About this file

This is a Request for Proposal (RFP) issued by the Colorado Charter School Institute (CSI) seeking vendors to supply fresh fruits and raw vegetables—both bulk and individually wrapped (IW) portions—for the Fresh Fruit and Vegetable Program (FFVP) serving three charter schools in Southern Colorado: Kwiyagat Community School in Towaoc, Pagosa Peak Open School in Pagosa Springs, and Battle Rock Charter School in Cortez. The program serves approximately 300 students across these locations with weekly FFVP distributions. Vendors may propose locally grown Colorado products (harvested within two weeks of delivery) and non-locally grown produce, with a preference for Buy American compliance. Bid responses are due by July 21, 2026, at 9:00 AM MST via email to IleneAgustin@csi.state.co.us. The contract period runs from August 1, 2026, through June 30, 2027, with four optional one-year renewal periods available at CSI's discretion. No formal bidder's conference or site visit requirements are specified, though local producers may be subject to farm visits during the contract period to verify food safety practices.

Award will be determined based on a weighted rubric considering proposed pricing (21 points), vendor performance and reputation (20 points), delivery capability (20 points), financial responsibility (20 points), and ability to meet bid requirements including food safety plans (19 points). Pricing must be submitted as firm, FOB Destination quotes separated into raw food costs and delivery costs, with pack sizes specified. CSI Schools are tax-exempt and will not accept payment terms of less than 30 days or discounted terms of less than 10 days from receipt. Vendors must provide proof of minimum $1 million liability insurance and complete a Producer Food Safety Checklist demonstrating compliance with HACCP or on-farm food safety plans. All products must comply with the Buy American Act, with vendors required to certify domestic sourcing or document specific products unavailable domestically. CSI reserves the right to make supplemental purchases through Colorado State Bid Contracts or other sources and may cancel the contract with 30 days' written notice. Vendors must also comply with debarment, non-collusion, and lobbying certifications as required by federal regulations.

2.11 BUY AMERICAN

The 1998 reauthorization of the National School Lunch Act requires school districts participating in the

National School Meals Programs in the contiguous 48 states of the United States to buy food products produced in the United States (domestic) when using federal funds. Therefore, if there is a domestic and non-domestic food product available, you must supply domestic products. You may supply non-domestic products only when domestic products are unavailable. As defined in this legislation, a domestic food commodity is an agricultural commodity (for example beef, pork, chicken, fruits, vegetables, oils or grains) that is produced in the United States. A domestic food product is processed in the United States using substantially domestic agricultural commodities. Substantially means that over

51 percent of the finished processed product comes from American produced products. Implementing federal regulations are 7 CFR 210.21 and 220.16 published on September 20, 1999. You may be required to provide certification of domestic origin and content. You must certify that the majority of food products you propose to provide and supply meet the federal requirements in the “Buy American

Act” and stipulate which specific products are unavailable domestically. Exceptions to this rule would typically be pineapple, mandarin oranges, olives, tuna fish, tea, spices and coffee. In the event the

Proposer supplies or delivers products contrary to the requirements of this section or applicable laws and regulations, the District may pursue remedies for default as provided in Section 36, and or may terminate this Agreement as provided in Section 36. The Proposer shall hold the District harmless from any fines, penalties, costs or expenses imposed upon or incurred by any of them as a result of the

Proposer’s non-compliance with such laws and regulations. This purchasing requirement does not apply in instances when:

a) The product is not produced in the U.S. in sufficient and reasonable quantities of a satisfactory quality to meet general needs,

c) The cost of the US product is significantly higher than foreign products (the District defines significantly higher to be when US product is twenty-five percent higher than the foreign product).

2.12 EQUAL OPPORTUNITY

In accordance with Federal civil rights law and U.S. Department of Agriculture (USDA) civil rights regulations and policies, the USDA, its Agencies, offices, and employees, and institutions participating in or administering USDA programs are prohibited from discriminating based on race, color, national origin, sex, religious creed, disability, age, political beliefs, or reprisal or retaliation for prior civil rights activity in any program or activity conducted or funded by USDA.

Persons with disabilities who require alternative means of communication for program information (e.g.

Braille, large print, audiotape, American Sign Language, etc.), should contact the Agency (State or local) where they applied for benefits. Individuals who are deaf, hard of hearing or have speech disabilities may contact USDA through the Federal Relay Service at (800) 877-8339. Additionally, program information may be made available in languages other than English.

To file a program complaint of discrimination, complete the USDA Program Discrimination Complaint

Form, (AD-3027) found online at: http://www.ascr.usda.gov/complaint_filing_cust.html, and at any

USDA office, or write a letter addressed to USDA and provide in the letter all of the information requested in the form. To request a copy of the complaint form, call (866) 632-9992. Submit your completed form or letter to USDA by:

(1) mail: U.S. Department of Agriculture Office of the Assistant Secretary for Civil Rights 1400 Independence Avenue, SW Washington, D.C. 202509410.

(2) fax: (202) 690-7442; or

(3) email: program.intake@usda.gov.

In connection with the performance of any work under the bid, the vendor shall agree not to refuse to hire, discharge, promote or demote, or to discriminate in matters of compensation against any person otherwise qualified, solely because of race, creed, color, sex, national origin, disability or age.

PART 3- ACCEPTANCE

1. The Vendor agrees to comply with all Federal, State, and local laws, ordinances and all applicable rules, regulations, and standards.

2. CSI schools are tax-exempt. Exemption forms will be issued upon request.

3. The Vendor certifies that this Proposal is made without prior understanding, agreement, or connection with any corporation, firm, or person submitting a Proposal for the same materials, supplies, or equipment and is, in all respects, fair and without collusion or fraud.
