About this file
This document is a Justification for Other Than Full and Open Competition (J&A) from the U.S. Department of Justice's UNICOR Federal Prison Industries for the Lompoc Farm. The agency seeks to purchase nine premium full-blooded pedigree registered Angus bulls for their cow-calf cattle operation, valued at $85,000. Due to operational changes and urgent breeding needs, UNICOR wishes to negotiate directly with a vendor without a full competitive bidding process. Market research revealed that potential auction vendors were unwilling to register in the System for Award Management (SAM.gov), and the specific requirements for bull age and genetics limit vendor selection. The agency plans to post a Request for Information (RFI) on SAM.gov to identify future vendors and plans to compare proposed prices against local auction averages to ensure fair pricing.

Federal Prison Industries (UNICOR) Lompoc Farm (LOX1)
3. Nature and/or description of the action being approved.
Nine (9) Premium Full Blooded Pedigree Registered Angus bulls to be used as sires for the LOX1 Cow-Calf Cattle Operation to increase variety of genetics in the herd. $85,000
UNICOR wishes to waive other than full and open competition and negotiate with the potential vendor.
4. A description of the supplies or services required that meet the agency’s needs (including the estimated dollar amount).
9 – Premium Full Blooded Pedigree Registered Angus Bulls sires
5. Identification of the statutory authority permitting other than full and open competition.
41 U.S.C. 3304(a)(2)
6. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires the use of the authority cited.
Due to the operational changes by the agency the urgent need for the Angus Bulls to be able to breed the herd and keep on the birth cycle.
7. A description of effects made to ensure that offers are solicited from as many potential sources as is practical including whether a CBD notice was, or will be, publicized as required by Subpart 5.1 and, if not, which exception under 5.101 applies.
Other livestock providers were consulted about providing the bulls. Typically, bulls are acquired at certain times of the year through auctions where various vendors sell livestock.
The vendors associated with the bull auction were contacted and are unwilling to complete the process to register with the System for Award Management. The bulls must be of an appropriate age and genetic make up to fulfill the requirement at the Lompoc Cattle Operation.
8. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Prices proposed are lower that the average cost of bulls for auctions in the local area.
9. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
Markey research was conducted by getting the sale cost of similar bulls at multiple auctions. Reached out to multiple market auctions and it was found the auctions contacted were not registered in SAM.gov and were not will to register.
10. Any other facts supporting the use of other than full and open competition.
With the particular requirement for the types of bulls needed it limits the selection of vendors to purchase from. With the time constraints and need for the bulls we do not have the option to do full and open competition.

12. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services are required.
An RFI will be posted to SAM.gov to get future vendors. This will allow UNICOR to get information from vendors who can adequately provide the types of bulls required for this operation.
13. Contracting Officer’s certification that the information is accurate and complete to the best of the Contracting Officer’s knowledge and belief.
By signing the form, the contracting officer certifies the acceptability of the document.
