About this file

This is a Request for Proposals (RFP) issued by the City of Pasadena's Transportation Department for professional services to prepare a Nexus Study updating the existing Traffic Reduction/Transportation Improvement Fee (TR/TIF). The project aims to review and update the methodology for calculating transportation impact fees, utilizing the City's 2017 TransCAD 7.0 Travel Demand Model to determine future development's fair share of infrastructure costs. The study will analyze transportation needs based on various planning documents, including the 2015 General Plan Mobility Element, Capital Improvement Program, and other transportation-related plans. The RFP was released on November 30, 2022, with proposals due by 12:00 pm on January 19, 2023. The initial contract term is one year, with an estimated budget of $45,000 - $65,000.

The proposal evaluation will be based on a comprehensive scoring system, with points awarded for approach (15%), experience (40%), ability to perform (20%), cost (15%), and additional preferences for local Pasadena businesses (5%) and small/micro-businesses (5%). Proposers must submit both technical and price proposals, with the technical proposal limited to 50 total pages. The city will conduct a thorough review process, potentially inviting top-ranked firms for oral clarification. Successful proposers must comply with various requirements, including the Pasadena Living Wage Ordinance, local hiring preferences, and provide necessary certifications and forms. The project will involve five primary tasks: project management, methodology review, future development analysis, draft and final reporting, and public meetings with various city commissions and the City Council.

1. INTRODUCTION

1. Summary

The City is seeking professional services to Prepare Nexus Study to update the existing Traffic Reduction/Transportation Improvement Fee (“TR/TIF”) to support the mobility initiatives identified in the 2015 General Plan http://www.cityofpasadena.net/GeneralPlan/

The update to DOT’s TR/TIF to be developed from this RFP will review existing City methodology and the methodology of other agencies in the development of transportation impact fees for long-range infrastructure improvements in the City; utilize projections in the City’s TransCAD 7.0 Travel Demand Model to determine a future development’s fair share of future facilities costs;

research future developments and future transportation needs from current transportation studies and reports; develop a comprehensive report that documents the City’s future transportation facility needs and cost; and determine the level of fees that may be imposed on future developments to pay their fair share cost of future transportation infrastructure improvements.

The City has estimated a budget of $45,000 - $65,000 for this effort.

2. Background

In 1981, the City of Pasadena established a New Development Impact Fee to help mitigate the traffic impacts of new development on the city’s transportation infrastructure. Following the adoption of the General Plan Update in 2004, City Council directed staff to study a new “fair share” transportation impact fee. The resulting Traffic Reduction and Transportation Improvement Fee (TR/TIF) was established by City Council in November 2006 and updated in July 2017.

The purpose of the TR/TIF is to help address the city-wide transportation infrastructure needs that are projected to be required in order to support the city’s growth as identified in the 2015 General Plan. With the adoption of the 2015 General Plan Land Use and Mobility Elements, a number of new transportation facilities, including transit, pedestrian and bicycle infrastructure were deemed necessary in order to address the potential impact of future new development on the City’s transportation system. The TR/TIF ensures that future developments pay their “fair share” of the cost of future facilities. TR/TIF funds are used to plan, design, and implement transportation improvements that align with the Mobility Element goals of livability, sustainability, neighborhood protection, and mobility.

The City’s current TR/TIF are assessed on developments based on the net new square feet of space or the number of net new dwelling units as identified in the table below. This fee is increased annually by the Consumer Price Index (CPI) or the Engineering News Record, Construction Cost Index.

TR/TIF fees for FY 2023

Land Use Unit Current Fee http://www.cityofpasadena.net/GeneralPlan/

Release Date: Wednesday, November 30, 2022

Industrial Net new square feet $1.28

Office Net new square feet $9.35

Retail Net new square feet $12.42

Single Family Residential Net new dwelling unit $10,257.02

Multi-family Residential Net new dwelling unit $3,971.78

The 2015 General Plan Mobility Element Update redefined critical aspects of Pasadena’s transportation policy. The city’s transportation system is expected to support the goals of livability, neighborhood protection and mobility. As a result, the City is electing to improve multimodal traffic operations, expanded transit, bicycle and pedestrian systems. To support these sustainable strategies, the City Council adopted new policies to include bicycle and pedestrian improvements identified in the Capital Improvements Projects (CIP) in the Fee.

In July 2017, City Council amended the TR/TIF as was supported by a Facility Needs List developed from a nexus study that determined the level of fees that may be imposed to pay for future facilities. The Needs List was and continues to be informed by a number of recent studies and reports that identify the City’s transportation infrastructure needs. The studies and reports, which include the City’s annual Capital Improvement Program, Intelligent Transportation Systems Master Plan Framework, Bicycle Transportation Action Plan, Short Range Transit Plan, Pedestrian Plan and American with Disabilities Act Transition plan, are updated on a regular basis, as appropriate.

