About this file

This document contains Provisions to be Completed for two separate solicitations related to telecommunications equipment representations. The first solicitation (140P6425B0002) for Box Culvert - PIRO and the second solicitation (140P6425Q0027) for Radio Communication - PIRO both address federal requirements under Section 889 of the John S. McCain National Defense Authorization Act. The provisions require offerors to disclose and represent whether they provide or use covered telecommunications equipment or services, with specific mandates about reporting the origin, description, and potential use of such equipment or services. Offerors must check boxes indicating if they will or will not provide such equipment, and if they do, they must provide detailed information about the telecommunications technology, including the producing entity, equipment details, and an explanation of proposed use.

The documents outline two key prohibitions: 1) preventing executive agencies from procuring equipment, systems, or services using covered telecommunications equipment as a substantial component or critical technology after August 13, 2019, and 2) prohibiting contracts with entities using such equipment after August 13, 2020. The provisions require offerors to conduct a reasonable inquiry and review the System for Award Management (SAM) for excluded parties. Detailed disclosure requirements are specified for both equipment and services, including information about manufacturers, model numbers, product service codes, and explanations of proposed use that would demonstrate permissibility under the prohibition guidelines.
