PERFORMANCE WORK STATEMENT (PWS)

PEARL HARBOR NAVAL SHIPYARD

& INTERMEDIATE MAINTENANCE FACILITY (PHNSY & IMF)

DRY DOCK SEDIMENT REMOVAL

1.0 BACKGROUND:

Dry Dock has excessive sediment (i.e. silt, marine growth, and debris) build up in the Suction Chamber. There has not been a cleaning recently of the Dry Dock Suction Chamber, therefore, a lot of sediment has built up within the Dry Dock Suction Chamber. As a normal practice at the end of the flooding periods, will wash down the dock basin after dewatering of Dry Dock However, it is not in their current work procedures and capability to remove the sediment in the chambers. This PWS will furnish the labor, equipment and material needed for contractors to remove the sediment. Sampling of the sediment for potential hazardous materials and appropriate disposition will be performed following removal.

2.0 OBJECTIVE & SCOPE OF WORK:

2.1 The Contractor shall provide all labor, equipment, tools and materials to remove and properly dispose of all silt and sediment from the Dry Dock Suction Chamber. The estimated quantity of sediment/silt in the chamber is approximately 1,500 CF. It is expected that the sediment be dewatered to the maximum extent possible. The Contractor shall provide a unit price per cubic foot for the removal and disposal of the sediment/silt with cost justification. Following sediment/silt removal, the Contractor shall sample and provide testing results of the sediment/silt before disposal. Testing and disposal will be in accordance with local, State, and Federal environmental regulations, which would include Pearl Harbor Naval Shipyard and Intermediate Maintenance Facility (PHNSY & IMF) environmental and safety regulations.

2.2 Period of Performance (POP)

3.0 PERFORMANCE REQUIREMENTS:

3.1

The Contractors shall perform work with a boat in dock. The Contractor shall work around Dry Dock operations and schedule.

Contractors shall work around and coordinate with other contractors performing other work within Dry Dock Suction Chamber.

3.1.1. Work schedule will be determined by government and coordinated with contractor.

3.2 Any waste such as sediment, silt, sea growth, etc. will need to be collected, labeled, stored and disposed of in accordance with the Environmental Protection guidelines for contractors per the Appendices.

3.3 Contractor shall adhere to the National Pollutant Discharge Elimination System (NPDES) Permit Number HI 0110230:

3.3.1 The contractor shall ensure no sediment material enters the Pacific Ocean via the Dry Dock Drainage Pumps.

3.3.2 The contractor shall ensure no sediment material enters the Pacific Ocean via the Dry Dock flooding procedure for docking/undocking.

3.3.3 The contractor shall ensure no sediment material enters the Sewage System.

3.3.4 The contractor shall ensure no sediment material enters the Pacific Ocean via run off, the area of waste storage shall have a secondary containment.

3.4 The Contractor shall present an Environmental Protection Plan (EPP) as part of the Contractor’s proposal and bid submittal. References found in the appendices outlines the various elements that shall be addressed, including testing the docking blocks for the presence of hazardous materials, including lead, asbestos, radioactive, and environmental mitigation efforts, including nuisance dust control and other steps to be taken to minimize or prevent damage to adjoining structures, on-going PHNSY & IMF operations and injury to personnel working in the vicinity. The contractor shall coordinate with PHNSY & IMF for hazardous waste. Once accepted by the Government, the EPP shall become an integral part of the requirements of this PWS.

3.5 Pre-Removal Coordination Meeting: The Contractor shall participate in an on-site Pre- Removal Coordination Meeting with the Technical Point of Contact (TPOC) and other Government representatives to coordinate, review and discuss aspects and phases of the removal work, including the EPP and the Contractor’s Safety Plan. The Contractor shall provide the Government with the name and contact number for key personnel responsible for the execution of the service during working hours.

3.6 The Contractor shall be responsible for the proper disposal of all waste materials generated.

Disposal of materials shall be in accordance with local, State and Federal laws and regulations. The disposal of materials within PHNSY & IMF is prohibited. The contractor must provide PHNSY & IMF the actual final amount of sediment/waste disposed.

