Summary of Palm Beach County Inshore Annual Construction Contract Pre-Bid Meeting

This document comprises pre-bid meeting minutes, attendee sign-in sheets, and presentation slides for a federally-funded construction contract issued by Palm Beach County's Environmental Resources Management (ERM) department in partnership with the National Oceanic and Atmospheric Administration (NOAA) and Fish & Wildlife Service. The project involves inshore estuarine habitat restoration including the creation of seagrass, mangrove, oyster, and artificial reef habitats within the coastal waters of Palm Beach County, specifically at Tarpon Cove and Monceaux Park. The scope of work encompasses material sourcing, transportation via barge, and in-water placement of sand, stone, and other fill materials to designated depths and grades. Work will be issued through multiple work orders over an initial two-year contract term, with an eligible one-year extension. The pre-bid meeting was held virtually on December 3, 2020, with a non-mandatory site visit at the FIND MSA-617-C staging area that same day at 2:00 PM. The bid deadline and public opening was scheduled for Monday, December 14, 2020 at 2:00 PM at the ERM office in West Palm Beach. Award was to be made to two lowest responsive and responsible bidders whose bids were reasonable and compliant with specifications.

The engineer's estimate totals $6,048,260, consisting of a base bid of $370,880 and two alternate staging area options: Alternate No. 1 (Contractor Staging Area) at $5,677,380 or Alternate No. 2 (FIND MSA Staging Area) at $4,541,904, with the county selecting either alternate for final contract price. A bid bond of 5 percent of the base bid was required at submission. The project is federally funded, making federal procurement requirements applicable and rendering the county's local preference and emerging business ordinances inapplicable; Davis Bacon wage rates also do not apply. Liquidated damages are assessed at $450 per day for late substantial completion. Contractors bear responsibility for environmental monitoring and protection, turbidity control with Class III curtains, quality assurance, safety planning, and all surveying and payment verification through Florida-licensed surveyors. Material testing certifications by Florida-licensed engineers or geologists must be performed within six months of bid opening. Work is constrained to daylight hours on weekdays, with the FIND staging site limited to 8:00 AM to 5:00 PM on weekdays only. Twelve companies and one government agency attended the pre-bid meeting.

Bid deadline and opening is Monday, December 14, 2020 at 2pm. This public meeting will be held at the

ERM office on the 4th floor of 2300 North Jog Road, Vista Center.

The contract documents, including plans and permits, are currently available free of charge through the VSS website referenced earlier. This is also the site where changes and responses to questions will be posted so check this website regularly.

Any bidding questions or requests for clarification are to be submitted in writing to ERM-

Bidding@pbcgov.org at least seven (7) days prior to the bid opening. That means the deadline for submitting inquiries is December 7, 2020.

The contract will be awarded to the two (2) lowest responsive responsible bidders whose bids are reasonable and comply with the existing specifications. Note: there will be no substitution of materials or changes to the specifications.

The contract has an initial term of 2 years from date of execution and is eligible for a 1-year extension.

Liquidated Damages are $450 per day for late Substantial Completion.

This project is federally funded through NOAA and Fish & Wildlife Service, which means Federal requirements apply. These can be found right after the Instruction to Bidders section as Attachment 1.

Federal rules prohibit geographical preferences when procuring construction services, thus the county’s EBO and Local Preference ordinances don’t apply. Davis Bacon is also not applicable.

The Bid Form portion of the solicitation contains all the forms necessary to submit a proposal. It’s critical that you use the forms provided (you can always add additional pages). Use the Checklist that serves as front cover to the Bid form section to check that all bid requirements and attachments are fully completed.

This will help you avoid common mistakes such as blank spaces and missing signatures.

The Bid Schedule currently features 5 base bid items and 13 items under the alternate bid option. We are currently discussing a possible change to the line items under that alternate bid; look out for a possible addendum in the next few days.

The total engineer’s estimate is $6,048,260 (Base Bid + Alternate Bid).

Bid bond is 5% of the Base Bid price and due when you submit your bid.

We are also asking that you submit a list of subcontractors you plan to engage with and indicate the line item each sub will be working on.

When completing the related work experience form, please provide valid contact information for your 3 references; not phone numbers that have been deactivated.

If you are awarded the contract, you will receive our notice of Intent to Award. This notice will contain instructions on what documents to submit next. They include: performance and payment public construction bonds (100% of the 1st work order price), a certificate of insurance and the executed contract. They are due no later than 2 weeks (14 calendar days) after we issue the Intent to Award notice. There will be no time extensions to submit these materials.

The County’s General Conditions are broad and representative of all construction contracts. Please review the Special Conditions section for project-specific conditions and details. In the event of a conflict between these conditions and the federal requirements, the federal requirements will prevail.

Appendix A contains useful forms to be used by the selected contractor(s) throughout the life of the contract.

Overview on Special Conditions – Eric Anderson Discussions and materials provided during this pre-bid meeting are meant to provide guidance and highlight important points; they do not replace or govern over the contract documents.
