PERFORMANCE WORK STATEMENT

Cross-Connection Control Survey (Irrigation Systems) Joint Base Lewis McChord, Washington January 5, 2021

PART 1

GENERAL INFORMATION

1. General: This is a non-personnel services contract to conduct a cross-connection control survey of the irrigation systems on JBLM-Main in support of the JBLM Cross-Connection Control (CCC) and Backflow Prevention Program. The Government shall neither supervise Contractor employees nor control the method by which the Contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual Contractor employees. It shall be the responsibility of the Contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the Contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the Contractor's responsibility to notify the Contracting Officer (KO) immediately.

1.1. Description of Services: The Contractor shall provide all personnel, equipment, tools, materials, supervision, other items, and personnel services necessary to conduct a CCC survey of the irrigation systems on JBLM-Main as defined in this PWS except as specified as government-furnished property and services.

1.2. Scope: The Contractor shall provide services outline in PART 5 - SPECIFIC TASKS of this PWS. The Contractor is expected to meet the following objectives:

The Contractor shall conduct a cross-connection control survey of the irrigation system on JBLM-Main. Although the irrigation systems Cross-Connection Control locations (TE-3 Irrigation BFP (Lewis-Main)) are believed to be accurate, additional inspection locations may be required that are not identified on the TE.

The Contractor shall develop a CCC survey report (TE-4 CCC Hazard Survey Report). The report shall include the findings from the survey and prioritized recommendations for program repairs and improvements along with associated cost estimates.Comment by Ramirez, Amanda M CIV: This report (TE4) only allows for data from 4 back flows and 15 cross connections. Will the contractor need to provide a clean sheet per every 4 back flows, or can they provide on an excel spreadsheet? It doesn’t specify to use another page, etc.
Would it be better to specify one sheet per backflow location?Comment by Shelton, Nathan B CIV: Amanda: I don’t know if a separate report form is required for each assembly/location. I don’t know how effective or efficient it would be to populate a separate report for each of the 59(+) assemblies/locations. I was hoping industry would provide the solution to that.

I would assume the contractor could reference the type and size from TE-3 (from Column A) and provide the survey result details on page 2 of the survey report. We’re most concerned with capturing the information on the report. It’s a question I will ask of the PNW backflow point of contact.

1.3. Type of Contract: The Government intends to award a Firm Fixed-Price (FFP) contract.

1.4. Place of Performance: All work to be performed against this contract will be performed JBLM-Main at Joint Base Lewis-McChord (JBLM), Washington.

1.5. General Information

1.5.1. Quality Control: The Contractor shall develop and maintain an effective Quality Control Plan (QCP) to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor's QCP is the means by which it’s assured that the work complies with the requirement of the contract. As a minimum, the Contractor shall develop QCP procedures addressing the areas identified in the Performance Requirements Summary (PRS). After acceptance of the QCP the Contractor shall receive KO acceptance in writing of any proposed change to the QCP.

1.5.2. Quality Assurance: The Government shall evaluate the Contractor's performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rates. The contracts appointed Contracting Officer's Representative (COR) and/or Quality Assurance Evaluator (QAE) will perform on-site inspections to verify the Contractor's services meet the minimum standards of the contract requirements throughout the contracts performance period.

1.5.3. Government Remedies: In the event that the Contractor fails to perform satisfactory services or fails to correct non-conforming services, the KO shall seek remedy in accordance with the contract clauses.

1.5.4. Recognized Holidays: New Year's Day; Martin Luther King Jr.'s Birthday; President's Day; Memorial Day;

Independence Day; Labor Day; Columbus Day; Veteran's Day; Thanksgiving Day; Christmas Day.

1.5.5. Hours of Operation: The Contractor is responsible for providing services between the hours of 7:00AM-4:30PM (Local) Monday through Friday except federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings.

The Contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the work force are essential.

1.5.6. Special Qualifications: The CCC Survey shall be performed in accordance with Washington State Department of Labor & Industries (L&I), Washington State Department of Health Safe Drinking Water Act, AWWA M14 Backflow Prevention and Cross-Connection Control, and the Manual of Cross-Connection Control by the University of Southern California, 10th Edition. The survey team shall consist of at least one (1) person trained and experienced in Cross-Connection survey methodology. At least one (1) person actively performing the survey shall possess the following Washington State certification:

a. 1.5.7. Security Requirements

1.5.7.1. Physical Security: The Contractor shall be responsible for safeguarding all Government property provided for Contractor use. At the close of each work period, Government facilities, equipment, and materials shall be secured. If work is to resume in the same area the following day, the Contractor's equipment may be left in the same location at the Contractor's own risk. The Government is not liable for the Contractor's equipment.

