Invitation to Bid Battle Creek Public School board is accepting bids for Public Address Systems for Dudley Elementary, LaMora Park Elementary, Post-Franklin Elementary, Verona Elementary, Springfield Middle school, WK Preparatory Academy and Fremont International Academy.

The Board of Education reserves the right to reject any and/or all bids in whole, or in part and to waive any informality therein. If in the Board's opinion, it is in their best interest, the contract may be awarded to other than the lowest bidder, for reason of establishing uniformity, delivery time, etc.

Bid shall be accompanied by a sworn and notarized statement disclosing any familial relationship that exists between the owner or any employee of the bidder and any member of the Board of Education or Superintendent. The Board of Education shall not accept a Bid Proposal that does not include this sworn and notarized disclosure statement. Familial Form must accompany your bid proposal.

Instruction to Bidders:

1. Pre-Bid Walk-Through

a. A mandatory pre-bid walk-through will be held April 9, 2019 at 9:00 am. The walk through will begin at Springfield Middle School and will continue the following schedule; LaMora Park, Dudley, Fremont International Academy, WK Prep, Post-Franklin, ending at Verona. See “School Locations To Be Included In Contract” for school addresses as needed.

2. Preparation of Bids:

a. Bidders are expected to examine all instructions and specifications. Failure to do so and comply with requirements will be at the bidder's risk, and is cause for rejection of the bid.

b. If any person contemplating submitting a bid is in doubt as to the true meaning of any part of the specifications or other conditions within the invitation, a written request for clarification must be submitted by April 17, 2019 to the attention of Chad Osborn via email at cosborn@battle-creek.k12.mi.us. Any clarification will be by written addendum duly issued by Chad Osborn and a copy of such addition will be emailed to each person in receipt of the invitation. Verbal explanations will not be binding.

c. Each bidder shall furnish all information required on proposal form. The person signing the form must initial erasures or other changes.

3. Submission of Bids:

a. All bids shall be submitted in sealed envelopes and shall include the following information on the face of the envelope: bidder's name, address, and statement "Bid # 101 - Public Address System". Failure to do so may result in a premature opening of, or failure to open, such proposal.

b. Bids must be received via mail or hand delivered to 3 W. Van Buren St, Battle

Creek, MI. 49017 before the closing date and time which is April 19, 2019 at 1:00 pm. Any bids received after this time will be returned unopened if marked, or not considered if inadvertently opened. Bidder must provide three

(3) hard copies of their bid response.

Consideration of Proposals

a. Chad Osborn, Director of Facilities and Operations shall represent the school district in all matters pertaining to this proposal and contact in conjunction therewith. The Owner reserves the right to reject any or all proposals, and to disregard any informality in the bids and bidding.

b. Proposals submitted on bid forms are understood to be according to specification data, unless deviations or exceptions are clearly stated with the same form. Each bid form must be filled out for every building listed in RFP.

c. The Owner reserves the right, when it deems to be in the best interest of the Owner, to award the bid as part or in whole.

d. Bidders shall be a reputable, recognized organization with at least five (5) years successful experience on work of this type. The bid documents shall include a list of a minimum of three (3) school references where similar work was completed within the past five (5) years, so as to allow checking and visiting of the references to evaluate the quality and nature of the bidder's work. Such a list, is to include names, addresses and phone number of individuals who may be contacted.

e. Contractor must describe their guarantee and/or warranty.

f. The insurance shall be written for not less than the following limits, or greater if required by law:

i. Workers’ Compensation Act; insurance as required by the State of Michigan.

ii. Comprehensive General Liability Insurance covering bodily injury and property damage with limits not less than:

1. $1,000,000 General Aggregate

2. $1,000,000 Products of completed operations aggregate

3. $1,000,000 Personal, Advertising, Injury

4. $1,000,000 Occurrence Limit

g. Comprehensive Automotive Liability coverage for owned, non-owned or hired vehicles in amount of not less than $1,000,000 per occurrence.

NOTE:

1) Coverages enumerated above must include Completed Operations Liability in force for one (1) year following date of Substantial Completion of the Project.

2) Wherever applicable, “X”, “C”, and “U” exclusions shall be waived.

3) In addition to the general liability coverages noted above, provide combined True Umbrella Liability coverages in the amount of not less than $1,000,000 per occurrence.

h. Certificates of insurance, in duplicate, indicating the job site and evidencing all required coverage must be submitted to and approved by Owner's Agent and Owner prior to the commencement of any of the work. 1. All policies shall expressly require thirty (30) day written notice to the Owner, at the above address, of the cancellation or material alteration of such policy, and the Certificate of Insurance shall so provide.

i. The Contract shall be awarded when a Bidder has been issued either a letter of intent followed by a purchase order or a purchase order only.

j. After a contract agreement has be executed, the Bidder shall not be allowed any sum and above the price(s) specified in the contract agreement.

k. It is the Bidder's responsibility to note any detail or specification that, in his/her opinion is not practical or functional.

4. Order deletions:

Owner reserves the right to add or deduct item quantities from the original specification without any affect on the unit prices submitted.

