About this file

This document comprises pre-bid meeting minutes, attendees, and presentation slides for Palm Beach County's Inshore Annual Construction (Federalized) Project 2021ERM02, administered by the Environmental Resources Management (ERM) division in coordination with federally funding agencies including NOAA and the Fish & Wildlife Service. The project seeks to secure construction services for inshore estuarine habitat restoration including seagrass, mangrove, oyster, and artificial reef creation within Palm Beach County's coastal waters. Work will be issued on a task-by-task basis via Work Orders, with anticipated initial assignments including the Tarpon Cove Phase II Restoration and Monceaux Living Shoreline projects, estimated to involve 92,547 cubic yards of sand and 17,125 tons of rock. The pre-bid meeting occurred on April 21, 2021, with a non-mandatory site visit scheduled the same day at the FIND MSA-617C staging site. The bid submission deadline is May 10, 2021, at 2:00 PM at ERM offices (Vista Center, 4th Floor), with bid opening occurring at the same date and time. The contract will be awarded to the two lowest responsive responsible bidders and carries an initial two-year term from execution date with eligibility for a one-year extension. Liquidated damages are set at $450 per day for late Substantial Completion.

The Engineer's Estimate for the Base Bid with Option 1 (Contractor's staging area) is $8,921,843, and for Base Bid with Option 2 (FIND's staging area) is $7,211,650.40, with a base estimate of $370,880 for the initial two-year term. A bid bond of 5% of the Base Bid price is required at submission, and Performance and Payment bonds equal to 100% of each Work Order price are required prior to execution, along with an additional $100,000 bond if utilizing the FIND staging site. The project is federally funded through NOAA and Fish & Wildlife Service, making federal procurement requirements applicable; consequently, local preference and Equal Business Opportunity ordinances do not apply, and Davis Bacon wage rates do not apply. Monthly progress payments will be based on units of materials placed to lines and grades as verified through field inspection, truck tickets, and payment surveys by the contractor's Florida-licensed surveyor. Bidders must submit documentation of sand and stone sources, including geotechnical analysis performed within 18 months of the bid opening date, three references with valid contact information, and a list of subcontractors with assigned line items. Written questions must be submitted by May 3, 2021, to ERM-Bidding@pbcgov.org, with responses and any addenda posted to the County's Vendor Self-Service website.

3. Meeting

Welcome & Introductions Overview on Contract/Bidding Documents – Gretel Sarmiento This is the 2nd round of advertisement for this project. Bids submitted during the first advertisement period failed to comply with technical specifications outlined and were rejected.

Since that 1st round of advertisement, we have changed a few things including an additional bond requirement of $100,000 (if using the FIND staging site) and we have clarified the documentation we are requesting of the sand and stone sources.

All relevant information covered today pertaining to this project (dollar figures, deadlines and numbers) can be found in the solicitation currently posted via the County’s Vendor Self-Service (VSS) https://pbcvssp.co.palm-beach.fl.us/webapp/vssp/AltSelfService.

For updates on the stages of the procurement process, visit ERM’s website www.pbcgov.com/erm/

The deadline to submit proposals is Monday, May 10, 2021 at 2pm. That is also the date and time of the bid opening public meeting, which will take place at ERM offices located at 2300 North Jog Road, 4th Floor, Vista Center.

The contract documents, including plans and permits, are currently available free of charge through the VSS website referenced earlier. This is also the site where changes and responses to questions will be posted so be sure to check this website regularly.

Any bidding questions or requests for clarification are to be submitted in writing to ERM-

Bidding@pbcgov.org at least seven (7) days prior to the bid opening. That means the deadline for submitting inquiries is May 3, 2021 in this case.

The contract will be awarded to the two (2) lowest responsive responsible bidders following our review of the proposals submitted.

The contract has an initial term of 2 years from date of execution and is eligible for a 1-year extension.

Liquidated Damages have been set at $450 per day for late Substantial Completion.

This project is federally funded through NOAA and Fish & Wildlife Service, which means Federal requirements apply. These can be found right after the Instruction to Bidders section as Attachment 1.

Federal rules prohibit geographical preferences when procuring construction services, thus the County’s Equal Business Opportunity and Local Preference ordinances don’t apply.

The Bid Form portion of the solicitation contains all the forms necessary to submit a proposal. It’s critical that you use the forms provided (you can always add additional pages). Use the Checklist that serves as front cover to the Bid form section to check that all bid requirements and attachments are fully completed.

This will help you avoid common mistakes such as blank spaces and missing signatures.

As last time, we are asking that you submit a list of subcontractors you plan to engage with and indicate the line item each sub will be working on.