1.5.8. Post Award Conference / Periodic Progress Meetings: The Contractor shall attend any post award conference convened by the contracting activity or contract administration office in accordance with the Federal Acquisition Regulation (FAR) Subpart 42.5. The KO, COR, and other Government personnel (as appropriate) shall meet periodically with the Contractor to review the Contractor's performance. At these meetings the KO will apprise the Contractor of how the Government views the Contractor's performance and the Contractor will apprise the Government of any issues being experienced. Appropriate action shall be taken to resolve any outstanding issues that have been identified. These meetings shall be at no additional cost to the Government.

1.5.9. Contracting Officer’s Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the functions identified in the letter of appointment issued to the COR and the Contractor. The COR is not authorized to change any of the terms and conditions of the resulting contract.

1.5.10. Key Personnel: The Contractor's project manager (PM) is considered key personnel by the Government. The Contractor shall provide a PM who shall be responsible for the performance of the work, as well as, an alternate PM who shall act for the Contractor if the primary PM is absent. The designated PM shall have full authority to act for the Contractor on all contract matters relating to the daily operation of this contract. The PM shall be available during normal hours of operation in accordance with PWS paragraph 1.5.5.

1.5.11. Identification of Contractor Employees: All contract personnel attending meetings and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

1.5.12. Personnel Administration: The Contractor shall provide for employees during designated Government non-work days or other periods where Government offices are closed due to weather or security conditions. The Contractor shall maintain the currency of their employees by providing initial and refresher training as required to meet the PWS requirements. The Contractor shall make necessary travel arrangements for employees. The Contractor shall provide necessary infrastructure to support contract tasks. The Contractor shall provide administrative support to employees in a timely fashion (time keeping, leave processing, pay, emergency needs).

1.5.13. Business Relations: The contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The contractor shall manage the timeliness, completeness, and quality of problem identification. The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.

1.5.14. Contract Management: The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor must maintain continuity between the support operation at JBLM and the contractor's corporate offices.

1.5.15. Contract Administration: The contractor shall establish processes and assign appropriate resources to effectively administer this requirement. The contractor shall respond to Government requests for contractual actions in a timely manner. The contractor shall have a single point of contact between the Government and Contractor personnel assigned to support contracts or task orders. The contractor shall assign work effort and maintaining proper and accurate time keeping records of personnel assigned to work on the requirement.

1.6. Security

1.6.1. AT Level I Training: All Contractor personnel requiring access to Army installations, facilities and controlled access areas shall complete AT Level I Awareness Training. All Contractor personnel shall comply with applicable installation, facility, and area commander installation/facility access and local security policies and procedures. 1.6.2. iWatch Army Training: The Contractor shall brief its personnel on iWATCH Army Training. 1.6.3. Installation Access and General Protection/Security Policy and Procedures:

Contractor personnel who require access to JBLM to perform work under any contract must obtain an Automated Installation Entry (AIE) access badge or a visitor's pass. Contractor personnel shall comply with applicable installation, facility, and area commander installation access and local security policies and procedures. The Contractor shall provide all information required for background checks to meet installation access requirements to be accomplished by installation the Directorate of Emergency Services (DES). All affected Contractor personnel must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. Should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes.

1.7. Emergency Services and Emergency Medical Treatment:

FOR IMMEDIATE EMERGENCY PERSONNEL RESPONSE DIAL 911. The Contractor shall have competent personnel trained and capable of dealing with minor personnel injuries. Madigan Army Medical Center (MAMC), Bldg. 9040 is available as the first point of emergency medical care for injuries occurring on the installation. Fees associated with emergency medical treatment are the sole responsibility of the Contractor and are not reimbursable. Contractor personnel shall immediately notify their supervisor, whenever possible, of any accident requiring emergency medical treatment. The Contractor will, in turn, notify the COR not later than one (1) hour following the incident. Emergency medical treatment and services for Contractor personnel is the responsibility of the Contractor.

1.8. Environmental Management System (EMS): The JBLM EMS conforms to the criteria defined in the international standard, ISO 14001:2004 Environmental management systems – Requirements with guidance for use.