3.7 Prior to commencing work on the project, the Contractor shall obtain and provide a copy of all necessary permits, approvals and licenses necessary for the transportation of the material on highway/roads and disposal/recycling.

3.8 The Contractor shall comply with PHNSY & IMF crane requirements per NAVFAC P-307 found in the Appendices.

3.9 The Contractor shall comply with all Appendices in paragraph 13.0 APPENDICES of this

PWS.

3.10 Work Phases:

Phase I – Mobilize equipment.

Phase II – Remove and properly test/dispose waste material Phase III - Clean-up and demobilize.

3.11 Work Schedule will be determined by a Government representative and coordinated with contractor.

4.0 SERVICE DELIVERY SUMMARY:

5.0 QUALITY ASSURANCE:

5.1 The Contractor is responsible for implementing and maintaining a Quality Control Program

(QCP) to ensure that the work performed meets or exceeds contract requirements and results in the correction of potential and actual problems. The QCP shall be implemented on the first day of contract performance.

5.2 Periodic Progress Meetings: The Contractor agrees to attend any progress meetings during the contracted period of performance, the TPOC and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the TPOC will apprise the Contractor of how the Government views the Contractor's performance and the Contractor will notify the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

5.3 Environmental/Safety compliance: The Government will monitor the Contractor, to ensure that the Contractor’s EPP is being followed. The TPOC retains the right to stop the Contractor from performing any work that violates environmental or safety regulations; the Contractor shall be in compliance prior to re-commencing the work.

6.0 GOVERNMENT FURNISHED UTILITIES AND SERVICE:

6.1 The Government will not provide any labor, equipment or supplies to the Contractor.

6.2 Utilities: Low pressure air, sea water, and electricity will be available.

6.3 Services: none.

6.4 Equipment: none.

7.0 CONTRACTOR QUALIFICATIONS/REQUIREMENTS:

7.1 The Contractor shall be a licensed Contractor with documented experience in the work scope per paragraphs 2.1. The Contractor shall provide qualified equipment operators to perform all aspects of this work.

7.2 All vehicles provided for performance under this contract shall have current State of

Hawaii permits, licenses, safety checks and insurance. Vehicles shall be clearly marked with the Contractor’s name.

7.3 The Contractor and its representatives shall be trained in and comply with all Federal, State, Territorial and local environmental laws and regulations. In the event that the work is found non-compliant to all stated environmental laws and regulations, the contractor shall indemnify the U.S. government from any liability.

7.4 The Contractor shall comply with Public Law 105-270, Section 5(2) (A), which states that contractors will not perform inherently governmental functions. Section 5(2)(A) of this Public Law defines the term “inherently governmental function” as “a function that is so intimately related to the public interest as to require performance by Federal Government employees.” Per Section 5(2) (B), inherently governmental functions include management of Government programs requiring value judgments, conduct of foreign relations, selection of program priorities, and the direction of intelligence and counter-intelligence operations.

Per Section 5(2) (C), inherent governmental functions DO NOT include, (i) gathering information for or providing advice, opinions, recommendations, or ideas to Federal Government officials; or (ii) any function that is primarily ministerial and internal in nature.”

7.5 The contractor shall have experience with DoD directives, regulations, policies and procedures.

7.6 The Contractor shall not provide personal services.

7.7 Contractor personnel will make clear to all individuals they engage with that, they are

Contractor employees and not Government employees. When participating and introducing themselves during official events wherein Government, non-Government, or foreign personnel are present, Contractor personnel will identify themselves as employees of the Contractor. Contractor personnel must be clearly identified (i.e. company shirt, pin, visible company ID, etc.) in a visible location as to who their employer is.

8.0 PERSONNEL:

8.1 U.S. Citizenship is required for facility access. Prior to the start of work, the Contractor shall provide the Contracting Officer’s Representative (COR) (on company letterhead) a request for access and include the following information – full name of all personnel working on this contract; Social Security number; date of birth, place of birth, and citizenship. The contractor shall state that information has been verified and shall have supporting records on file, if required for examination.

8.2 Contractor personnel shall not establish an employee-employer relationship with

Government personnel under this contract.

