About this file

This is an Express NDAA Certification form issued by the United States Department of State that vendors must complete to demonstrate compliance with Public Law 115-232, the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year 2019. The form requires offerors to provide representations regarding their use of covered telecommunications equipment and services. Vendors must certify four specific compliance statements: that they do not provide covered telecommunications equipment or services as a substantial, essential, or critical component of any system in violation of Section 889(a)(1)(A); that they do not use covered telecommunications equipment or services within their enterprise as defined in Section 889(a)(1)(B); that they have conducted a reasonable inquiry to identify any covered telecommunications equipment or services in their possession; and that they will report to the Government in accordance with applicable contract requirements if they identify such equipment or services during contract performance.

The form requires vendors to complete four Yes/No certification statements and submit the completed certification to their Contract Specialist. The representation must be made by a person with authority to bind the merchant, with spaces provided for the merchant name, authorized representative signature with typed name, and authorized representative signature. The form directs vendors to first read the entire Section 889 portion of the provision and clause in the Federal Acquisition Regulation (FAR) at Acquisition.gov before completing the certification. This representation is a mandatory requirement for all federal procurement actions to ensure compliance with national security and supply chain risk management standards.
