shall detail steps taken in the event of an environmental spill of any type of waste product covered by this contract. Contractor shall notify the COR immediately of any spills within the confines of the installation. Contractor shall be responsible for all aspects of the spill cleanup at no additional cost to the government.
4.9. Contracting Officer and Contracting Officer Representative (Quality Assurance Personnel). The government will periodically evaluate the contractor’s performance to ensure services are being performed in accordance with the contract and PWS. The CO will appoint a primary and alternate representative for management of the day to day activities of the contract. The identity, title, and authority of this representative will be provided in writing to the contractor after contact award. Contractor shall re-perform unacceptable/defective service at no additional cost to the government.
4.10. Damages. The contractor shall take precautions to prevent damage to government property. The contractor shall repair (to include ruts) or replace damaged items at no additional cost to the government.
4.11. Continuity of Operations During Crisis Situation. According to DFARS 252.237-7023, Continuation of Essential Contractor Services, this service does not meet the definition of “essential contractor service” or “mission-essential function” and therefore, shall not be performed during a crisis situation.
4.12. Workers’ Compensation and Employer’s Liability. IAW FAR 28.307-2 Contractors are required to comply with applicable Federal and State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers.
4.12.1. General Liability. The contracting officer shall require bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.
4.12.2. Property Damage Liability Insurance. Property damage liability insurance shall be required only in special circumstances as determined by the agency.
4.12.3. Automobile Liability Insurance. The CO shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.