AWARD:

Qualifications to perform the work: Battle Creek Public Schools reserves the right to request a criminal background check on any employee of Contractor. BCPS also in its discretion may decide that anyone with a criminal history, other than traffic violations that have not been annulled, will not be allowed to work at the project site.

The award will be based on the proposal that best meets the needs of BCPS. Factors included will be the cost, completeness of the proposal, quality of the technology provided, and experience of the contractor and installation team.

*Maximum points for the best and so forth. Difference between scores is based on how close they are to one another. BCPS reserves the right to waive any and all informalities in its best interest.

• Applicants are responsible for having ascertained pertinent local conditions, such as equipment, conditions, locations, accessibility, and general character of the site, knowledge of conditions affecting the work. The act of submitting a proposal is to be considered as full acknowledgment that the bidder inspected the site and is familiar with the conditions and requirements of these specifications.

Successful Contractor Requirements:

a. The Owner shall not be responsible for any cost or expense the Contractor incurs in implementing the requirements of this bid document.

b. Contractor shall remove from the project all his/her waste materials and rubbish resulting from his/her operations and shall remove all packing cartons and debris. If contractor fails to clean up within seven (7) days after completion, the Owner may do so and the cost thereof shall be charged to the Installer as a deduction in his/her contract price.

c. Contractor shall take all reasonable precautions for the safety of his/her work, all items or materials to be installed which are in his/her custody, adjacent property, other workmen at the site, and the public.

d. Contractor shall provide an adequate number of qualified, experienced personnel, in harmony with other workers at the site, capable of performing the required work within the timeframes set forth in Owner's schedule.

e. All workmen and subcontractors performing work shall be skilled in their respective trades.

f. Contractor agrees, that in the performance of its work under this contract, it shall abide by and comply with all applicable Federal, state and local laws, codes and regulations, including but not limited to the Occupational Safety and Health Act of 1970.

g. Because other activities of the Owner will be proceeding at the same time as the project covered by this specification, the contractor shall cooperate with the Owner's Representative to ensure that all work progresses in a manner which does not conflict with other activities.

h. The Owner shall conduct a final inspection of project to assure that all work performed meets specifications.

i. It is the responsibility of the Contractor to keep informed of all existing and future federal, state, county or local ordinances and regulations which in any manner affect the work to be performed. The Contractor and all his/her agents or subcontractors shall at all times observe and comply with all such laws and ordinances, and shall protect and indemnify the Owner and all their representatives against any claim, loss, or liability arising or resulting from violation of any such laws or ordinances.

Scope of Work

SITE VISITATION

A MANDATORY PRE-BID SITE WALK IS SCHEDULED FOR April 9, 2019 at 9:00 am .

Meet at the reception desk at Springfield Middle School, 1023 Avenue A, Battle Creek, MI 49037. Walk through will then proceed to LaMora Park, Dudley, Fremont International Academy, WK Prep, Post-Franklin, ending at Verona. Attendance at the scheduled walk through is a contract bidding requirement. A sign in sheet must be signed by all bidders at the walk. Additional site visits may be scheduled directly with Chad Osborn, BCPS Director Operations, Facilities, and Technology, cosborn@battle-creek.k12.mi.us. No obligation on the part of BCPS exists for additional visits, but an effort will be made to accommodate additional visits.

Applicants are responsible for having ascertained pertinent local conditions, such as equipment, conditions, locations, accessibility, and general character of the site, knowledge of conditions affecting the work. This project includes:

1. Design and Installation of an Public Address System at Battle Creek Public Schools.

2. Project completion would be August 9, 2019.

3. The winning design builder will provide all necessary design and installation.

4. The finished project is to be fully code compliant, field tested and subject to owner approval prior to final acceptance.

SERVICES

Work within this request for proposal (RFP) shall include the following:

A. Available Manufacturers: Subject to compliance with requirements, manufacturers offering products that may be incorporated in the work include, but are not limited to, the following:

1. Valcom

B. System Requirements

1. Coordinate the features of materials and equipment to form an integrated system. Match components and interconnections for optimum performance of specified functions.

2. Single source all equipment from one vendor or limit as much as possible the number of vendors to simplify system maintenance.

3. Functional Performance: System functions include, but are not limited to, the following:

a. All paging via phones and no use of microphones

b. Self-amplified system (voice sent over Cat5E from central point to speakers)

c. Prerecorded message triggering accessed via any phone but limited by passcode

d. Access to page from any phone connected to PBX but limited by passcode

e. Paging to all speakers across entire campus simultaneously (1 Zone) in school.

f. Unlimited expansion

C. Placement of Equipment 1. Speakers, horns and strobes are to be installed according to attached maps and verified with school appointed representative before starting install D. Equipment 1. Central Paging Control Unit - Provide units with the following minimum features:

a. 600 Ohm Impedance input

b. 120 Vac power

c. Battery backup

d. UL, CSA, CE compliant

e. Wall mountable or mountable in existing MDF PBX racks

2. Power Supplies for speakers – Install power supplies at various distribution closets in the buildings sufficient to power the initially installed speakers and provide for growth in the areas to be covered.

