SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFERORS OR

OFFERORS

L.1 52.215-1 INSTRUCTIONS TO OFFERS – COMPETITIVE ACQUISITIONS (JAN

2004) DEVIATION, (e) has been replaced with HHSAR 352.215-1 Instructions to Offerors - Competitive Acquisition.

(a) Definitions. As used in this provision -

Discussions are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer's discretion, result in the offeror being allowed to revise its proposal.

In writing, writing, or written means any worded or numbered expression that can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.

Proposal modification is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

Proposal revision is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

Time, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror. Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.

(2) The first page of the proposal must show -

(i) The solicitation number;

(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and

(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.

(3) Submission, modification, revision, and withdrawal of proposals. (i) Offerors are responsible for submitting proposals, and any modifications or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.

(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is late and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and -

(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(3) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.

(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.

(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.

(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.

(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.

(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).

(e) Restriction on disclosure and use of data.

(1) The proposal submitted in response to this request may contain data (trade secrets; business data, e.g., commercial information, financial information, and cost and pricing data; and technical data) which the offeror, including its prospective subcontractor(s), does not want used or disclosed for any purpose other than for evaluation of the proposal. The use and disclosure of any data may be so restricted; provided, that the Government determines that the data is not required to be disclosed under the Freedom of Information Act, 5 U.S.C. 552, as amended, and the offeror marks the cover sheet of the proposal with the following legend, specifying the particular portions of the proposal which are to be restricted in accordance with the conditions of the legend. The Government's determination to withhold or disclose a record will be based upon the particular circumstances involving the record in question and whether the record may be exempted from disclosure under the Freedom of Information Act. The legend reads:

Unless disclosure is required by the Freedom of Information Act, 5 U.S.C.

552, as amended, (the Act) as determined by Freedom of Information (FOI) officials of the Department of Health and Human Services, data contained in the portions of this proposal which have been specifically identified by page number, paragraph, etc. by the offeror as containing restricted information shall not be used or disclosed except for evaluation purposes.

The offeror acknowledges that the Department may not be able to withhold a record (data, document, etc.) nor deny access to a record requested pursuant to the Act and that the Department's FOI officials must make that determination. The offeror hereby agrees that the Government is not liable for disclosure if the Department has determined that disclosure is required by the Act.

If a contract is awarded to the offeror as a result of, or in connection with, the submission of this proposal, the Government shall have right to use or disclose the data to the extent provided in the contract. Proposals not resulting in a contract remain subject to the Act.

The offeror also agrees that the Government is not liable for disclosure or use of unmarked data and may use or disclose the data for any purpose, including the release of the information pursuant to requests under the Act.

The data subject to this restriction are contained in pages (insert page numbers, paragraph designations, etc. or other identification).

(2) In addition, the offeror should mark each page of data it wishes to restrict with the following statement:

"Use or disclosure of data contained on this page is subject to the restriction on the cover sheet of this proposal or quotation."

(3) Offerors are cautioned that proposals submitted with restrictive legends or statements differing in substance from the above legend may not be considered for award. The Government reserves the right to reject any proposal submitted with a nonconforming legend.

(f) Contract award. (1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.

(2) The Government may reject any or all proposals if such action is in the Government's interest.

(3) The Government may waive informalities and minor irregularities in proposals received.

(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.

(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government's best interest to do so.

(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.

(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or sub line items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.

(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.

(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(i) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.

(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(iv) A summary of the rationale for award.

(v) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

The proposal must be prepared in three parts: a "Technical Proposal" a "Business Proposal", and a “Past Performance Proposal”. Each of these parts shall be separate and complete in itself so that evaluation of one may be accomplished independently of evaluation of the other. Alternate proposals, or deviations from any requirements of this RFP, must be clearly identified.

It is understood that your proposal will become part of the official contract file.