When you get to Bid Form - Attachment 5 (“Related Work Experience”) be sure to read this section carefully, particularly bullets G & H, where we describe the documentation we want of the sand and stone sources.

This is one of the areas where previous proposals fell short. Make sure the documentation you are submitting fits the criteria specified. For example, geotechnical analysis must have been performed within 18 months of the Bid Opening Date. Also, include valid contact information for your 3 references; not phone numbers that have been disconnected.

Bid bond is still set at 5% of the Base Bid price and due with your bid submission.

The Bid Schedule currently features 5 base bid items and 13 optional line items.

The Engineer’s Estimate for the Base Bid w/ Option Bid 1 (contractor’s staging area) = $8,921,843. The Engineer’s Estimate for the Base Bid w/ Option Bid 2 (FIND’s staging area) = $7,211,650.40.

If you are awarded the contract, you will receive our notice of Intent to Award. This notice will contain instructions on what documents to submit next. They include a certificate of insurance and the executed contract. They are due no later than 2 weeks (14 calendar days) after we issue the Intent to Award notice.

There will be no time extensions to submit these materials.

The Public Construction Bonds (Performance & Payment) are not due at the bid submission or intent to award stages. They will be required of the awarded contractor prior to execution of each Work Order. These public construction bonds must be in an amount equal to 100% of the Work Order price. This is also when that additional bond of $100,000 is due (again, only if you decide to use FIND’s staging site).

The County’s General Conditions are standard conditions and cover a wide range of contracts. Please review the Special Conditions section for project-specific conditions and details. In the event of a conflict between these conditions and the federal requirements, the federal requirements will prevail.

Appendix A contains useful forms to be used by the selected contractor(s) once the work begins and throughout the life of the contract.

https://pbcvssp.co.palm-beach.fl.us/webapp/vssp/AltSelfService https://pbcvssp.co.palm-beach.fl.us/webapp/vssp/AltSelfService https://pbcvssp.co.palm-beach.fl.us/webapp/vssp/AltSelfService http://www.pbcgov.com/erm/ mailto:ERM-Bidding@pbcgov.org

Appendix B pertains to post-bid information, which the County may or may not require of the selected bidders. If requested by the County, each bidder must be prepared to submit this information within 2 days of the request.

Overview on Technical Specifications (See accompanying slideshow) – Eric Anderson The objective of this Invitation for Bid and associated prospective construction Contract Documents is to identify and secure a contract necessary for the construction of inshore estuarine habitat restoration including creating seagrass, mangrove, oyster, or artificial reef in the estuarine waters of Palm Beach County.

Work Orders will be issued on a task-by-task basis for assignments anywhere within the coastal waters in Palm Beach County.

Anticipated Work Orders under the initial two-year contract include the Tarpon Cove Phase II Restoration and Monceaux Living Shoreline projects (see Attachment A - Schedule of Estimated Quantities).

The work shall be performed during daylight hours on weekdays and no staging of equipment, loading or unloading should occur in residential neighborhoods.

Bid submissions should contain true costs and account for purchase, transportation to the site, loading and placement of materials.

Each Work Order will be issued prior to start of construction and contain the applicable requirements, specifics, quantities, etc.

The total dollar amount for award of this Contract (Contract Price) shall be the Base Bid + Bid Option No.1 (Contractor staging area) or Base Bid + Bid Option No. 2 (FIND staging area).

The goal for issuing the first Work Order is shortly before or after completion of construction of Town of Palm Beach’s Marina in September 2021.

CONTRACTOR’s responsibilities include: Environmental Monitoring and Protection Plan, Turbidity Control Monitoring and Reporting, Construction Surveys, Warning Signs, etc.

The CONTRACTOR shall also provide documentation on the sand and stone materials stating who the source is and its capacity to provide the materials as outlined in the technical specifications.

Monthly progress payments shall be based on the units of materials placed to lines and grades in the Work Order and accepted by the COUNTY. Monthly progress payments shall be based on the units of materials verified through field inspection, truck tickets and payment surveys performed by the CONTRACTOR’S professional surveyor licensed in Florida.

Conclusion – Gretel Sarmiento The attendees list, minutes and PowerPoint presentation from today’s meeting will be uploaded to VSS.

A non-mandatory site visit will be held today at 2:00pm at South of Donald Ross Road, West side of Ellison

Wilson Road at the FIND MSA-617C site) unless nobody expresses interest, in which case it will be cancelled.

Remember to submit questions in writing to ERM-Bidding@pbcgov.org. Questions will be accepted until

May 3, 2021.