In accordance with EMS procedures, the Contractor shall be familiar with the JBLM environmental policy and shall ensure that this information is considered and incorporated into this project. 1.8.1. Sustainable Acquisition: In order to comply with federally mandated sustainable acquisition requirements and Department of Defense (DOD) and Department of the Army (DA) Green Procurement Program (GPP) policies, JBLM requires the purchase, supply, and use of environmentally preferable products and services. Program elements include: recovered material products, energy and water efficient products, alternative fuels and fuel efficiency, bio- based products, non-ozone depleting substances, and environmentally preferable products. The Contractor shall comply with all applicable Federal, DOD, Army, and JBLM sustainable acquisition laws and policies. If compliant products are unavailable or determined to be impracticable based on cost or performance, the Contractor shall contact the COR for further guidance. Claims of exception must meet applicable legal criteria and be justified in writing through the submission of a completed HJB Form 225 (Sustainable Acquisition Exception). 1.8.2. Hazardous Materials: Prior to the use of any hazardous materials, the Contractor shall submit an initial list of hazardous materials to be used (including unit of measures and Safety Data Sheets for each product). A copy of these documents must be submitted to the JBLM Pollution Prevention Program at usarmy.jblm.id-readiness.list.dpw-aul@mail.mil prior to beginning work. These items must be reviewed by Pollution Prevention and authorized for use if they are not already on the Contractor’s Authorized Use List issued by the JBLM Pollution Prevention Program. The Contractor shall not use any hazardous materials not authorized by Pollution Prevention. The Contractor shall ensure that all non-storm water discharges from cleaning is collected and appropriately disposed of.

For any in-use hazardous materials, the Contractor shall submit a hazardous material inventory on HJB Form 953 noting the hazardous materials used, the units of measure, quantities used, storage locations, and other information indicated on the form. This inventory shall be submitted at the end of the project (if the project goes into a new calendar year, the Contractor shall also submit a copy of this inventory (accounting for all hazardous materials) by January 15 of the new calendar year). Storage of hazardous materials on JBLM in not authorized. All HJB 953 inventories shall be submitted electronically and addressed to the KO and COR with usarmy.jblm.id-readiness.list.dpw-hm-inventory@mail.mil included in the “Cc” line of the email. 1.8.3. Anti-Idling: The Contractor shall monitor its use of vehicles and other energy consuming equipment for abuse and unnecessary use beyond that needed to perform the services in accordance with this PWS. The Contractor shall turn off engines when vehicles and equipment are parked or a driver/operator is not at the controls unless maintenance operations require the engine to be idling. The Contractor shall idle engines for no longer than is necessary to produce sufficient temperature and pressure for vehicle operation.

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS & ACRONYMS

2.1. DEFINITIONS:

2.1.1. Contracting Officer's Representative (COR): An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.2. Contracting Officer (KO): A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the Government.

2.1.3. Deliverable: Anything that can be physically delivered, but may include non‐manufactured things such as meeting minutes or reports.

2.1.4. Non-Personal Service: Personnel rendering the services are not subject, either by the contract's terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.

2.1.5. Physical Security: Actions that prevent the loss or damage of Government property.

2.1.6. Quality Assurance Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.7. Quality Assurance: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.8. Quality Control: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.9. Sub-Contractor: One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

PART 3

GOVERNMENT FURNISHED ITEMS & SERVICES

3.1. Services: None.

3.2. Facilities: None.

3.3. Utilities: The Government will furnish utilities as currently installed on Joint Base Lewis-McChord. The Contractor shall not change or modify any utility system or component without prior COR review and written approval. The Contractor shall not connect any Contractor furnished property, equipment, or system without prior COR review and written approval. The Government will provide access to water sources and electrical power if it is in the immediate area of the work to be performed and in good working order. The Contractor shall instruct employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish the services in accordance with this PWS.

3.4. Equipment: None.

3.5. Materials: None.

PART 4

CONTRACTOR FURNISHED ITEMS & SERVICES

4.1. General Information: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Part 3 of this PWS.

4.2. Materials: The Contractor shall provide all materials and supplies necessary to meet the requirements of this PWS.

4.3. Equipment: The Contractor shall provide all equipment necessary to meet the requirements of this PWS.

PART 5

SPECIFIC TASKS

5.1. Basic Services: The Contractor shall perform the following tasks in support of the JBLM Cross-Connection Control and Backflow Prevention Program. The Contractor shall provide all personnel, equipment, materials, and other resources necessary for, or incidental to the performance of work associated with this requirement. Comment by Shelton, Nathan B CIV: Revised verbiage. I don’t know what was meant by activities.