The RFP does not commit the Government to pay any cost for the preparation and submission of a proposal. In addition, the Contracting Officer is the only individual who can legally commit the Government to the expenditure of public funds in connection with proposed acquisition.

The Government will evaluate proposals in accordance with the evaluation criteria set forth in Section M of this request for proposals.

L.9 PRE-PROPOSAL CONFERENCE.

The Government will hold a pre-proposal conference to discuss the requirements of this solicitation at 10:00 a.m. on Saturday April 26, 2008 at 5600 Fishers Lane, Rockville, Maryland 20857. Offerors interested in attending should contact the following individual: Brendan Miller at bjmiller@psc.gov. All inquiries must include the Solicitation Number, your business name, and point of contact, address, telephone number and facsimile number. No questions will be answered over the telephone.

Attendees may also bring written questions to the proposal conference. If the answer requires research, there is no guarantee that the question will be able to be answered at that conference.

Following the conference, the Government will provide all prospective offerors who received a copy of the solicitation with a copy of all questions presented in writing before the conference, along with answers. If the answer requires a change to the solicitation, the Government will issue a solicitation amendment.

L.10 TECHNICAL PROPOSAL INSTRUCTIONS

Proposals which merely offer to conduct a program in accordance with the requirements of the Government's scope of work will not be eligible for award.

Your technical proposal shall consist of a series of technical plans or outlines that detail exactly how the Offeror will carry out the work that is specified in Section C of this solicitation. The "plans" that will be required are detailed in Section M of this solicitation. Each of the plans specified in Section C will be combined with any other information required elsewhere in this solicitation to comprise the "technical" proposal.

Your technical approach should be in as much detail as you consider necessary to fully explain your proposed technical approach or method. The technical proposal should reflect a clear understanding of the nature of the work being undertaken.

mailto:bjmiller@psc.gov mailto:bjmiller@psc.gov.

The technical proposal must include information on how the project is to be organized, staffed, and managed, including the proposed use of subcontractors to accomplish the work. Information should be provided which will demonstrate your understanding and management, of important events or tasks. You must explain how the management and coordination of employees and/or subcontractor efforts will be accomplished.

The technical proposal must provide the general background, experience, and qualification of the organization. Similar or related contracts or subcontracts should be included in the technical proposal. This information must contain the name of the customer, contract number, dollar amount, time of performance, and the names and telephone numbers of the Project Officer and Contracting Officer.

The technical proposal must contain a discussion of present or proposed facilities and equipment which will be used in the performance of the contract.

While technical proposals will not be limited to a certain number of pages, offerors are encouraged to be succinct and economical in their presentation. Excessive volume and elaborate presentation are unnecessary and will not be appreciated.

L.11 GOVERNMENT EXPECTATIONS WITH RESPECT TO THE TECHNICAL

PROPOSAL

As discussed above, the Government does not expect a technical proposal that merely restates the requirements of the Statement of Work. It is the intention of the Government to have the Contractor detail exactly how they would perform the work according to the minimum standards for performance found throughout this solicitation. It is not the intention of the Government to award a contract to an offeror that merely proposes to perform the work in accordance with the minimum requirements and standards called for in the Statement of Work. Offerors should be aware that the Government is asking potential Offerors to be innovative (where applicable) as to exactly how they would successfully perform the work called for under this solicitation in a manner that is both cost effective and requires minimal Governmental supervision.

At a minimum, the Technical proposal should be tailored to the requirements found in Section M of this solicitation in addition to any other information that the Offeror feels is necessary to demonstrate the Offeror's intentions and abilities.

L.12 TECHNICAL PROPOSAL CONTENTS

1. Table of Contents

2. Organizational experience including:

Past performance information - The Offeror shall provide information pertaining to contracts of similar complexity or magnitude. This information must contain the name of the customer, contract number, dollar amount, time of performance, and the names and telephone numbers of the Project Officer and Contracting Officer. A list of five past contracts of similar complexity and magnitude shall be provided. The Government will use this information to contact previous customers to obtain their responses to the past performance questions found on the last page of Section M.

