· Late responses will not be considered Minnesota’s Commitment to Diversity and Inclusion The State of Minnesota is committed to diversity and inclusion in its public procurement process. The goal is to ensure that those providing goods and services to the State are representative of our Minnesota communities and include businesses owned by minorities, women, veterans, and those with substantial physical disabilities. Creating broader opportunities for historically under-represented groups provides for additional options and greater competition in the marketplace, creates stronger relationships and engagement within our communities, and fosters economic development and equality.
To further this commitment, the Department of Administration operates a program for Minnesota-based small businesses owned by minorities, women, veterans, and those with substantial physical disabilities. For additional information on this program, or to determine eligibility, please call 651-296-2600 or go to the Office of Equity in Procurement home page, at www.mn.gov/admin/oep.
SPECIAL NOTICE: This is a request for proposal. It does not obligate the State of Minnesota to award a contract or complete the proposed program, and the State reserves the right to cancel this solicitation if it is considered in its best interest.
This Solicitation requires proposals to be submitted through the SWIFT Supplier Portal. Please note the security changes below that may impact responders from submitting a timely response.
SWIFT SUPPLIER PORTAL SECURITY CHANGES
There are new security measures that the Minnesota Management and Budget implemented on October 16, 2022. It is a new multi-factor authentication (MFA) to enhance the security of the State of Minnesota Supplier Portal. MFA is an authentication method that requires bidders and suppliers provide two verification factors to log into the SWIFT Supplier Portal. The goal of MFA is to create a layered defense that makes it more difficult for unauthorized system access to occur.
For information about these changes, please refer to the SWIFT Supplier Portal Multi-Factor Authentication FAQ document.
If you have not done so already, please make sure to log into the SWIFT Supplier Portal as soon as possible to get this authentication set up early so there are no issues when submitting a response to an RFP.
You are strongly encouraged to set your MFA during business hours of 8:00 A.M. to 4:00 P.M., Central Time, Monday through Friday. You may experience delay setting your MFA after hours.

SECTION 2 – SUMMARY OF SCOPE
1. Procurement Overview and Goals.
The Department of Natural Resources, Division of Forestry, Badoura Nursery is seeking proposals to provide fumigation for weeds (both weed seeds and germinating seedlings) and soil-borne pathogens (nematodes, fungi, and bacteria) control in nursery beds. This service is necessary to keep weeds and pathogens out of the nursery fields to allow them to remain in production and increase capacity for forest regeneration projects.
Since 1931, Minnesota's State Forest Nursery has provided over 1 billion healthy, native tree and shrub seedlings for Minnesota plantings. With over 85 years of experience, we have developed methods to achieve the best seedling stock possible. Seedlings are kept in the ground long enough to develop robust root systems and healthy stems. Depending on species, coniferous seedlings are between 2–4 years of age, and deciduous seedlings are between 1–3 years of age when sold. Every seedling is inspected to meet high standards for height, diameter, root development, and health. Only the best seedlings are sold.
The goal of the Badoura Nursery is to economically produce forest regeneration material of the highest genetic and biologic quality in the quantity needed for forest regeneration projects. Soil fumigation play a crucial role in ensuring a healthier soil environment for seedlings to develop successfully.
The specific fields to be fumigated will be determined by the DNR Nursery following soil testing reports and the spring/fall planting plans.
The Responding fumigation company must be able to determine and provide the appropriate fumigation chemical, the chemical application, tarp to trap the chemical in the ground and provide the trained applicators to apply the chemical. This process usually takes about 3 days. The fumigation company also needs to provide a licensed applicator to ensure the chemical is applied according to all state and federal laws.
Sample Tasks and Deliverables.
A. Responder will determine the appropriate fumigant, application rate, application method and timing based on the soil characteristics, level of pest infestation, environmental conditions, and the target soil-borne organism(s).
B. Responder will provide instructions on proper ground prep prior to fumigation and removal and disposal of the plastic tarp, which will be the responsibility of the Nursery.
C. Responder will provide appropriate fumigant application and TIF plastic (“solid tarp” method) coverage on ten nursery fields (approximately 15 acres) for weed and pathogen control in nursery beds.
D. Responder will provide a licensed applicator to oversee/apply chemical.
E. Responder will provide on-site supervision of fumigant handlers and fumigant applications.
F. Responder must post proper signage and posting requirements.
G. Certified applicators must keep records of all soil fumigant applications. Certified applicators must prepare and make available written FMPs for each fumigant application. These records must be made available for qualifying parties. Recordkeeping requirements fall under United States Department of Agriculture (USDA), EPA, or state regulatory authority depending on the type of certification: private applicator or commercial applicator.
SECTION 3 – PROPOSAL INSTRUCTIONS AND ADDITIONAL INFORMATION
1. Anticipated Contract Term.
The term of this contract is anticipated to be from June 15, 2024, to June 14, 2026, with the option to extend up to an additional three one-year increments determined by the State.
Question and Answer Instructions.
All questions should be submitted no later than the date and time listed in Section 1, Instructions to Responders. The State is not obligated to answer questions submitted after the question due date and time.
Only personnel listed above are authorized to discuss this solicitation with responders. Contact regarding this solicitation with any personnel not listed above could result in disqualification. This provision is not intended to prevent responders from seeking guidance from state procurement assistance programs regarding general procurement questions.
If a Responder discovers any significant ambiguity, error, conflict, discrepancy, omission, or other deficiency in the solicitation, please immediately notify the contact person detailed above in writing of such error and request modification or clarification of the document.
Additional Tasks or Activities.
Responders are encouraged to propose additional tasks, activities, or goods above and beyond the scope of what is requested in this solicitation if they will substantially improve the results of this procurement. Any costs associated with these additional tasks, activities, or goods should be clearly marked and separated from costs associated with the tasks, activities, or goods specifically requested under this solicitation. Because cost is a factor in the evaluation of responses to this solicitation, failure to separate costs for additional tasks, activities, or goods may result in those costs being included in a responder's cost proposal and result in a lower cost score for that proposal.

Work Plan. Responder should provide a description of the deliverables to be provided by the Responder along with a detailed work plan that identifies the major tasks to be accomplished and be used as a scheduling and managing tool, as well as the basis for invoicing. This document should NOT list cost detail. If cost detail is included in this document, the State may disqualify the proposal as non-responsive. Responder should provide a statement of the objectives, goals, Personal Protective Equipment (PPE), Emergency Response Plan, and tasks to show or demonstrate the Responder's view and understanding of the nature of the contract, and what makes the Responder uniquely suited for this work. Responder should provide a Fumigant Management Plan (FMP) to ensure the certified applicator will comply with label requirements, the chemical is applied according to all State and Federal laws and serve as a record of compliance. The FMP is to ensure that all aspects of a safe and effective fumigation have been planned before the actual work begins. The FMP must be kept on site during all handler activities and made available to handlers; local, state, federal, and tribal enforcement personnel; and emergency responders. Both the certified applicator and the property owner must keep a copy of the FMP on file for two years from the date of the application.