5.1.1. Cross-Connection Control Survey: The Contractor shall conduct a CCC survey of all irrigation systems listed in Technical Exhibit-3. Although the facility listing is believed to be accurate, additional inspection locations may be required that are not listed (for example, backflow prevention assemblies added since the last survey was completed). Comment by Diaz, Jose F CIV: What? Comment by Shelton, Nathan B CIV: This sentence can be removed in its entirety. It was overlooked from the initial requirement to survey the entire installation. I apologize for the oversight. The irrigations system locations identified in TE-3 were selected because they have never been surveyed.

The Contractor shall inspect each facility's irrigation cross-connection as identified in Technical Exhibit-3 including a 100-foot radius surrounding the outside of each facility. The survey team shall consist of at least one (1) person trained and experienced in Cross-Connection Survey methodology (e.g. CCS). The contractor shall assume that 59 irrigation backflow prevention assemblies will be assessed during the CCC survey. The contractor shall develop and submit its projected schedule to the Government not later than 14 days prior to commencing work. Comment by Diaz, Jose F CIV: What happens if there are more than 59, will they be included with the report as a finding? Comment by Shelton, Nathan B CIV: We’re not expecting the contractor to survey any assemblies outside of those verified and identified in TE-3. This statement can be removed if it is too ambiguous.

All potential cross-connections between potable and non-potable water uses or sewers shall be documented. Each cross-connection shall be located, cataloged, and tagged. The Contractor shall identify, catalog, and evaluate all existing protections, including air gaps, vacuum breaks, and other backflow preventer assemblies. Information shall include location, type, manufacturer, model number, serial number, assembly size, and date installed (if applicable).

5.1.2. Cross-Connection Survey Database and Report: The Contractor shall produce a CCC Hazard Survey Report. The report shall include identification of all actual and potential cross-connections, the hazard classification of each, and recommended corrective actions along with estimated costs to implement each recommendation. The completed survey report shall be first signed by the CCS conducting the survey, and then countersigned by the owner of the premises or the owner’s authorized agent. Comment by Shelton, Nathan B CIV: In this case, the term “premises” refers to the JBLM water supply system in whole (e.g. premise plumbing), not individual facilities. The JBLM Water Systems Manager (Mr. Yannick Rendu) is the premises owner; therefore, he will verify the information for each cross-connection and countersign the survey report(s). I (as the COR) am only facilitating the project and do not have the authority to sign off on anything relating to the welfare of the water system.

The report shall include a section outlining the justification for recommended corrective actions. The Contractor shall include a narrative description of the locations where backflow preventer assemblies are installed and determine where backflow preventer assemblies and/or corrective action are needed. For each potential cross-connection identified that requires corrective action, the Contractor shall rank in descending order, from most hazardous to least hazardous, to allow for corrective action to be accomplished. The contractor shall provide a fully burdened estimated cost for each corrective action identified.

NOTE: The Cross-Connection Control Hazard Survey Report (TE-4) was taken from the Washington State Department of Health Guidance Document for Cross-Connection Control for Small Water Systems. Although this is a SAMPLE FORM, the Government would like to keep the format of the Cross-Connection Control Hazard Survey Report (TE-4). Comment by Ramirez, Amanda M CIV: Earlier question about the form only allowing 4 back flows and 15 cross connections…can we address this here? PART 6

APPLICABLE PUBLICATIONS

6.1. Applicable Publications (Current Editions): The Contractor shall abide by all applicable regulations, publications, manuals, and local policies and procedures including those listed elsewhere in this PWS and those listed below. When Army regulations and other regulations, publications, manuals, and local policies and procedures conflict, the Contractor shall contact the COR for clarification. Copies of Army regulations are available at https://armypubs.army.mil.

The Contractor shall abide by all applicable regulations, publications, manuals, and local policies and procedures. Any Contractor provided publications are to be procured and maintained at the Contractor’s expense. The appropriate edition of each publication shall be used:

(1) AWWA Manual M14 Backflow Prevention and Cross-Connection Control

(2) Manual of Cross-Connection Control by the University of Southern California

(3) Washington State Department of Health Publication No. 331-234 (Guidance Document: Cross-Connection Control for Small Water Systems)

PART 7

TECHNICAL EXHIBITS AND ATTACHMENTS