Resumes of Key Personnel and Management that will be instrumental in the successful completion of the services to be performed shall be included. A commitment letter shall accompany any resume submitted which the candidate is not currently working for the contractor. This section must designate which supervisory employees are to be covered by the Service Contract Act.

3. Deduction table

The purpose of having the Contractor propose the deduction table is to give them the opportunity to demonstrate the effectiveness of their Quality Control Plan (Required in Section M). This will be accomplished by joining the Contractor's assurances of quality work and diligent supervision as proposed in their Quality Control Plan to a monetary deduction should the Contractor fail to perform satisfactorily

4. Development of a detailed program which describes how the Contractor will perform the work called for in Section C of this solicitation. The Contractor must include the following information:

General overall philosophy as to how the Contractor will accomplish specific cleaning requirements called for by the Statement of Work.

A task and frequency chart of the activities needed to perform the requirements as specified by the Government.

Lawn maintenance plan

Transition plan

Snow removal plan - the Contractor if proposing the use of a subcontractor shall submit as part of their proposal, a copy of a proposed contract with a recognized, competent snow removal company located within 30 miles of the building. The snow removal company shall have at least five (5) years of experience in the snow removal business. The Contractor shall provide an action plan which includes a commitment for heavy snow removal equipment for clearing and treating of parking lots and hauling of snow.

The Contractor shall include an inventory of the company's snow removal equipment that demonstrates backup capabilities should equipment breakdowns occur.

Quality control plan - the plan should be focused on how the Contractor plans to ensure that the work will be performed with a minimum of Governmental supervision. It is the responsibility of the Contractor and not the Government to ensure that the work is performed at a level that meets or exceeds all standards.

Emergency response procedures - emergencies frequently occur that require the assistance of custodial personnel.

The information presented above is only a suggestion as to how the technical proposal might be constructed. Please note that the evaluation of Technical proposals by the Government will be in accordance with the Technical Criteria found in Section M of this solicitation.

L.13 BUSINESS PROPOSAL INSTRUCTIONS

(a) Price Breakdown:

Prospective offerors are required to submit cost or pricing information in sufficient detail to allow for a complete cost analysis or at a minimum, price proposals adequate to establish the reasonableness of the proposed costs/price.

The breakdown of price shall include:

1. A breakdown of all direct labor to be employed on this contract by:

• Number of personnel

• Task of the employee and the number of hours per shift.

• Base rate of pay - this must include the hourly wage as dictated by the applicable Department of Labor (DOL) Wage Determination and any cash payment of applicable fringe benefits.

• Identification of those employees NOT covered by the DOL Wage Determination.

2. Fringe Benefit Rates, to include costs/elements comprising the rate.

3. Overhead Rate, to include costs/elements comprising the rate.

4. Other direct costs - including proposed subcontractors, supplies, etc.

5. General and Administrative Rate - including costs/elements comprising the rate.

6. Proposed profit

7. All items which may be amortized shall be done over a 42 month period.

(b) Administrative and Management Data:

1. The offeror's financial capability

2. Completed Pricing Template

3. Completed EXHIBIT 4, Deduction Schedule

The purpose of having the Contractor propose the deduction table is to give them the opportunity to demonstrate the effectiveness of their Quality Control Program (Required in Section M). This will be accomplished by joining the Contractor's assurances of quality work and diligent supervision as proposed in their Quality Control Program to a monetary deduction should the Contractor fail to perform satisfactorily.

4. Completed Section K

5. Standard Form LLL, “Disclosure of Lobbying Activities”

Your proposal must stipulate that it is predicated upon all the terms and conditions of this RFP. In addition, it must contain a statement to the effect that it is firm for a period of at least 90 days from the date of receipt thereof by the Government.