8.3 Contractor personnel shall not manage, supervise, or task Government employees or military personnel. Contractor personnel may not make any commitment to non-DoD personnel, including a foreign official, which commits the expenditure of U.S. Government resources.

9.0 SECURITY REQUIREMENTS:

9.1 U.S. Citizenship is required for facility access. The Contractor shall conduct background investigations on personnel who are used in connection with this contract. Only those individuals with favorable investigations shall be utilized on this contract.

9.2 This contract does not require a security clearance level and clearance granted by the Defense Security Service (DSS). However, Contractor personnel shall recognize that PHNSY & IMF deals with sensitive information and other proprietary information, which are valuable, special, and unique assets. Contractor personnel shall not divulge, disclose, or communicate in any manner, any information to any third party without prior written consent. Contractor personnel shall protect information and treat it as strictly confidential and will abide by the security requirements of SECNAVINST 5510.36. A violation of this paragraph shall be a material violation of this agreement.

9.3 The Contractor personnel shall follow all procedures in requesting and obtaining a PHNSY

& IMF “Green” standard access control badge for all Contractor personnel performing work. Sufficient time shall be allowed by the Contractor to obtain the necessary badges prior to work.

9.4 The Contractor personnel shall follow all procedures in requesting and obtaining a PHNSY

& IMF Camera permits for all Contractor personnel that need to take pictures to perform the work. Sufficient time shall be allowed by the Contractor to obtain the necessary badges prior to use.

9.5 The Contractor personnel shall follow all procedures of PHNSY & IMF when training to use Personal Electronic Devices (PEDs). Sufficient time shall be allowed by the Contractor to obtain the training prior to work.

9.6 Should Contractor personnel receive or suspect they have learned of classified information beyond their level of clearance, the Contractor shall identify and report suspicions to the

COR.

10.0 CONTRACTOR RESPONSIBILITIES:

10.1 Identification badges shall be worn at all times when performing work, including while attending Government meetings and conferences that may take place outside the facility.

10.2 The Contractor performing services shall be required to comply with all Pearl Harbor

Naval Shipyard & IMF rules, regulations, and training that is applicable to conduct, safety, security, and procedures governing site entry and exit.

10.3 Ensure that the on-site technical representative complies with the following safety guidelines:

10.3.1 Personal Protective Equipment (PPE) shall be used per Occupational Safety and Health Administration (OSHA) guidelines.

o Safety glasses with side shields shall be worn when personnel are conducting eye hazardous operations and when in an eye hazardous area.

o Hearing protection shall be used when noise exposure is at hazardous decibels.

o Hardhats, safety glasses and safety shoes shall be worn at all times from the outer crane rail and/or entry into the fenced Controlled Industrial Area (CIA) area, including the Dry Dock Basins.

10.4 Shall ensure its employees understand the fire safety requirements and actions to be taken when fire or an emergency occurs during work. Contractor shall ensure that all personnel are briefed on the Shipyard Fire Safety Plan and muster locations.

10.5 Eating, smoking or drinking is prohibited except for designated areas identified by the government.

11.0 HOURS OF OPERATION:

11.1 Working Hours: PHNSY&IMF operates 24 hours per day. However, most

PHNSY&IMF administrators work 0630 to 1500 hrs, Monday through Friday, and do not work on Federal holidays. If the Federal holiday falls on a Saturday, the holiday is observed on the preceding Friday. If the Federal holiday falls on a Sunday, the holiday is observed on the following Monday.

11.2 Scheduled Federal Holidays:

11.2 The contractor must perform the work under this contract during the shift determine best to facilitate government need. Any work schedule outside the regular hours must be approved by the Contract Officer (KO) and coordinated with the COR prior to commencement.

11.3 Weekend work may be required but must be approved by the KO and coordinated with the COR prior to commencement.

11.4 Facilities may close due to local or national emergencies, administrative closings, or other Government directed facility closings. Contractor access to Government facilities during closures is not permitted.

11.5 If a holiday falls on a Saturday, the holiday is observed on the preceding Friday. If a holiday falls on a Sunday, the holiday is observed on the following Monday.
