About this file
This is a formal protest filed by EnviCare, LLC against the awarding of a Bio Medical Waste Removal Services contract issued by the Georgia Department of Public Health's Georgia Public Health Laboratory on June 16, 2022. EnviCare submitted their bid by the original deadline and contests the decision to extend the bidding period by additional weeks following their submission. The protesting party asserts that the contract was awarded to a competitor who submitted a bid $.40 lower than EnviCare's proposal coincidentally after the extension was granted, despite EnviCare being marked as unresponsive in the evaluation documentation. EnviCare challenges the unresponsive designation, maintaining detailed logs of all communications with the state and asserting that no attempt to contact them regarding responsiveness was made by the state or its representatives.
EnviCare argues that the bidding process was mishandled and requests that the award decision be reversed and the contract be reinstated to EnviCare based on their timely original submission and pricing. The protester contends that the circumstances surrounding the bid deadline extension, the subsequent lower competing bid, and their designation as unresponsive raise serious concerns regarding the integrity and propriety of the procurement process. EnviCare's legal counsel has reviewed the matter and concurs with the protester's position that the handling of the bid warrants reversal.

To Whom it may concern, I, Jon Lewis on behalf of EnviCare, LLC want to formally protest the Handling and awarding of the Bio Medical Waste Bid issued on June 16, 2022. The original bidding was extended additional weeks after original due date. EnviCare, first submitted the bid correctly and fully upon the stated original due date. An hour after the due date time there was an extension. We find this as well as our legal counsel "suspect" as to the provider awarded the bid, whom is normally the higher bidder on such bids, comes in coincidentally .40 cheaper than our bid after the extension.
In reading it states that EnviCare was unresponsive and our pricing was not noted as the others. We keep call, email, etc. logs of incoming and outgoing communications and even log missed calls. The state of Georgia or anyone attached to this bid did not reach out by any means of communication, so we would also like a response to the statement we were not responsive.
EnviCare finds it blatantly appalling at the misrepresentation of this bid and obviously misleading as to closed bids. We should have been awarded based upon our original bid amount as well as the timeliness of our submittal.
This bid should be immediately reversed and awarded to EnviCare!
Sincerely, Jon Lewis
