B.2 PRICE SCHEDULE DEFINITIONS
B.2.1 “Functional Areas” As used in this contract, “Functional areas” define specific areas of technical expertise required in the performance of this contract effort. There are nine functional areas:
B.2.1.1 “Account Management”: As the title implies, this function oversees the entire contract effort. Account Management includes the overall management of financial, material, and human resources. This functional area would most commonly address technical and contractual problems.
B.2.1.2 “Production of Ads”: As the title implies, this function includes the work related to the development and production of television and radio ads – from the development of storyboards to the final delivered product and the retagging of existing ads with state logos and/or icons.
B.2.1.3 “Media Buy”: As the title implies, this function includes the work related to planning, placing media buys and providing post-buy analysis. This includes traditional as well as nontraditional media outlets for national media campaigns and buys in local markets that support NHTSA demonstration projects.
B.2.1.4 “Events/Earned Media”: This function refers to the work related to planning, staging, pitching, and executing local press events to promote strategic highway safety messages. This includes completion of satellite media tours, bites and b-roll packages, and audio news releases. The contractor shall provide a studio in Washington DC for satellite media tours, bites and b-roll packages and audio news releases.
B.2.1.5 “Planning and Research”: This function refers to the work related to better identifying target audiences and their responses to communication strategies and messages. Planning and research efforts include focus group opportunities, mall intercepts, and web based feedback. This function also includes the work related to the planning and development of a national communications plan.
B.2.1.6 “State and Technical Research”: This function refers to any work associated with providing media support to states. Media support may include the review of media buy plans, creative executions and earned media discussions.
DTNH22-08-R-00085 “Media Support for National Communications Activities”
B.2.1.7 “Creative Collateral Material”: This function refers to work involved in the development of collateral material kits to support the primary high visibility campaigns for “Click it or Ticket” and Drunk Driving. Over the Limit. Under Arrest.
Collateral materials include posters, web banners, and other guerilla materials delivered in a web format for posting on the NHTSA website.
B.2.1.8 “Conference and National Forum”: This function refers to work related to speeches or presentations conducted by the contractor at national/regional conferences. Administrative support includes the finding and negotiation of hotel conference facilities, agenda development and speaker identification.
B.2.1.9 “Training”: This function refers to the work related to conducting the 2.5 day NHTSA communication course that NHTSA offers to state highway safety offices.
Work includes understanding the curriculum, presenting the training and updates.
B.2.2 "Loaded Labor Rates": As used in this contract, "Loaded Labor Rates" are composite rates for labor categories assigned to each of the three functional areas. These rates represent a weighted average based on the anticipated level of participation of each labor category within a function. The loaded labor rate includes the base rate (plus merit and or cost of living increases if applicable) plus indirect costs such as Fringe Benefits, Overhead, Facilities Capital Cost of Money (FCCM), G&A, and Fee or Profit. Loaded Labor Rates shall be fixed at time of contract award and shall remain fixed for the entire term of the contract (to include Option Years, if exercised).
B.2.3. "Regular" Loaded Labor Rates: Regular Loaded Labor Rates reflect rates paid for work performed during a normal workweek (generally 40 hours per workweek).
B.2.4 "Overtime" a). "Normal Workweek" means, generally, a workweek of 40 hours.
b). "Overtime" means time worked by a contractor's employee in excess of the employee's normal workweek.
c). "Overtime Premium" means the difference between the contractor's regular rate of pay to an employee for the shift involved and the higher rate paid for overtime.
d). Overtime shall be used only when approved in advance by the Contracting Officer.
B.2.5 Materials, Supplies, and all other Non-Labor Costs - For all materials, supplies, travel costs, subcontracting, and consultant’s costs, and all other non-direct labor (contractor’s labor) costs, the Contractor shall be reimbursed at cost including appropriate indirect costs.
Indirect costs include only those costs clearly excluded from the loaded labor rate and allocated in accordance with the Contractor's usual accounting practices consistent with FAR Part 31. The contractor shall not apply a fee or profit to materials, supplies, travel costs, subcontracting, and consultant’s costs, or other non-direct labor items furnished under this contract.
DTNH22-08-R-00085 “Media Support for National Communications Activities”
B.2.5.1 Materials Handling Costs: Application of Material Handling Costs to Materials is strictly prohibited under this contract unless documentation submitted with the proposal clearly shows that no part of the loaded labor rates includes such cost. Further, if a Material Handling Cost is shown to be appropriate through such documentation, only those indirect costs, including only that part of the G&A expenses allocated to direct materials in accordance with the Contractor's usual accounting practices consistent with FAR Part 31, shall be accepted. Materials’ Handling Costs shall be negotiated prior to award and shall remain fixed during the entire term of the contract. In the absence of such documentation, no Material Handling Costs as applied separately to Materials shall be reimbursable under this contract.
B.2.5.2 Subcontracts: The cost of subcontracts, (if applicable) to include subcontracts with consultants, is reimbursable costs under this clause. Reimbursable costs shall not include any costs arising from the letting, administration or supervision of performance of the subcontracts, if the costs are included in the hourly labor rates payable under this contract. The prime contractor shall not apply a fee or profit to subcontractors’ costs.
B.2.5.3 All Other Non-Labor Costs: Any and all other non-labor costs incurred during the performance of this contract shall be reimbursed at cost only.
B.2.5.4 Profits or Fee: Application of Profit or Fee to Materials, Subcontracting and all other Non-Labor Costs is strictly prohibited.
B.2.6 Travel Costs - The Contractor shall be reimbursed in accordance with FAR Part 31, as follows:
a. Costs for transportation may be based on mileage rates, actual costs incurred, or on a combination thereof, provided the method used results in a reasonable charge.
b. Costs for lodging, meals, and incidental expenses may be based upon per diem, actual expenses, or a combination thereof; such costs shall be considered to be reasonable and allowable only to the extent that they do not exceed on a daily basis the maximum per diem rates in effect at the time of travel as set forth in the following:
1) Federal Travel Regulations - for travel in the contiguous United States;
2) Joint Travel Regulations, Volume 2 DoD Civilian Personnel, Appendix A -for travel in Alaska, Hawaii, The Commonwealth of Puerto Rico, and territories and possessions of the United States; or
3) Standardized Regulations (Government Civilians, Foreign Areas), Section

