About this file

This document is a Justification for Exception to Fair Opportunity (JEFO) for a task order under contract 70US0923F1DHS2538 held by AVER LLC. The U.S. Secret Service (USSS) is seeking to enhance the Protective Threat Management System (PTMS) under this contract by adding four subject matter expert and senior developer resources to support a compressed schedule for 14 major PTMS enhancements.

The JEFO cites FAR 16.505(b)(2)(i)(B) as the basis for the sole-source justification, stating that only AVER can provide the unique and highly specialized services required at the necessary level of quality. The enhancements are within the general scope of the existing PTMS contract and are necessary to ensure consistent code development, compatibility, and continuity of services to support the USSS's upcoming National Special Security Event activities in 2026. The total estimated price for the additional four resources is $. The Contracting Officer has determined that the proposed labor rates are fair and reasonable.

Justification for Exception to Fair Opportunity Exceeding the SAT pursuant to FAR 16.505(b)(2)(ii)(B)

JEFO No.: FY24- 0010 - 1 -

JEFO No.: FY24- 0010

Date: April 18, 2024 PR Number:

1. Agency and Contracng Acvity

The Department of Homeland Security (DHS), U.S. Secret Service Office of Procurement prepared this jusficaon for an excepon to fair opportunity.

2. Nature and/or descripon of the acon being approved

DHS/USSS/CIO/SII intends to award a task/delivery order without considering other awardees under contract number 70US0923F1DHS2538 pursuant to FAR 16.505(b)(2)(ii)(B).

3. A descripon of the supplies or services required to meet the agency’s need (including the esmated value).

The United States Secret Service office of Chief Informaon Officer (OCIO) provides informaon sharing services with respect to individuals of protecve interest. This mandate is parally met with the Protecve Threat Management System (PTMS), which primarily serves the Protecve Intelligence & Assessment Division (PID).Threat intelligence and idenficaon (protecve intelligence) are crucial aspects of upholding that mandate, and mission success is largely dependent on the mely idenficaon, tracking, and disseminaon of threat-related informaon. To be successful, USSS personnel must have mely access to current, complete, and accurate protecve intelligence. The PTMS provides PID and field users a system to manage the collecon, analysis, and disseminaon of this mission crical informaon. The Uniformed Division Log Book (UDLB) is a PTMS module that allows Uniformed Division personnel to capture incident data on alarms, arrests, demonstraons, employee sickness and injury reports, threats, vehicle accidents, as well as other classificaons. UDLB interfaces with PTMS to support cases created.

Currently AVER LLC provides PTMS under contract number 70US0923F1DHS2538 with a Period of Performance of 6/26/2023-3/25/2024; a Base Period of nine (9) months, and four (4), oneyear opons, for a total price of . All qualified small business vendors were given a fair opportunity to be considered for the original task order via Qualified Small Business

Contract Holders under CIO SP3 SB within the NITAAC Strategic Sourcing Vehicle under Task Area 10.

The Assistant Director of Strategic Intelligence and Informaon of (SII) is requesng to enhance the schedule for PTMS enhancements by 6 months from the end of 2024 to opon period 1 just two months aer Inauguraon to be best postured for a very acve 2026 USSS Naonal Special Security Event (NSSE) year. The workforce will be able to get used to the new features for a full year in normal operaons mode before transioning to NSSE/normal operaons mode. This sheer increase in volume and velocity of work requires the addional support of four (4) resources (Team B).

The labor categories for these four support roles are:

Subject Mater Experts Level II / Senior Developers

These four addional resources will provide mission crical support in achieving SII’s new requirements.

The total esmated price for this enhancement is

4. Idenfy the excepon to fair opportunity and supporng raonale, including a demonstraon that the proposed contractor’s unique qualificaons or the nature of the acquision requires use of the excepon cited.

FAR 16.505(b)(2)(i)(B). Only one awardee can provide the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

The basis as to why the Government believes only AVER can provide the services required at the level of quality required is, because the services are unique and highly specialized. It is within the general scope of the exisng contract. The enhancements requested are permissible changes and can be made under the PTMS contract. USSS needs to maintain code delivery and consistency with one vendor for development to support upcoming NSSE for campaign season and inauguraon.

Raonale:

While the scope of work for PTMS has remained consistent since contract award, the sheer volume and velocity of work has rapidly increased.

JEFO No.: FY24- 0010 - 3 -

The PTMS contract team assessed the requirements to develop a schedule when the contract kicked off June 23, 2023. The schedule was unveiled mid-October 2023 and when presented with the major requirements had a planned compleon date of the end of 2025 to complete.

and minor requirements being implemented in following opon years. Fourteen major enhancements were idenfied as below:

Requirement Dependent Task Duraon (weeks)

1 – Done Case Dashboard N/A 15 2 – Done 671/679 Case N/A 8

3 – WIP Sensive Tab 8

4 672 Case 2 10 5 Other case types 2 4 6 Reports, Abstracts 5 4 7 PIOC Reports 5 4 8 PIX Agent 5 4

9 Simple Search 5 3 10 Mobile Search 5 3 11 UDLB atachment sync 5 6

12 Admin Ulies 5 6 13 Quick Search 5 3 14 Advanced Search 5 20

As idenfied in the table above, majority of the requirements can be worked concurrently and has a major opportunity to develop in concurrent acvies that would result in compressed schedule. The ideal scenario for the PTMS contract is to establish a second development team (Team B) to distribute the workload amongst two development teams. The team currently working (Team A) will handle the threat management requirements and the second team (Team B) would handle the search requirements.

The enhancements requested to support the inauguraon are within the general scope of the contract and is necessary to ensure that we have consistent code development, compability, and interoperability of the team, and above all connuity of services from one vendor to ensure consistency and security. AVER could provide a seamless support to the addional requirement, keeping the consistency of the code being developed. This will enable the workforce geng trained on the use of the new features in a mely manner. This is a permissible in-scope change

JEFO No.: FY24- 0010 - 4 -that is requested due to the unique and highly specialized need under the exisng PTMS contract.

An assessment of recent market research conducted for the re-compete enabled the consideraon of whether contractors other than the incumbent could provide the addional resources. It is esmated that it would take an eligible contractor other than the incumbent a minimum of 90 days to transion-in and that it would take that same contractor an addional 90 days to get up to speed on the program, it has been determined that the incumbent is the only responsible source who can rapidly and efficiently sasfy the Agency’s PTMS requirements with the addional qualified teams. No other contractor can provide the unique level of quality required to meet the Agency’s PTMS requirements with limited risk during the me period involved. Without the addional four development resources, the success of PTMS will be severely compromised.

5. Determinaon by the contracng officer that the ancipated cost to the Government will be fair and reasonable.

The contracng officer will verify that all labor categories and rates proposed for this contract modificaon is fair and reasonable based on the pricing that was negoated when the PTMS Contract (70US0923F1DHS2538) was compevely awarded under CIO SP3 SB within the NITAAC Strategic Sourcing Vehicle under Task Area 10.

6. Any other facts supporng the jusficaon.

There are no other facts supporng this jusficaon.

7. A statement of the acons, if any, the agency may take to remove or overcome any barriers that led to the excepon to fair opportunity before any subsequent acquision for the supplies or services is made.

USSS CIO/SII will connue to monitor the marketplace for up to date opportunies to fulfill our needs and connue to plan ahead for new requirements. While there are no plans to foster compeon for this acon because only AVER LLC has the necessary knowledge and resources to connue crical operaons, future task order/contracts will be competed.

8. DHS intends to post this requirement on FedBizOpps pursuant to FAR 16.505(b)(2)(ii)(D).
