JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that Embassy Kigali, Rwanda use other than full and open competition for the acquisition Health Insurance Services for the Locally Engaged Staff (LES). The estimated cost is 300,300,000.00RWF, roughly $441,617.65

2. This LES Health Insurance contract is a contract for a period of one year from October 1, 2014 through September 30, 2015.

3. The American Embassy in Kigali requires Health Insurance coverage for the LES employees in Kigali, Rwanda. The US Embassy Kigali has determined that the prevailing practice by employers in Kigali is to provide for their employees health insurance protection and that the cost of such insurance protection is usually borne in full or in part by the employer. It has been determined that such health insurance protection is representative of local prevailing compensation practice.

4. The company is the sole responsible vendor based on previous acceptable work. Post is taking all necessary steps to have a new contract signed by September 30, 2015. Post could not compete this "one year contract" procurement due to the fact that the benefit levels are being re-evaluated for compliance with local practice and intends on awarding an other than full and open competition authorized under 41 U.S.C.253(c)(1).

5. There is one known responsible source for this current period. The current provider of the LES Heath Insurance, who can effectively continue the LES health insurance services while the new requirement is competed. They are proven to be technically qualified to continue this service.

6. The contract will serve only for the period until the award of the new contract.

7. Based on current market conditions and inflation, the anticipated cost for the U.S. Government is fair and reasonable. The price (premium rates) has been negotiated in such a way that it remains the same.

8. The Regional HRO was unable to carry out the market survey during last trip to Kigali.

9. Any other facts supporting the use of other than full and open competition.

The current medical insurance coverage expires September 30, 2014.

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.

None.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Post is currently in the process of competing a new contract.
