3.0 DEFINITIONS

The following definitions are applied to this contract:

Contracting Officer - Contracting Officers have authority to enter into, administer, or terminate contracts and make related determinations and findings. Contracting Officers may bind the Government only to the extent of the authority delegated to them. Contracting Officers are responsible for ensuring performance of all necessary actions for effective contracting, ensuring compliance with the terms of the contract, and safeguarding the interests of the United States in its contractual relationships. In order to perform these responsibilities, Contracting Officers should be allowed wide latitude to exercise business judgment.

Disposal - In the context of this PWS, disposal is the discharge, deposit, injection, dumping, spilling, leaking, or placing of solid waste or hazardous waste into or on any land or water so that such solid waste or hazardous waste or any constituent thereof may enter the environment or be emitted into the air or discharged into any waters, including ground waters. Proper disposal effectively mitigates hazards to human health and the environment.

Hazardous Waste - A solid waste that may be solid, semi-solid, liquid, or contained gas, and either exhibits a characteristic of a hazardous waste as detailed in JEGS Paragraph 16A.1 or is listed as a hazardous waste in Tables of JEGS Chapter 16. Domestic sewage sludge, household wastes, and medical wastes are excluded.

Industrial Waste - Solid waste generated by industrial processes and manufacturing that is not characterized as hazardous waste IAW JEGS Chapter 16.

Japan Environmental Governing Standards (JEGS) - Specific environmental compliance criteria and specific management practices with which all DOD activities and installations in Japan must comply.

Manifest - A shipping document used to control and track industrial or hazardous waste from collection and transportation to disposal.

(1) Manifest Slip A – Issued when shipped off (from transporter to generator).

(2) Manifest Slip B – Issued when transporting is complete (from treatment/disposal facility to transporter to generator).

(3) Manifest Slip C – Issued when treatment/disposal is complete (within treatment/disposal facility, from treatment/disposal facility to transporter to generator).

(4) Manifest Slip D – Issued when treatment/disposal is complete (from treatment/disposal facility to generator).

(5) Manifest Slip E – Issued when all treatment/disposal is complete (from treatment/disposal facility to generator).

Oily Wastewater (OWW) - OWW can be bilge water, water containing bulk fuels, fuel tank cleaning wastewater, ballast tank wastewater, compensating tank wastewater, bulk fuel tank bottom wastewaters, hydro-blasting wastewater and wastewater contaminated with Aqueous Film Forming Foam and Fuel System Icing Inhibitor. OWW can include any fuel produced from used oil by processing, blending or other treatment and also include any oil or waste petroleum (diesel, jet fuels containing FSII, F-76, mixed fuel waste) or Petroleum Oil and Lubricant product that has been refined from crude oil or is synthetic oil. OWW can also include off-specification feed water, boiler and steam generator blow-down, seawater and brine.

Perfluoroalkyl-and Polyfluoroalkyl Substances (PFAS) - Per- and polyfluoroalkyl substances are a group of synthetic organofluorine chemical compounds that includes perfluorooctanesulfonic acid (PFOS), perfluorooctanoic acid (PFOA), and many other chemicals. PFAS is a common hazardous substance derived from an older variant of Aqueous Film Forming Foam which has been mostly eliminated from the Navy stock system but may still be found in use on ships and submarines.

Solid Waste - Garbage, refuse, sludge, and other discarded materials, including solid, semi-solid, liquid, and contained gaseous materials resulting from institutional, industrial, residential, and commercial operations and from community activities. It does not include solids or dissolved material in domestic sewage or other significant pollutants in water resources, such as silt, dissolved or suspended solids in industrial wastewater effluent, dissolved materials in irrigation return flows, or other common water pollutants.

Treatment - Any method, technique, or process, designed to change the physical, chemical, or biological character or composition of any waste. Treatment includes neutralization, energy or material resource recovery, or any process rendering a waste non-hazardous or less hazardous; safer to transport, store or dispose of; or amenable for recovery, amenable for storage, or reduced in volume. Elementary neutralization of hazardous wastes is not considered as treatment.

Treated Waste Oil - Waste oil generated by the separation process and/or treatment of the OWW.

Used Oil - Used oil that is recycled for reuse or burned for energy recovery is termed “used oil fuel.” Used oil fuel includes any fuel produced from used oil by processing blending or other treatment. “Used oil” means any oil or other waste petroleum, oil, or lubricant product that has been refined from crude oil, or is synthetic oil, has been used, and as a result of such use, is contaminated by physical or chemical impurities. Oil exhibiting the characteristics of reactivity, ignitability, corrosivity, and toxicity, is still considered used oil, unless it has been mixed with other hazardous waste. Used oil mixed with hazardous waste is a hazardous waste and will be managed as a hazardous waste.