3. Battery Back-up Power Unit: Rack-mounted unit consisting of time-delay relay, sealed lead calcium battery, and battery charger. Arrange unit to supply public address system with power automatically during an outage of normal 120-V ac power. Arrange for battery to be on float charge when not supplying system and to transfer automatically to supply system after 10 seconds of continuous outage of normal power, as sensed by time-delay relay. Provide automatic retransfer of system to normal supply when normal power has been reestablished for 10 seconds continuously. Provide ON-OFF switch and "normal" and "emergency" indicating lights. Provide adequate capacity to supply maximum system power requirements for one hour of continuous full operation.

4. Wire and Cable: Cat 5E Plenum (PURPLE or VIOLET)

5. Weatherproof Equipment: Where equipment is indicated to be weatherproof, or is exposed to the weather or damp conditions, provide items specifically designed and listed for such duty.

INSTALLATION

A. General: Install equipment to comply with manufacturer's written instructions.

B. Wiring Method: Install PURPLE or VIOLET CAT 5E Plenum wire for easy identification compared to network and camera wiring.

C. Weatherproofing: Apply to units that are mounted out-of-doors or in damp locations or where exposed to weather.

D. Grounding

1. Ground cable shields and equipment to eliminate shock hazard and to minimize ground loops, common mode returns, noise pickup, cross talk, and other impairments.

2. Signal Ground Terminal: Locate at main equipment rack or cabinet. Isolate from power system and equipment grounding.

E. Cleaning

1. Prior to final acceptance, clean system components and protect from damage and deterioration.

Demonstration

1. Schedule training with Owner with at least 7 days' advance notice.

2. Train one member of owner’s personnel from the following departments:

Safety and IT

3. Amount of training: provide a total of 6 hours of training to personnel distributed between the Safety and IT departments. Distribution determined by Owner.

On-Site Assistance

1. Occupancy Adjustments: When requested within one year of date of Substantial Completion, provide on-site assistance in adjusting sound levels, adjusting controls, and investigating possible need for any system revisions required to meet actual occupancy conditions. Provide up to 3 visits to the site for this purpose.

HAZARDOUS MATERIAL RESPONSIBILITY

The contractor is to notify the owner of any hazardous materials encountered. The owner will contract as necessary to remedy the hazardous material conditions.

ADDITIONAL PROJECT REQUIREMENTS

● A one year warranty is to be provided for all work performed.

● Equipment list and design is to be approved by BCPS prior to ordering or installation of materials.

● Submittals are to be made, with acknowledgment by the design builder that the project requirements are met.

● CAD based design documents are to be generated for the final design and finished project.

● Power and cable requirements are to be included in the design.

● Work shall be done with a minimum amount of disruption to the school activities.

○ This may include off hours work which are to be scheduled in advance with the BCPS administration.

● The school reserves the right to make a written request for additional information from a Contractor/Vendor to assist in understanding or clarifying a Proposal. The responses are to be provided in writing.

● Required Material Safety Data Sheets (MSDS) for material brought on site by the successful bidder must be available on site at all times.

● All local, state and federal regulations are to be followed. Any fines assessed to BCPS due to the lack of these regulations being followed will be the responsibility of the successful bidder.

• If applicable, vendor is responsible for calling Dig Safe System, Inc., a private locating service. Any fines, damages, etc. assessed to BCPS due to failure to obtain a Dig Safe permit and to have utilities located by a private company will be the responsibility of the successful bidder.

• Shirts are required to be worn at all times on the work site.

• Smoking is NOT allowed. Individuals who violate this rule will be warned by the school staff. Multiple infractions will result in permanent removal from the site contract work.

• No radios or headsets are allowed.

• Parking for vehicles and equipment must be cleared through the Facilities Maintenance Department. Use of cell phones and radios are prohibited while vehicles are in motion.

• Designated bathrooms are available in the Building

• After the Award of Bid, the Contractor shall submit a list of all employees, all subcontractors’ employees, and other related personnel who will be physically required to work at the College, providing the following information for each person:

• Battle Creek Public Schools reserves the right to request a criminal background check on any employee of Contractor. BCPS also in its discretion may decide that anyone with a criminal history, other than traffic violations that have not been annulled, will not be allowed to work at the project site.

BCPS reserves the right to accept or reject any or all of the proposals.

The award will be based on the proposal that best meets the needs of BCPS. Factors included will be the cost, completeness of the proposal, quality of the technology provided, and experience of the vendor and installation team. The vendor who is awarded the contract will need to submit a completed Alternate W-9 form (no fee) with contract and must be willing to comply with all terms and conditions of the State of MI.

CONTRACT TERM

Battle Creek Public Schools shall have the right to terminate the contract at any time by giving the Contractor a thirty (30) day written notice.

PAYMENT AND COMPENSATION

Payment terms: 90% due within 30 days after satisfactory completion of work invoiced, receipt of the invoice, approval, and acceptance by Battle Creek Public Schools or progress payments on a monthly basis. Retainage will be released within 45 days of receipt of all warranty and training and documentation required for proper servicing of the equipment. The vendor awarded the contract will need to furnish an insurance certificate as described.