It is HHS policy that Contractors will provide all equipment and facilities necessary for performance of contracts; however, in some instances, an exception may be granted to furnish Government-owned property or to authorize purchase with contract funds. If additional equipment must be acquired, you shall include the description, estimated cost of each item, and whether you propose to furnish the item with your own funds.

You must identify all Government-owned property in your possession and all property acquired from Federal funds, to which you have title that is proposed to be used in the performance of the prospective contract.

L.14 PAST PERFORMANCE INSTRUCTIONS

1. The information described below shall be included as a separate section to be used in the evaluation of past performance for both responsibility determinations and as an evaluation factor. By past performance, the Government means the offeror's record of conforming to specifications and to standards of good workmanship, the offeror's adherence to contract schedules including the administrative aspects of performance;

the offerors reputation for reasonable and cooperative behavior and commitment to customer satisfaction; and generally to the offeror's business-like concern for the interests of the customer.

2. Offerors should note the difference between past performance and past experience.

Past performance is viewed as relating to "quality" and how well a contractor performed, while past experience is viewed as pertaining to the types and amounts of work previously performed by a contractor.

3. Offerors must provide a list of all comparable ongoing or completed projects awarded within the past 4 years. The offeror shall provide a description including the size, scope and complexity of each project, contract number, award dollar amount, projected final costs, performance period and type of contract. The name, agency, address and telephone number of Contracting Officer, Project Officer and any other pertinent officials that can verify performance shall be included. Offerors shall also include a brief explanation of any problems, delays or cost overruns, and any corrective actions taken in regards to cost, schedule or technical performance.

4. Comparable projects are defined as: contracts to provide security services in a building of similar proportions for Federal, State, Local, or educational institutions.

5. The burden of providing thorough and complete past performance information remains with the offeror. Explanations/comments regarding problems encountered and corrective actions taken shall be addressed as a part of the proposal submitted in response to this solicitation. The Government will take the offerors comments into consideration when conducting the past performance evaluation.

SECTION M – EVALAUTION FACTORS FOR AWARD

M.1 52.217-5 EVALUATION OF OPTIONS (JUL 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.

Evaluation of options will not obligate the Government to exercise the option(s).

M.2 GENERAL

Proposals received shall first be evaluated from a technical and past performance standpoint without regard to proposed prices. Those proposals which are considered to be technically acceptable shall then be evaluated from a financial/management standpoint.

Proposals which merely offer to conduct a program in accordance with the requirements of the Government's scope of work will not be eligible for an award.

The offeror must submit an explanation of the proposed technical approach in conjunction with the tasks to be performed in achieving the project objectives.

M.3 TECHNICAL EVALUATION

This evaluation shall be based upon the completeness and thoroughness of the proposals submitted. The offeror should show that the objectives stated in the proposal are understood and offer a logical approach for their achievement.

M.4 EVALUATION CRITERIA

The factors on the following pages will be used to technically evaluate proposals and will be weighted as indicated in establishing a numerical rating for all technical proposals submitted:

A. Understanding of the Requirements of the Contract 40 points

The proposal shall provide a series of detailed programs which describes how the Offeror proposes to accomplish the following elements of the Statement of Work:

Overall approach and methodology to perform the cleaning aspect of the contract including the ability to furnish supplies, equipment and manpower. This plan shall include a task and frequency chart of the services to be performed.

Lawn Maintenance Plan Quality Control Plan

Emergency Response Procedures

B. Organization Experience 35 points

Demonstrate organizational experience in managing a requirement of similar complexity. Include the following as a minimum:

1 . The relevant experience (resumes) of all key personnel that will be responsible for the management, supervision and successful performance of the proposed contract. (15 points)

2. Past performance information - provide a list of contracts of similar complexity or magnitude. This list must contain the name of the customer, contract number, dollar amount, period of performance, and the names and telephone numbers of the Project Officer and Contracting Officer. (20 points)

The information provided above will be used to contact your prior customers for a past performance survey. The questions that will be asked in this survey are included at the end of Section M.