In order to ensure the TR/TIF reflects the current and future project needs as defined in the Capital Improvement Program and updated action plans, a nexus study is needed to justify the level of fees that may be imposed to pay the cost of future facilities. The Department of Transportation is requesting proposals from qualified firms to recommend an updated TR/TIF with projected future development based on the City’s 2017 Travel Demand Model and future facilities (the Needs List) based on the FY 2023 CIP and previously referenced plans, including the Short Range Transit Plan, Pedestrian Plan, Bicycle Transportation Action Plan, Local Road Safety Plan, Intelligent Transportation System and Traffic Signal Master Plan.

Release Date: Wednesday, November 30, 2022

No. Evaluation Criteria Scoring Method Weight (Points)

1. Approach This criterion will be used to assign points based on how well the proposal demonstrates the Proposer's understanding of the project, and on how well the Proposer describes the approach to satisfy the City requirements identified in the SCOPE OF WORK. The Proposer should be able to explain how each task identified in this RFP will be accomplished. Highlight any ingenious approaches to achieve the project objective.

Points Based 15 (15% of Total)

2. Experience Points will be assigned for “Experience with Projects of this Size and Scope in an Agency of Similar Size” based on a vendor’s previous experience with municipal agencies, as delineated in the SCOPE OF WORK, and CLIENT REFERENCES. Relevant experience, and technical expertise of the Consultant and sub- Consultants (if allowed) to perform the work.

Maximum point value will be awarded to Proposers that have successfully worked with 3 or more cities/municipalities on similar scope projects within the last 5 years.

3. Ability to Perform Points will also be assigned based on availability and capability of the project team. Points will be assigned based on the qualifications of project team members identified in the "Statement of Qualifications" part of your proposal. The Proposer should include projects of similar scope that the project team member has done in the past with successful results.

The scoring will also be based on any additional number of value-added services, if any. If there are two or more firms with identical or very similar proposals, then the firm that provides the most value-added services beyond the RFP requirements will be assigned the higher score.

Points Based 20 (20% of Total)

Release Date: Wednesday, November 30, 2022

4. Cost Proposal Points will be assigned based on a “Ratio Method.” The proposer’s cost must include the delivery of the proposed solutions, as well as any recurring costs (if any) as delineated in the Scope of Work and the PRICE PROPOSAL.

With this method, the proposal with the lowest cost receives the maximum points allowed. All other proposals receive a percentage of the points available based on their cost relationship to the lowest price. This is determined by applying the following formula:

Lowest Price / Evaluated Price X maximum points available = Awarded Points

Example: The cost for the lowest proposal is $100,000. The next lowest proposal has a cost of $125,000. The total points available for cost = 30 points.

( $100,000 / $125,000 ) X 30 = 24 points

Reward Low Cost 15 (15% of Total)

5. Local Pasadena Business To be awarded a 5 point preference for this category, the proposer must have an official business address within the City of Pasadena at the time that this RFP is posted on the City’s Website.

9. PUBLIC CONTRACT CLAIMS PROCEDURE

PUBLIC CONTRACT CODE SEC. 9204 NEW PUBLIC WORKS CLAIMS PROCEDURE

AB 626, approved by the Governor on September 29, 2016, created a new Public Contract Code Section 9204, which specifies new procedural requirements for claims submitted by a contractor on any public works project. These new requirements contain burdens for both private contractors and public entities and are specifically made applicable to charter cities.

For this legislation, a “public works project” is defined as “the erection, construction, alteration, repair, or improvement of any public structure, building, road, or other public improvement of any kind.” This definition is not as broad as in the Prevailing Wage Law.

A “claim” is defined as “a separate demand by a contractor sent by registered mail or certified mail with return receipt requested…” and is limited to three types of contract disputes:

1. “A time extension…for relief from damages or penalties for delay assessed by a public entity….”

2. “Payment by the public entity of money or damages arising from work done by, or on behalf of, the contractor pursuant to the contract for a public works project and payment for which is not otherwise expressly provided or to which the claimant is not otherwise entitled”, and/or

3. “Payment of an amount that is disputed by the public entity.”

Upon receipt of a claim, a public entity must "conduct a reasonable review" and provide a written statement to the contractor within 45 days of receipt of the claim. Failure of a public entity to respond to a claim within the time periods described in Section 9204 "shall result in the claim being deemed rejected in its entirety."

For any undisputed portion of a claim, a public entity must make payment within 60 days of the public entity's issuance of the written statement.

If the contractor disputes the public entity's written statement, or if the public entity fails to respond, the contractor may demand "an informal conference to meet and confer for settlement of the issues in dispute." The public entity must schedule the meet and confer conference within 30 days of the demand.

Within 10 business days following the meet and confer conference, the public entity must provide a written statement identifying the portion of the claim that remains in dispute.

Any payment due on an undisputed portion of the claim must be made within 60 days of the meet and confer conference. Amounts not paid in a timely manner shall bear interest at 7 percent per year.

After the meet and confer conference, any disputed portion of the claim "shall be submitted to non-binding mediation." If mediation fails to resolve the dispute, the parts of the claim that remain in dispute shall be subject to applicable procedures outside Section 9204 (statutory and contractual).
