JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)
1. I, Deputy Local Guard Force Commander Andro Antonian, recommends that the Embassy use other than full and open competition for the acquisition of 5.11 STRYKE® PANT - 364 ea. The estimated cost is $27,600.
2. Nature and/or description of the action being approved.
The LGF requests approval to purchase the above-mentioned items: Make: 5.11;
Model: 5.11 STRYKE® PANT; Color - Tundra (192)
3. A description of the supplies or services required to meet the agency's needs.
The items being requested are mandatory uniforms for the 182 LGF.
4. An identification of the statutory authority permitting other than full and open competition.
This is a Brand Name Justification. "41 USC 253 (c)(1) Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements" Pieces of uniform LGF intends to purchase - 5.11 STRYKE® PANT must all be exactly of the specific model and color as requested.
5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).
RSO Tbilisi requests permission to purchase the Model 5.11 STRYKE® PANT for our LGF. Currently, the LGF have different colors and types of uniforms for day and night and for the summer and winter seasons. By streamlining the color and brand, we will not only simplify the uniform standards but save money in the long run.
Currently, uniforms cost $206.85 (three pairs at $68.95 each) per guard per year, but this amount will come down to $149.98 (two pairs at $74.99 each) per guard per year. This will bring the total costfrom $37,646 to $27,296 each year. We believe that the cost saved will be even higher as the STRYKE® PANT brand is the best on the market in material quality, color resilience, and durability.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The market survey has been conducted and it was determined that there is no alternative for the 5.11 STRYKE® PANT
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
9. Any other facts supporting the use of other than full and open competition.
See paragraph 8.
10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