DTNH22-08-R-00085 “Media Support for National Communications Activities”
c. Specific written approval from the Contracting Officer must be obtained in advance of any travel to foreign areas.
d. Non-reimbursable Travel: Travel expenses of any kind incurred for personal convenience between home and the contractor’s site will not be reimbursed under this contract.

Under Arrest. campaigns. Such funds have been identified in this contract as “Pass-Through of Congressionally Mandated Funds” or funds for Ad Hoc Advertising Air Time. As Congress provides pass-through funding to NHTSA, NHTSA will modify the contract, unilaterally, to add the amount of pass-through funding to the this cost category. Congressionally Mandated Funds or funds for Ad Hoc Advertising Air Time may not be used by the contractor to pay for any Functional Area, Other Direct or Travel Costs ; nor may the contractor use any part of Congressionally Mandated Funds to recover its indirect costs or fee. See Paragraph C.10.2 of this contract for further discussion on Congressionally Mandated Funds.
B.2.8 Ceiling Amounts: The ceiling amounts for this contract are as follows:
Base Period (First 36 months of the contract term). $ To be filled in at time of contract award.
Option Year One.................................. $ To be filled in at time of contract award.
Option Year Two..................................$ To be filled in at time of contract award.
The Not to Exceed (“NTE”) amounts shown for the Functional Areas and all other costs presented in Section B.3 “Price Schedules” of this contract are estimates only. Upon written authorization from the Contracting Officer, the Contractor may make line-item adjustments between “Other Direct Costs” categories. The ratios of “Functional Areas” used in the calculation of the Functional Area NTE amounts may also be adjusted upon written authorization from the Contracting Officer. The parties contemplate that the Government will allot additional funds incrementally up to the ceiling specified in Section B.3 of this contract. The Contractor agrees to perform, or have performed, work up to the point at which the total amount paid and payable by the Government under the contract approximates but does not exceed the total amount actually allotted by the Government.
b. The Contractor shall notify the Contracting Officer in writing whenever it has reason to believe that the costs it expects to incur under this contract in the next 60 days, when added to all costs previously incurred, will exceed 75 percent of the total amount so far allotted to the contract by the Government. The notice shall state the estimated amount of additional funds required to continue performance for the period specified in Section B.3.
c. Sixty days before the end of the period specified in the B.3., the Contractor shall notify the Contracting Officer in writing of the estimated amount of additional funds, if any, required to continue timely performance under this contract or for any further period specified in Section B.3. or otherwise agreed upon, and when the funds will be required.
d. If, after notification, additional funds are not allotted by the end of the period specified in Section B.3. or another agreed-upon date, upon the Contractor's written request the Contracting Officer will terminate the contract on that date in accordance with the provisions of the Termination clause of this contract. If the Contractor estimates that the funds available will allow it to continue to discharge its obligations beyond that date, it may specify a later date in its request, and the Contracting Officer may terminate the contract on that later date.
e. Except as required by other provisions of this contract, specifically citing and stated to be an exception to this clause-
(1). The Government is not obligated to reimburse the Contractor for costs incurred in excess of the total amount allotted by the Government to this contract; and

h. Change orders shall not be considered an authorization to exceed the estimated cost to the Government specified in the Schedule, unless they contain a statement increasing the estimated cost.