Points shall be awarded for the following past performance ratings as determined from the customer surveys:

20 points Based on the offeror's performance record, no doubt exists that the offeror will successfully perform the required effort. A significant majority of sources of information are consistently firm in stating that the offeror's performance was superior and that they would do business with the offeror again without reservation.

15 points Based on the offeror's performance record, little doubt exists that the offeror will successfully perform the required effort. Most sources of information state that the offeror's performance was good, better than average, and that they would do business with the offeror again.

10 points No past performance history is identifiable. Newly formed companies that do not have any past performance information will be assigned 10 points for this element. NOTE: if no past performance information is furnished to the Government, the Offeror will be deemed to be unresponsive.

5 points Based on the offeror's past performance record, some doubt exists that the offeror will successfully perform the required effort. Many of the sources of information make unfavorable reports about the offeror's performance and express concern about doing business with the offeror again.

0 points Based on the offeror's performance record, serious doubt exists that the offeror will successfully perform the required effort. A significant majority of the sources of information consistently stated that the offeror's performance was entirely unsatisfactory and that they would not do business with the offeror again under any circumstances.

The Government reserves the right to evaluate relevant past performance information not specifically provided by the offeror.

C. Snow Removal Plan 15 points

The Offeror shall provide a detailed program demonstrating the overall approach and methodology to perform the snow removal aspect of the contract. Including the ability to furnish equipment and manpower based on common scenarios which typically occur during snow seasons in the Rockville area.

D. Deduction Table 10 points

The Offeror shall propose the amount of deductions that will be assessed against the Contractor in the event that the work called for under this solicitation is not satisfactorily performed. The Government will evaluate how committed the Contractor is to the concept of Quality Control, the oversight of contract employees and the work they perform. The deduction table is to be used in conjunction with the Quality Control program to be developed by the Contractor above.

M.5 BUSINESS EVALUATION

For evaluation purposes, the offeror’s price will be the proposed total price for all labor categories in Section B for the Base Year and for all Option Years. In the present solicitation, it is expected that competition will establish price reasonableness, and that comparison of the proposed prices will satisfy the requirement to perform a price analysis.

However, in view of the critical importance of this requirement, the Government reserves the right to examine price proposals for completeness, reasonableness, and/or realism to the extent it deems necessary or appropriate. Any lack of realism, unreasonableness or imbalance in offered prices may be considered in the determination of best value.

M.6 PAST PERFORMANCE EVALUATION

The offeror's past performance will be evaluated concurrently with the technical evaluation. A survey consisting of the questions contained in Section J will be conducted.

The Government will assess the relative risks associated with each offeror.

Performance risks are those associated with an offeror's likelihood of success in performing the acquisition requirements as indicated by that offeror's record of past performance. Past performance will be assigned a numerical rating as specified above.

When assessing performance risks, the Government will focus on the past performance of the offeror as it relates to all acquisition requirements, such as cost, schedule, and performance, including standards of good workmanship, the contractor's record of containing and forecasting costs on previously performed cost reimbursable contracts, the contractor's adherence to contract schedules, including the administrative aspects of performance; commitment to customer satisfaction, and generally, the contractor's business like concern for the interests of its customers.

M.7 Selection of Successful Offeror:

Discussions will be conducted with those offerors determined to be in the competitive range, however, the Contracting Officer, in accordance with FAR 52.215-1(f)(4), may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. You are advised that paramount consideration shall be given to price and other price related factors. Furthermore, cost/prices will be evaluated on the basis of cost realism, which is defined as the offeror’s ability to project costs/prices, which are reasonable and indicate that the offeror understands the nature and extent of the work to be performed.

Award shall be made to that responsible offeror submitting the proposal (Technical, Past Performance and Business) determined to represent the Best Value to the Government based on the criteria described in this section.
